I received a citation from South Bay Expressway telling me I evaded a toll.  Gave me the date and time.  My wife was driving my car at the time.  We went to our financial institution to get a report (since we always use our card at the toll booth).  The bank told us we were charged twice withing a six minute period and that the second one was returned to us by SBX.

We submitted out our request for an investigation complete with a printout of the charge on the date in question.  We have since received the results of that investigation and are still told we are in violation and that they will grant us a one time waiver and only charge us $3 for the toll (which was already paid for that day) and a $10 fee to recoup their processing and collection costs.

The letter also stated that I had to pay within 7 days of the date of the letter.  It took 3 days for the letter to get to us...locally.  So now I have 1 day, since they aren't open on the weekends to get this taken care of or they threaten me to the DMV and extort an outrageous fine.

I don't feel as though I should have to pay for their system error.  I feel as though they need to put in a receipt option for those that pay at the booth.

I feel as though they are fraudulently hitting people with these bogus fines to try and recoup money lost when the builder went bankrupt.  I hope there is a lawsuit, class action or otherwise, so they will stop their illegal and shady practices.  Depending on the outcome of when I talk to them monday, I am more than likely to report this to the local news stations who do investigative work for the little guy who gets bullied around by big companies.

I also paid the toll with my credit card. They would not accept credit card statement. Tell us, how did the administrative hearing go.   It looks like I'm going to be forced to do that too.

The other report where the drive DID back up to get out of Fast Trak got their fine thrown out after appealing it, so there's no reason they ought not do the same for you. Look up the report for any details I may have forgotten.

Okay, voiceofreason, let me spell it out for you since your reading/comprehension skills seem to be lacking.  There was no wrong lane, there was no higher toll lane.  There are 2 lanes.  Fast Trak and Pay.  I use the pay lane.  When going through said pay lane, I use the credit card machine, the light then turns green, therefore I go.  It really is as simple as that.  There was a mess up on their end.  My guess is, it's just a machine error.  However they do not want to admit that.  I have explained this to them in a letter and over the phone.

I contacted my financial institution with the exact date and time of the citation and they said SBX took the toll, then returned it.  I included in the letter that they need to have a conference call with me and my financial instutuion to verify this information.  During their investigation this never happened.

I don't know how much simpler I can put this.  I am not at fault, if I were I would have paid the first time I received the citation or would have used the pay by plate option if you go through the toll and don't have the money.  That amount if $5 I think.  I know how this toll road works I have used it plenty.  I just feel they need to admit their error and be done with it.  Or put in a receipt option for those that use the pay lane.  I feel as though this won't happen, because then people would have proof of payment when bogus or faulty citations get sent out.

The $13 is not worth the consequences

Pay the bloody $13 and be done with it. You could have gotten a far worse summons for backing up on a highway to get into the right lane.  you screwed up once, found yourself in a more expensive toll lane than you intended to use, thought you could back out of it cleanly. It didn't work and now you have this. It's not like you have a cut and dry case of they're wrong and you're right. It's a gray area and you're courting larger trouble by not paying.

Just pay it and be done with it and write it off to experience.

Follow-up call

I called SBX today and they proceded to tell me what I already knew.  I tried explaining more to them and all I would be told is to accept the low payment (i.e. accept guilt) of $13, or in order for me to have a hearing I would still have to pay the full $63 fine.  So, I am wondering how many people who took the cheap way out just to get it done with.  Especially due to the fact that in todays economy not a lot of people just have $63 to throw away on a bogus charge. 

I am a man of integrity and if I am at fault I would gladly pay.  However, if I am right and I know I am right...then I just get mad at companies that try to bully around the little guy.  I would at least like to see the photo or video of me running the toll without paying.  I do seriously doubt that they can or will provide such evidence.

Now in response to your sincere sounding letter to resolve this issue.  Let me guess, I contact you through your website and you then tell me I have to pay the full amount and get the hearing.  Then wait to see if you guys actually do any real investigation/hearing or delay for a time and then come back to me saying you have reviewed it again and I am still "guilty"??

The sad part of all of this is that I was about to setup an account for SBX.  Now I will avoid it like the plague, and will recommend to others to do the same.  I hope whoever "owns" or is responsible for the SBX now goes completely under and you all lose your jobs, especially if you know the company you work for is intentionally doing this to people and say nothing.....
