I was linked to this "great product" called Simply Garcinia and Simply Green Coffee Bean, designed to help with fat burn and weight loss. It's an all-natural supplement, and when i googled it, there were many positice reviews. They offer a "free trial" where you pay only shipping, which amounts to about $10 for both products. I thought that was fair, so signed up. here is what it says at the bottom of their web page:

"Unlike Garcinia knock-offs, we stand behind the 100% Quality Guarantee of our products and allow you to try it for zero cost when you order today. Pay only $5.95 for shipping and we’ll send you a month’s supply of Simply Garcinia. We are that confident you will love the fat burning results!"

I signed up, and received the product in 2 days. I received around 10 "shipment confirmation" emails, which already made me nervous that they weren't great at record-keeping. The product didn't work for me, and so i called to cancel. They "couldn't find my account," and tried my name, email address, phone, and credit card number, yet couldn't find it. They asked me to fax to a number and ask them to help me cancel. I never heard back. Then I find out they charged my card $160 over a week ago, before me 14-day trial was up. I called back today, and they magically (*gasp*) found my account right away. (?!?!) I told her I didn't want any more product, and she told me the charge was for the free trial product! I balked, and she claimed it was explained in the fine print. Let me copy exactly what was in the email confirmation I receieved:

"Terms & Conditions. Try Simply Green Coffee Bean for 14 days. If you elect not to continue with Simply Green Coffee Bean, just call our toll free to cancel at 800-635-5589 in the US during the 14-day trial period to cancel. Then just return the bottle (even if it is empty) without further obligation. We cannot refund the cost of shipping and handling.

If you decide to keep Simply Green Coffee Bean, we charge you $78.98 (25% off our regular retail price) at the end of your Trial period and you start on the auto-ship program to ensure you receive a new bottle of Simply Green Coffee Bean every 30 days at the same discounted rate of $78.98 so you can continue to look and feel your absolute best."

I read that, and I'm sure most people do as well, that if i don't cancel, they'll charge me $78.98 and put me on an auto-ship program, meaning I'll pay that amount for a new bottle. It is not clearly stated that charge is for the "free trial" bottle. I'm sure they have some legal loophole that lets them get away with it, but that's b.s.

I told the lady I thought that was a bit unfair, as it's not that clear, and that by the way, they charged me on the 30th of June when the product didn't ship until the 17th, meaning I didn't get a full 14 days to try the product. she then said that "somewhere" it says that the trial starts the day I order (how can that be when i have nothing to try?) and that i can call when i get the product to move the trial start date. Um, none of the emails I received, nor the paper that came with the product said anything.

All she would do for me is credit me 50% refund and tell me to call back when the product is gone, as she's "sure" i'll love it and want to continue. Ha! I always read the fine print, but I see now it was so loosely worded it protects them and I'm out $90. Even if the product worked for me I wouldn't pay that much!

don't fall for this, they are too clever and will take your money. i told her outright that it's unfair and their terms are unclear and wanted a manager, but no dice. she didn't care.

THIS IS NOT A REBUTTAL BUT A BIT OF INFORMATION

AUTHOR: NYArtist - ()

POSTED: Tuesday, December 09, 2014

I filed a complaint here, with the Canadian consumer affairs office and the BBB of Canada and lo and behold this morning, just hours after I filed the complaints, I was given a refund in full, including for the shipping cost for the free trial.

I encourage everyone to file complaints with both the Canadian and American (Savannah, GA) Better Business Bureaus and the Canadian govt as well as consumer fraud in your region and in GA as well.  Enough complaints and this company will be investigated.  Be sure to file with the GA Attorney General's Office.  LET'S SHUT SIMPLY GARCINIA DOWN!
