Description:I purchased a samsung moment from Sprint that is defective.

My name is Joseph and I recently signed up with Sprint in Feb. 2010 I have had problems with both my service and phone ever since. Originally when I first noticed the problems I went into the print location where I purchased my phone and they said that it was where I live. They also said that this problem could be fixed by simply purchasing their Air Rave. So, I did it cost me over $100 and they never informed that I would also have to pay and additional monthly fee for using it. At that time I was more concerned with having a product that worked so I was OK with paying a little more if that meant me being able to receive and make phone calls. Well it did not fix the problem. The phone continued to freeze and lock up. I would dial a telephone number and it would act like it was trying to transmitting the call and then it would get stuck and stay on a screen that was ticking minutes off the in call timer without anyone actually being on the phone. The only way to fix it was removing the battery from the phone completely for a few minutes and then reinserting and powering up. This is a long and annoying process for someone who spent so much money on an phone that they were pushing on me at their retail location. Now 8 months later, I have spent several days in their retail location and their service or repair centers and they have not helped me at all. The manager of the Sprint store told me that it is not their policy to change out phones or refund me after 30 days. They also said that my problem was common. I went online to sprint.com one night when my phone would not even power back up after one of its freezing issues and I looked up my phone to see if anyone was experiencing the same issues and it was the first thing I saw. After reading that they were aware of the issue and spending multiple hours in their stores taking time off of work and not having a phone for hours at a time. I wanted to cancel my plan and go back to Verizon. They then told me that I would have to pay a cancellation fee of over $200.00 this is just not fair. I have noted over 20 complaints to them regarding my issue and currently it is 12:32 pm on 9/21/2010 and I have been on hold for approximately 1 hour and 30 mins now waiting to speak to a supervisor again for the third time today. This is overbearing and I feel like they have been just taking my money and not caring that I have a legitimate complaint. I have asked to let me purchase another phone that is capable of handling the Android platform and I even told them that I would pay and additional $200 if they would. They refused to except and they said I have to keep the same phone. I have not pursed the institution of litigation but that's next. I will also file a complaint with the attorney generals office and the federal trade commission. The lady in customer service said that my retail location was sent a e ticket that would allow them to give me a new phone of my choice. A lady named Beverly in equipment escalations gave eticket # 123459145005991****. It is now 1:20pm on 9/21/2010 and I am going to leave work once again to go and try to remedy the situation with my retail location as directed by Beverly. Please note that this is costing me work hours again. It is now 3:45 pm on 9/21/2010 and I just returned from the retail location and they just told me that there is nothing that they can do for me. I even spoke to the manager and gave them the e ticket information and they told me to call Samsung it was their problem with the model.
