On Feb. 5th i recieved a call offering me a visa/master charge with $2000 credit limit, 0% apr for 3 yrs for a one time fee of $249. i had a new account, i only knew the account # and my bank name. I was wanting to re-establish my credit and felt like it was ok deal. i asked if i could think about it or recieve something in the mail they sadi it would come w/card in 25 days after reciecing my $249. i gave them my bank phone # wrong but all my acct # ss# and an ok to deduct these funds to them. i hung up the phone and in 5-10 minutes callede # they gave me left message that i did not want the card. i went to my bank told them but they said since i gave them the info i could not stop the transaction. so i waited and waited and.....no card, they recieved their $$ on 2-15, today 3-17 i told my bank of the matter they said i had been scammed and all they could do was file a report, but nothing usually happens, in other words i was out $249 plus it made my acct overdrawn bouncing checks to the tune of $395 tottalling $644. the e-check was paid to Spectra Finacial Bene drawn on Calvet Bussiness Bank, Sacramento, Ca. the front of the e-check hgad a # i called it was a recording of me all my info so they could have gotten more funds, i closed acct. today. i notice on the site that took me here all rip off reports on them say Spectra, in Champlain (city) and numerous states. Do not trust this company it is a scam and it appears they can get away with it!! I called to get a phone # for the address i had on Spectra it was a disconnected #, the toll-free # they give out is computer operated, says hold for help you wait it repeats then you wait then it says all operaters are busy leave message. ive left hundreds i got zero replies. I live on disability, $579/mo, i had to get a loan to recover but now how do i live on $500/mo when i barely got by before Spectra ??

EDitor's Suggestions on how to get your money back!

HERE IS WHAT RIP-OFF REPORT SUGGESTS YOU DO:

Go to your bank within 60 days of the charge, or as soon as you know about the charge, don't delay, and tell them that there has been fraudulent activity within your account. Explain that you wish to file a dispute, and demand that they assist you in accordance with Federal Regulation E.

According to the majority of victims interviewed by Rip-off Report, those who immediately called their banks to dispute the charges did not get very far. Many victims got the following responses from their banks: we could not do anything for you or you waited too long; it has been more than 60 days.

If the bank is says that you have waited too long, explain to them how you called their 800 number as soon as the charges were found, and were told by the bank that nothing could be done. Remind the bank that they failed to assist you properly at the 800 #, and instead, provided you with an inadequate explanation of your right to dispute. Tell the bank that it's their fault time has expired, and since they gave you the wrong info to begin with, they will just have to deal with it, take the loss and reverse the charges.

Tell them the truth; this was unauthorized and your account was NOT to be charged! Keep emphasizing how you never authorized anything! Direct them to the hundreds of victims reports that were filed on Rip-off Report.com. And if you're at the bank, walk them over to their computer and make them go to this site! If you are on the phone with them, tell them you will wait while they access this site! Either way, be persistent!

DO NOT TAKE NO FOR AN ANSWER!

Let them know nicely, that you were advised to Report them (the Bank) and this situation to the Banking Commission in your state. Since each state has a different name for the agency/controller over banks, find that name before you call or get to the bank so you can throw it in their face. The more knowledgeable you appear to be, the further you will get.

And just continue to demand the Federal Regulation E form! The bank CAN, MUST and WILL reverse the charge! But, you must be persistent; ask to speak to the supervisor or the area manager for all the branches in the state.

Let the bank personnel know you are meeting with the media later in the day, that you would much rather they do the right thing (as most other banks have) by looking at the complaints and immediately reversing the charge(s) to your account; no matter how long ago it was. Be sure to call the Media if necessary so you are telling the truth.

If you have to, be loud (but nice) in front of other customers. If you are just calling by phone, the above tactics should still work. The bank can easily fax or mail to you the Federal Regulation E dispute form.

CHARGES TO YOUR CREDIT CARD

If the charge was to your credit card (not debit card, check card, or checking account), contact the credit card company as soon as possible to request a dispute form. Consumers usually have a little longer to dispute fraudulent credit card charges (up to 6 months), but it is better to act right away. In this type of situation, credit card disputes are usually successful since fraudulent companies often won't contest the disputed charge. In rare cases, credit card companies will review disputes, but refuse to reverse the charges. If this occurs, complain to a manager and let them know you will be filing a report here.

Remember Don't let them get away with it! Make sure they make the Rip-off Report .. The more Reports filed on a Company or individual, the more likely it is that the authorities, media and attorneys will want to take action.

And good luck Let us know how you do!

My bank First Convience Bank , 17 hours after i recieved this spectra call told me IN PERSON, in front of my room-mate that i could "not stop an e-check.....

AUTHOR: Lisa - (U.S.A.)

POSTED: Friday, April 22, 2005

as soon as i hung up the phone i felt uneasy so the NEXT day 17 hours after the scam call i went to my bank w/my room-mate, i was told that an e-check "could not be stopped", one of the tellers there remembers this, as does my room-mate. when i called to get an gov e form, i was told it would come in the mail. it did, weeks later stating i had waited "30" days and they could "not" help me!!!!! i told them iwould be calling the banking commisioner the fdic the ftc, the ccc the attorny general, they said it would not help. This lady "angela sanders is a bank manager, i stated i had 60 days to file the gov e form she said no, sorry. i told her about the teller who recallls me being told an e-check can't be stopped, as did my room-mate ONLY 17 hours after the phone call from spectra, not days weeks months, not spectra but first convience bank who "knows" of this scam & that i was lied to when i tried to stop the charge, which i now know is just like stopping payment on a check, Ms, Sanders says blatently after knowing all this plus the over $600 this has cost me and the loan im having to pay back to straighten out my account my life, i live on $579 SSi, still says i missed a 30 day deadline...when i was in her bedford branch 17 hours after this call & told i was just scammed...e-checks cant be stopped....on that day for maybe a $33 dolar charge , my legal right, the e-check could have been reversed, i would not be selling off my belongings to eat and paying off a loan that assures me for the next 7 months i will loose everthing, electricity, phone, and more than likey my apartment and be homeless!!!!!!! so i believe the banks who know this fraud company should not allow their customers to be ripped off, plus should allow them to stop charges, not tell them because it was a busy day & they probably didn't want to stop to help me so they lied to me....they know at this branch that i am quiet, have mental disabilities & took advantage of that to clear out a line of 5 people, and i foolishly believed them, so i hear you speak of smalll claims do i sue Ms Sanders the tellers ther bank spectra or do i a disabled woman wind up homeless so 5 people were able to get their business done "quickly" as mine would have taken ...maybe 4-5 minutes !!!!!!!

Misspelled bank Spectra used to cash my scammed money

AUTHOR: Lisa - (U.S.A.)

POSTED: Friday, March 18, 2005

in my first report i stated the bank where the e-check was cashed was Calvet, that was a mistake in spelling, it is The "Calnet Business Bank", of Sacramento Ca. 1565 Exposition Blvd. Sacramento Ca. 95815.....I appologize for any inconvience this may have caused...I also want the right bank to know what their customer is doing with the account they have at the Calnet bank.
