I used to sell cards on ebay. The owner(s) of SMCC won a card from me and paid for the card. They then returned it to me 3 weeks after the 7 day return period w/o contacting me first. They actually demanded a refund, stating in their letter that the card was not an original as advertised. the card was never advertised to be an original, it was advertised as a reprint!

Needless to say i didn't issue a refund but rather i returned the card to them along with the reasons why i was not issuing a refund. They complained to Ebay and in a moment of pure stupidity, i issued a full refund and asked that they return the card to me. it's been a month and they have not done so!! here in tx that is considered theft by deception and you can go to jail for that!! Do not buiy anything from them as they will do whatever they can to rip you off!! I hate them!! If one day I find out that they have gone bankrupt do to lack of sales i will be extremely happy!! they are thieves!!!

The problem with your claim is you conveniently omitted the important facts.

AUTHOR: SMCCI. Inc. - (United States of America)

POSTED: Tuesday, March 13, 2012

Quite conveniently the seller forgot to mention several important facts in his ridiculous story about us being "thieves".  The title of his ebay listing made NO mention of the fact that this was a REPRINT and NOT an original rookie card.  He INTENTIONALLY listed it without the word reprint in order to get a higher price.        I, fully within my rights as an ebay bidder, returned the card to him for a full refund and got delivery confirmation that he received it back. When he refused to refund the purchase price I filed a claim with ebay. Ebay agreed his listing was intentionally deceptive and misleading, and I had the right to return it and proof it was returned and received by him. Ebay then processed the claim and issued us a refund due to the seller's negligence.     Funny how he claims "He" refunded the order, that is an outright lie. In his report he states, and I quote "Needless to say i didn't issue a refund but rather i returned the card to them along with the reasons why i was not issuing a refund."  Plain and simple, he thought he could force me to "accept" his card and get away with it, unfortunately for him I know my rights and Ebay protects buyers from fraudulent sellers in situations like this. Nothing wrong at all with what we did, I had already spent $2+ to return his reprint which is worth all of $1, saw no reason to return it again and lose more money because of his "error".  For me it wasn't about the money (we are talking about a $7 auction), but the principle. Much easier and less time consuming for me to eat the loss and move on but I hate to see sellers like this on ebay as they ruin it for everyone else.    If you want to get a better idea of our companies' reputation,  please check our ebay feedback, seller ID is  SMCCI  , as of today 3/13/12 it is over 23,000 positive and counting.     One last note:  The 7 day return period is a seller preference but not a hard ebay deadline, EVERY buyer has 45 days from the auction date to file a claim for merchandise that does not fit the seller's description.
