On, 8/14/04 we visited Shoma at GrandLakes, before we sign a contract for a $450.000 house, we specifically requested information regarding credit toward upgrades.

The sales agent Berenice Flores informed us that we would be given such credit upon color selection interview. We asked her to show us an example of how much appliances and tile upgrading would cost, to have a rough idea of total amount for everything we needed to change because they said that the model had many items that were not standard and we needed to give a 60% up- front for the total upgrade figure.

She said that Shoma does not give her an specific booklet showing the difference between the regular items and the upgraded ones. Also we placed a written contingence asking not to be force to purchase the alarm system with their company. Since it was required a 5 year contract or $600.00 if we decided to cancel at closing. After a few days the sales Rep called us saying shoma did agreed to our contingence. We then gave 2 check one i/a/o $5000 & a posdated one for $17,400. We called three times before our 2nd check was cashed to see if we could go to the color selection to assured that we were given credit toward the upgrades.

On 9/18/04 our appoiment for the color selection was due and we interview with Ilse Talavera and spent 4 hours trying to decide what to upgrade or not since they no longer give such credit. We left very dissapointed, since they were charging $39,115 for things that we though were supposed to be standard on such a priced house; and still could not afford the floring and the kitchen appliances.

We tried to arrange the price between regular appliances & the upgrade but it was imposible. They wanted full price and plus for the desired ones.

Same thing happened with the flooring, we select a different tile from the one offered and were ask to pay $17,200 more. What kind of pricing is that?. After all it is a 2700 sqf of tile. For that amount, we could have marble isntalled instead.

Where is the credit for the installation and the regular tile included in the price of the house? This is only an example of the ripoff. The list is too long to keep writting.

We want people like us, who are being umprofessionally treated and misrepresented, to speak out and inform future customer of risk involved when dealing with such developers.

I want Shoma to know that we are paying for that service it is not free and we should be intitled for the credit on labor and material not using in the upgrade. Where is the customer satisfaction agrement (SPA) mentioned on the very first web page of your advertisement? We would keep searching for an answer and hope Shoma stick to their promise.
