I have done business with Sierra Auction Management for quite a while now.  I have bought anything from sports cars down from them.  I purchased newer model sports car they said ran that didn't, many electronics that have been reported stolen. as with any auction, there have been good times and bad, although my experience is that i have a lot more questionable items than most places. I'm not here to question the merchandise though.  I won't speculate if they had any knowledge of the condition or status of these items when they were sold.  

 

I have, however, noticed that they have had an additional charge for both my PayPal accounts and my debit card for transactions there.  When I initially brought to their attention that these charges were either illegal for debit, or against the terms of service of PayPal, they completely ignored me.  When I pushed the issue, they made it clear my thoughts on the matter were of no concern to them.  Now their stance on this was that they were not charging an additional 3% for those things, but i can document otherwise.  Their website clearly stated (they have since corrected it) that there is a 12% buyers premium for that auction.  It didn't say 16%, or mention a cash discount, or anything else.  It clearly stated 12%.  The invoice provided had a 12% buyer's premium attatched to it.  If a payment was made as previously stated, they would add an additional 3% to that.  When I got PayPal involved, they agreed that was outside of the Terms of Use of PayPal and refunded my money.  There are still so many people out there who haven't gotten their money back if this is PayPal's stance on this.  I have been charged many times to pay with a debit card.  

 

I am in the process of filing paperwork with the Arizona Attorney General's Office now.  Although I studied business law in college, I am not a lawyer.  I do not know exactly what the implications are of doing this.  I have been told, and my research points to that this should be looked into.  If you believe this applies to you, I urge you to contact someone to get a professional opinion on this.  

 

If needed, I can provide a saved copy of the page stating the 13% premium for transactions.  I will attach it to this report if possible when I submit it.

Sierra Auction Management has been in business for almost 30 years and has a stellar reputation of conducting auctions in an ethical and fair manner.  All fees are fully disclosed in many different places and Mr. Lewis agreed to those fees and had every opportunity to take them into consideration prior to placing any bids.  Mr. Lewis, like all of our buyers, can take advantage of a cash discount by paying cash at our location or depositing the cash discounted amount into one of our four major bank accounts.  We have thousands of buyers who transact business with us, using any one of our multiple methods of payment with the understanding that if they use cash or a cash equivalent method of payment, they will receive the cash discount.  This method of operation is a generally accepted practice in our industry and if one were to take the time to review other auction companies around the country, he/she will find similar terms and conditions.

What this complainant fails to tell you is he, registered as "Chris Lewis" in our system, has had previous disputes with Sierra and to which we've been able to resolve to each party's mutual satisfaction.  He contends that Sierra "completely ignored" him, yet we both have several email exchanges suggesting otherwise. It would have been more accurate of him to state that Sierra did not satisfy his demand to change our terms and conditions which have been in place for several years.

This final complaint with us over the same fees he has agreed to pay in each auction over the past several years could not resolved to his satisfaction and after many threats of legal action we removed him from bidding in future auctions.  He then re-registered for our next auction under a different name as "Thomas Lewis" - same address and email.  Once we realized that he had registered under a different name and was banned a second time, he personally researched members of my family and my personal investments and brought them into an email exchange in an attempt to threaten me and/or gain some sort of advantage in our negotiations. Mr. Lewis has received all the items he purchase for the cost he agreed to when he registered to bid. At this point we believe this complaint has been resolved per our agreed upon terms and conditions and have barred Mr. Lewis from bidding in any future auctions. We believe that we have resolved Mr. Lewis’s issues in the fairest possible manner and that we can defend our actions both morally and legally.
