Shop NBC Misleading advertising Nationwide Minnesota

On or around 2/9/07 I was watching T.V. late at night when I came across the Shop NBC station. They were advertising a 37 inch Akai 1080P high tech T.V. They claimed that the T.V. was brand new and the latest technology, was really great and that when it comes out into the stores the price would be from $500-$600 higher than the $1,200 plus shipping cost that they were offering it for. Basically saying that this was a pre store special discount price.

Based on the big savings, I was swayed to purchase the T.V. and on the fact that NBC Television network was behind this sale as they were using the NBC logo.

I received the T.V. about a week later and actually liked it and was happy about the purchase. About 35 days after receiving the set, I was shopping in Office Depot and they had the exact same T.V. the Akai 1080P, Viella for only $749.

I immediately went home and called Shop NBC to complain. They told me that they have a 30 days refund policy and I was a few days over that so they would not do anything and I have to keep the set without any consideration. I requested to either pay the $749 in store price or send the set back, be refunded what I already paid and owe no more as I was on a monthly payment plan and then buy the set from Office Depot. I called Shop NBC for 2 weeks speaking to supervisor after supervisor and they all flatly refused to do anything.

The last conversation I had with them I told them I was contacting my credit card bank and filing a complaint with them that I was mis-represented and defrauded. The credit card company is presently investigating the issue. I asked again how and where to send the T.V. back to and the representative told me that they will not accept the T.V. back and that I should keep it. As stated, I wish to send the set back or only pay what I could have bought it for from Office Depot which is a total of $749.

I also filed a complaint with the Minnesota attorney general's office who will also be investigating the issue.

Just because a company is utilizing a household name NBC should not give them a license to utilize unfair and deceptive trade practices and trick people out of their hard earned money.
