We bought a 2005 Escape last week from these people. When we test drove it we had to take the route that they told us to take (there were no left turns).We heard something in the frount end of the car and told the salesman who said nothing. The air in the car did not work we were told that it just needed charged (wrong the whole air needs replaced). We got the car at a lower price due to this fact so we signed papers and got approved for a loan. We had to leave before all the paper work was done so they let us take the car home.

Driving the car home we found that their was something bad going on with the front end when the car got to 55 miles per hour it drove bad. Also the breaks were bad so the next morning with down payment in hand we took it back to Sextons and told them all about the things that we found and that we felt that this car was unsafe to drive and we wanted them to check it out.

We were told at that time that they would not check it out and that we had already brought the car after several talks back and forth with the manager(who never spoke to us in person) we were told that they would do a diag on the car but if something was found we would have to pay for it. We told them that we did not feel comfortable doing the rest of the paper work or giving them a down payment on a unsafe car. 

We were then told by our sales person that the manager had told him to tell us '' The manager was going to let us hold the down payment over his head and that he would get the payment from us one way or another''We told him about the lemon law and that we were leaving. We were told then that we had bought that car and if we did not finish the deal that they would sue us and if we left the car there that they would have it towed and we would be responcable for all the towing charges. We have taken this car in and the est cost for all repairs are in the thousands.

we tried to give the car back to them that morning but they would not take it. We tried to get them to fix the problem by with holding or down payment. We were told that they would file  a law suit if we did not finish the deal. I told them that we were leaving anyway and I was told by the salesman that if we left before all paper work was done and the down payment was given to them that they would consider the car to be abandoned and would have it towed away. That we would be on the hook for all the towing fees and that they would sue us for the total of the car. We are not lawyers we did not know what they can or can not do. I have looked on the internet and we still are not sure what they can do. 

 We knew that the air was out but were told that this car had been threw inspection and that it only needed charged. So in good faith we told them that we would fix it for a lower price on the car and they agreed. What we did not know was that the brakes are gone the front end had a linkage problem and the right front tire has a plug in it. All these thing made the car unsafe to drive we explained this to them and were told it is as is sale so you are stuck with it. I do not think that a dealership is allowed to sell a car that is not safe to the people that are driving it and other that are on the road? We asked if we could look ar other cars but was told that we had already bought this one.

Here We Go Again...

You took this car on a "questionable" test drive and you noticed a problem right away. You also noticed the AC wasn't working. By the way...when an AC system needs to be "recharged" that's because the refridgerant leaked out. It just doesn't disappear! "Recharging" it does not solve the problem...it just gives the system new and more refridgerant to leak away. The salesman thought you were going to swallow this hook, line and sinker. These two problems which you were very astute to observe were deal breakers. Why did you move forward with a purchase of a car with known serious problems? What you did was voluntarily buy a car with known problems. You can blame them all you wish but you had the opportunity to NOT buy that car with known problems. Since nobody forced you to buy it, why are they at fault? Don't misunderstand me here. I think they are responsible to not sell junk and misrepresent it as non-junk! If they were a dealership which operated on honesty and integrity, they should have thanked you for pointing out the problems and then told you not to buy that car and instead show you others. That's exactly what a reputable dealer would have done. Instead, they were more interested in getting your money and then sliming their way out of their responsibilities to fix their junk. Bottom line is you were fantastic to notice the problems but you threw that away when you accepted less than what you the customer deserve.

I just read the lemon law in Illinois. There is no lemon law when it comes to used cars. (This is the case in most states.) I suggest you have a mechanic look at your car before you purchase it next time.

Did the purchase include a warranty? Was the vehicle purchased AS-IS?
