My complaint is almost identical to complaint from "Anonymous, Walnut Creek, CA" Received phone call from SMTN sales rep who told me of company's services. I gave her my credit card info for a charge of $1148 for 1 sales ad and 2 rental ads. I received written forms by email requiring my signature and information on my properties. The forms which stated their services did not represent what Cincotta had claimed. I then did a websearch on SMTN and found numerous complaints a BBB rating of C-. I called back Cincotta that same day stating I was not signing the forms and to refund my money. They refused to refund. Then they placed ads on their site supposedly representing my properties. Since I had not given them my timeshare specifics the ads were totally false.

I have filed a dispute through my credit card company. I have also filed complaints with the BBB, the NH attorney general and the FTC. I am currently searching for lawyers or a firm willing to file a class action suit against these frauds. They need to be put out of business and pay major penalties for cheating hundreds of people out of millions of dollars (amount is assumed from reports of their profits).

I have read your post with great interest, as our company is always striving to work to the best of our ability with our customers to help them sell or rent their timeshares.

We have tracked your details in our database through your email address and have a good idea of what happened during your contact with us. Unfortunately, our sales representative did make a mistake in the information that she emailed out to you. However, you stated in an earlier complaint on another website that you sent us an email requesting a refund. We have investigated our server logs and we have no record of any emails from you requesting a refund. I understand that during your phone conversation with Mr. Cresta, you mentioned that you were also working with another company at the same time, in addition to ours, and I wonder if you inadvertently sent them the refund request. This does not excuse the mistake that was made with the original documents, but I am confused as to how we are "frauds or are cheating you when our mistake was sending you the wrong activation form. Since you gave us information on your timeshare in the original phone call, we would be very pleased to make the changes to your ads that are necessary, but you have not returned our phone calls.

You should have a copy of the email in question in your Sent Items box, and I would ask that you please forward a copy of the email directly to me at steveluba@sellmytimesharenow.com so I can substantiate your request. Such a written refund request would fall within our guidelines to grant such a request. However, as you have disputed your charge with your credit card company rather than allowing us to look into the matter for you, there is nothing we can do until the matter has run its course with the bank. Once we have heard from the bank, then we can revisit the matter and a copy of your email would certainly work in your favor.

I am sorry that this matter has gone as far as it has and please feel free to contact me directly if you have any questions.

Sincerely,
Steve Luba
