On September 18th 2003 I made a contract with shoma homes grand lakes development this is a new home to purchase a home I gave them a deposit in the amount of seven teen thousand dollars I was to fill out a mortgage contract with in seven days with Continental trust Mortgage their lender five days later I tried to cancel the contract due to the fact that my husband had lost his job but this was not the case my check had been cashed and we had not even been approved for the loan our sales person rosita cabrera was not as nice as she was at the beginning I was told that the only way to get the money back was to go to Continental Mortgage and do the paperwork will would not be approved for the loan and we will get our money back we were approved for a loan of $300,000 they have done everything they could to keep the 17,000 I cannot even get a 10,000 home equity loan which I have tried to do and was not approved I was ripped off and scam by shoma homes

RIP OFF RIP OFF SHOMA HOMES

It shoma Development Corp. is not in the business of ripping off customers then why can we even get $5 from our 17,000 then what is it called if not a rip-off and under all the circumstances I hope shoma Development Corp. does something good with the $17,000 I would like to hear from the owner not an employee this is not only rip-off but also a scam if we can even get approval for $10,000 how can we possibly be approved for 300,000 it doesn't make any sense and is not a COURTESY it's a rip-off rip-off MELISSA shoma homes protect itself by ripping off customers we did not change our minds this was all of our savings but didn't count on my husband losing his job merry Christmas and Happy New Year from my family and my kids.

Shoma Development Corporation is in the business of building quality homes NOT ripping customers off. Our Company and the buyer is bound by the terms of the sales contract. Once a buyer signs the agreement and offers consideration to bind the contract, that buyer, under Florida Statute has no legal remedies but to adhere to the agreement and to its terms.

Florida Law does not offer any grace period for buyers purchasing single-family homes from developers. As a COURTESY we offer our customers a 72-hour cancellation period whereby the buyer can cancel the contract and all deposits against such are refunded in full.

In this case, the buyers exceeded their 72-hour grace period and rightfully, our Company cashed the deposit check. Also, as stated by the buyer, they changed their minds five days later and exceeded the COURTESY grace period offered by Shoma. The buyer is not entitled to a refund of any sort.

Shoma Development Corporation in no way "ripped" this buyer off. Buyers of all types of purchases whether it be a T.V., a car, or a home need to be conscious of their decisions and be fully informed and educated about the terms of their agreement and their rights as buyers.

Unfortunately, this customer did not follow through with her end of the deal, and as a result, our Company protected itself under the terms of the executed sales contract.
