I used photographer Jennifer Espensen of Schutterschmack headshots to do headshots for me.  I met with Ms. Espensen Wr a consultation prior to the shoot.  During this consultation I explained to her I wanted a specific type of shot that reflected a vintage/period feel.  I asked her if she could do this for me and she said yes.  Come the day of the shoot she was unable to do this.  I also told her I did not want to be photographed at certain angles because they were unflattering.  She took notes but come the day of the shoot she did everything I asked her not to do.  When I received the proof many of them were either in shadow or way too bright in exposure.  It is clear Ms. Espensen is not a professional photographer only an amateur and does not understand lighting.  When I told Ms. Espensen I was not happy with the proofs she told me I would have to correct the mistakes she made in photoshop.  I did not hire what I thought was a professional photographer to correct things in photoshop.  I then asked Ms. Espensen for a refund on the photoshoot as the quality of her photos were not good.  She is refusing to give me a refund and I'm now stuck with photos I can't use.  I believe if Ms. Espensen does not understand lighting and needs to make corrections in photoshop she needs to let the client know before she books them.  Also she needs to deliver what she promises in the consultation.  If she could not do a specific type of photo I wanted she should have said right away she was not capable of doing it and I would not have hired her. Ms. Espensen is claiming that I saw the photos the day of the shoot and said they looked good and gave me approval.  This is not entirely true.  I did not see the proofs the day of the shoot. I never would have given my approval to photos in shadow or over exposed photos.  I would like a full refund on my photoshoot as the quality of Ms. Espensen's work is sub-par and she did not deliver on what she promised in the conusultation.

Rebuttal to Shutterschmack's response.

AUTHOR: - ()

Ms. Espensen's offer to reshoot the last look was turned down because the whole shoot was bad.  As I stated in my original complaint you pay a "professional" photographer because they understand lighting and you should not have to pay to retouch those kind of things in photoshop.  Ms. Espensen only offered to correct three of the images.  This was not a satisfactory resolution to the shoot because nearly all of the shots were either in shadow or dark or overexposed and too light.  She should have offered to redo the entire shoot.  Since she was not willing to do this I said I would except the shoot if she color corrected every single image.  She refused that offer.  I also find it very funny that the "testimonials" to her work are given by two people she pays to advirtise her services with and a former collegue (photographer) she used to work with who she trashed and spoke ill of to me on the day of my photoshoot.  I realize that I am never going to get my money back for this shoot but other's should be aware that she is a total ripoff.

Have Spoken to client via mediation to try and satisfy her complaint

To Whom it may concern,

I wish to resolve this in a friendly manner and make right Ms. Marlowe's dissatisfaction with her images.

Ms. Catherine Marlowe's complaint has been through a process of mediation in which I have offerred to reshoot the look in question.  The day of her session, it rained in the morning, but it was her decision to move forward with the session.  I have multiple email correspondance offering her the choice to reschdule prior to the day of shooting, and leaving the decision to her.

We did meet for a consultation and go over the "looks" or outfits which Ms. Marlowe wanted to shoot.  In our eight hour session, we did in fact shoot each one of those looks.  She was unhappy with her hair in the final look, and again, I have offerred to reshoot that for her free of charge.  She at this point has declined the offer, but it stands in perpertuity.

She has filed complaints asking for different compensation including money back on a nonrefundable session, (which is clearly stated on the website policies), and editing work on over 500 images.  She recieves three fully retouched images in the session rate which as of this date she has not choosen to follow through on.  If and when she chooses to complete the process, I will have those ready for her.  Full editing is not standard in headshot proofs for an enitre session, and in no way is listed in the services on my rates page.

I allowed Ms. Marlowe to view the images as we shot during her session, and she approved the day of the shoot.  It is only afterwards that she is asking for money back.  Again, the offer stands to reshoot a look that she would like to do differently free of charge.  The work Ms. Marlowe recieved is what is represented on my website.

See below testimonies regarding my work, and specifically Catherine Brown- Marlowe's session.

To Whom It May Concern at the NYC Office of Consumer Affairs:

My name is Tony Nation. I’ve been one of the partners at Actors Connection in NY for over 17 years and a professional actor since 1991.

This letter is on behalf of Jennifer Espensen who I’ve worked with for many years as one of the professional headshot photographers who we consistently recommend.

Jen has been a delight to work with and in my professional opinion her work is always top notch and on par with what the industry is looking for in headshots and lifestyle images.

The Actors Connection client who has filed the current complaint has had a history of getting professional headshots and then hating them afterwards.

I viewed the images and they are an accurate representation of the type of photography that Jen advertises.

Please feel free to contact me if you need any more information. For more information on Actors Connection, please feel free to visit our website at www.actorsconnection.com.

Sincerely,

Tony

Dear Sir or Madam,

My name is Ben Esner, and I'm a headshot photographer in NYC. I have been working in the headshot industry for 15 years.
Industry standard for deliverables is to deliver original images without color- correction or retouching. Once the client chooses her shots that she will be using, a retoucher (or the photographer) will adjust those particular images individually to her liking.

Generally, when images come out of the camera without any adjustment, the colors will be muted; some might be a little lighter or little darker, especially if they were shot outdoors. And there are always little details that need to be adjusted, such as flyaway hairs, wrinkles, blemishes, etc.
I always tell my clients that when looking through through their proofs, to choose their shots based only on their expression and the background, keeping in mind that all other aspects can, and likely will, be adjusted for the final product.

Best,
Ben Esner
