Solymar Homes Scam, Fraud, ripoff and dishonest Phoenix Arizona

Met with Gary Miller (Sales Rep) on 8/2 and deposited $30k in the form of a check. We were told that we would not be obligated to anything other than the cost of the Architect (not to exceed $4,500) up until we gave complete approval of the plans. (I confirmed this by telephone and have a tape recording of this) As of today the plans have not been approved by us and the city has not approved them either due to changes needed.

We initially worked with another architect Jeff Page and on 9/28 addressed my concerns with this architect. Gary stated they have had a lot of complaints in regards to Jeff and that they would have another Architect contact me to fix the issue and make everything go smoother.

We met with Carlos Montoya on 10/10. After that we experienced the same time and communication challenges that we had with Jeff Page. (I have copies of all of the emails as proof) We have been fighting with this process since 8/2 and have copied Tony (Owner) on all emails. He never responded to our frustrations until we talked about cancelling our contract. I have both written, emails and tape recordings of our frustrations and promises made by Solymar Homes. I have emailed Tony and the main email address of Solymar homes of our intentions to cancel on the following dates with no reply back. (2/11/2007, 2/13/2007, 2/15/2007, and 2/18/2007.

We gave 48hrs for a reply and they haven't responded to any of them. Then on 2/21/2007 we filed an official Complaint with the Registrar of Contractors. A copy of the complaint went to Solymar on 3/15/2007. (16 Business days from my initial complaint) After no response from Solymar my case was turned over to the legal department and the Official Complaint was mailed on 5/1/2007. (48 days from my initial complaint) Solymar had until 5/16/2007 to respond and they still have not. I am contacting Amanda Mann on Monday 5/21/2007 for an update as we have not been informed of our next actions.

The ROC's Mission Statement To promote quality Construction by Arizona contractors through a licensing and regulatory system designed to protect the health, safety, and welfare of the public is a JOKE! What type of regulatory system would allow Gary Miller to open yet his 3rd license intended to scam more Arizona Residents. 1st Company started was Express Builders #ROC174329 where there are more than 33 victims and the ROC revoked the license. 2nd is Solymar Homes #ROC191016 where there is currently 43 victims and is about to have their license revoked. Now there is H and M Construction #ROC231577 where I am sure they will have a good number of victims in 6 12 months. How many Victims will it take before someone does something about this?

Our Family, as well as many others are victims here and feel that the process and the laws support the criminals more than the victims! I hope you are never put in this situation as the same people we vote for lack the courage and leadership to protect the public.
