We used the 125 toll road with no problems to get to Chula Vista. Nice empty road. When we went to return northbound I ended up in the Fast Trak lane as I approached the toll booth. I realized it, stopped, reversed, entered the correct lane, paid the $3 toll and proceeded onto the toll road. I had 4 kids in the truck with me as witnesses.

A couple of weeks later I got a notice stating that I had evaded the toll. I knew that wasn't true so I filed my report stating essentially what I summarized above. I was 100% clear on two things. 1) I paid the toll, and 2) I never reached the toll booth or toll road in the wrong lane.

Yesterday I got a response saying that my response was investigated and the original notice of toll evasion was valid. However, as a "one time courtesy" they were going to let me pay $13 instead of $63. They say the $10 is to cover their collection cost... well they'd have zero collection cost if they hadn't sent me a bogus notice in the first place. The remaining $3 is the toll they claim I didn't pay. Well, I paid it and I suspect they have a picture of me paying it.

The only recourse they listed was to pay the original $63, I guess as sort of a bond, and file another request for review.

No evidence has been presented to support the original fine and no evidence was presented to support the findings of their "investigation" into my response.

Everything about this seems like a scam.

They actually did something for you that few such agencies willingly do without putting someone through a horrible wringer. I'm glad you didn't take my advice before, but count your blessings that they gave in without a battle.

Got the citation dismissed... still a scam though

Pay the lousy $13. Could have been worse

Pay the bloody $13 and be done with it. You could have gotten a far worse summons for backing up on a highway to get into the right lane.  you screwed up once, found yourself in a more expensive toll lane than you intended to use, thought you could back out of it cleanly. It didn't work and now you have this. It's not like you have a cut and dry case of they're wrong and you're right. It's a gray area and you're courting larger trouble by not paying.

Just pay it and be done with it and write it off to experience.

Still a scam

I appreciate your offer to do the investigation that SBX pretended to do when I sent in my first request for review.

However, I don't appreciate that I have to come to a web site such as this to get a reasonable response. I don't appreciate the arrogance of a company who is unwilling to verify a violation before sending out a notice of violation.

In any case, I will follow up and send you the same information again. I expect that this time your response will not be a form letter sent in hopes that I'm lazy enough to just send you $13 so you'll leave me alone.

Please provide the citation number or license plate number to us via this website or by e-mailing customerservice@sbexpress.com in order for us to look further into the citation issued. In instances like you are describing, you did the right thing by filling out the dispute form on the back of the citation and including an explanation. A citation is issued in these cases because when you drove through the FasTrak lane, it created the beginning or ending of a trip and when you backed up and drove through the lane with the Automated Cash and Credit Card Machine, that was paid as a separate trip. Our records will indicate that the trip you made through the FasTrak lane was incomplete and as needed, we can pull video of your transaction.

We do not encourage drivers to reverse in their lane on the Expressway since it is dangerous and puts your safety in jeopardy by doing so. Rather, call us within four business days, and wed be happy to take your payment for your toll over the phone without you having to reverse back into a lane where you are able to pay.

With a little more information about your citation, wed be happy to research it and get in touch with you after doing so.
