First of all let me explain what had happened to me last year.

On May 2, 2006 I was injured on the job, which according to the MRI results a Triangular Fibrocartilage Complex (TFCC) tear and the cause of injury was power tools, equipment and trauma. When I was injured on May 2nd I was sent to Promed on May 3rd because I was specially advised not to tell my employer, Merridian Automotive Systems, which Staffmasters (Salisbury, NC) has placed me into because Staffmasters is a temp agency.

I was advised to report an injury only to Staffmasters not Merridian AUtomotive Systems. On May 3 I had reported the injury to Staffmasters and Tish Fanny, staffing specialist, was dealing with Workers Comp. I went back to Promed on May 5th, and I was advised by the medical doctor to make an appoint to visit an Orthopaedic surgeon and I specially told Tish about it.

Tish did not make an appointment for me to visit an orthopaedic surgeon. I had to contact a surgeon, so I made an appointment to Comaodoll, Watts & Ellison in Salisbury, which I do not understand why Tish did not make an effort to contact a local orthopaedic surgeon? Every time I had contact with my doctor from either Promed or Comadoll Watts, when the doctor was diagnosing my condition Tish had witnessed the diagnosis with me and I do not understand why she would do that.

Tish was formerly dealing with the workers comp claim. She told me she had to be with me in the room while the doctor was performing a diganosis and is that illegal or not? I soon found out that she was not required to be in the room with while I was being diagnosed which I found information on the internet.

My witness, Sophia, had explain to Tish on the phone not to come to Comadoll Watts anylonger because Sophia and I requested a private consultation. But I do not understand why Tish would tell me she was required to be with me during the diagnosis but by law she is not required to be with me during dianosis?

Ok, After the medical doctor, Dr.Mason from Comadoll Watts Orthopaedic & Sports Medicine had diagnosed me he had advised Tish and I that I was suppose to perform light duty work in the Staffmasters office environment. Sophia was a witness to the doctors orders and she had knowledge that I was supposed to work light duty in Staffmasters office.

TIsh had advised me in Promed and Comadoll Watts kept that she would offer me a light duty office position with Staffmasters. Dr. Mason specifically advised me, Tish, and Sophis that I was not suppose to work with Goodwill Industries which Staffmasters had offered me. Going from the doctors work orders I was only to perform light duty in the Staffmasters office, but of course the manager of Staffmasters tried to lur me into working with Goodwill, which was against the doctors work orders.

I did not employee with Goodwill Industries. National Benefits America, an insurance company, told me and my witness on the phone that medical doctors do not have rights to tell patients where to work or not to work, so my opinion is the insurance company was saying Dr. Mason did not have the right to tell me that I could not work Goodwill and that Staffmasters had the right to place me into Goodwill. Staffmasters went against Dr.Masons medical orders and I do not understand why Staffmaster would go againsts the doctors orders.

I had noticed that Staffmasters is a female gender based work environment. I had noticed only females staffing specialists and the manager of the office is a female.

I had contacted Staffmasters on the phone about office work. I was advised the position was not open because a female employee had taken the position. The office manager had explained to the staffing specialist that the position was taken and it was a female employee.

From the word of the staffing specialist,"she" had filled the work position and that sounds fishy to me. I believe that the office manager does not hire male employees to work in the office because I believe the office manager favors only a female atmosphere in the work environment and this is my opinion.

It was Staffmasters responsibility to search for employment during I was out of work because of course temp agencies are required to find employment for employees. I was waiting for work from Staffmasters during my time of employment.

I had contacted another Staffmasters in a different city and I asked them if they had clerical positions available. They said, "yes" and I also asked them if they had any clerical positions available at the Statesville Blvd area where I was employed with and they also said ,"yes". That did not make sense to me.

I was formerly visiting my orthopaedic surgeon for diagnosis, but no contacts from Staffmasters for employment. On 6-8-2006 Dr. Mason (Comadoll Watts Orthopaedic & Sports Medice) reported that If I had more problems,in which to this day I do, he would report me to Dr. Baker a hand surgeon in Salisbury.

National Benefits America had quit paying for my diaganosis to Dr. Mason and I did not have a chance to visit Dr. Baker because Nation Benefits America had denied my claim and would not pay for anymore doctor visits. Also NBA stated that my condition was pre-existing, that is what Karen Fisher (no longer a Claims Representative) from NBA said to me over the phone, based on her opinion from the MRI on 6-05-06.

From Karens false medical knowledge she had lied because my condition is not a pre-existing condition and according to a statement made from Dr. Mason on July 10, 2006 it states" I have been asked to forward my opinion as to whether there is a pre-existing injury. To my knowledge, there is none." Claims Reps are not medical doctors and they do not have the right to diagnose an injured employee.

I believe National Benefits America did not want to pay for future visits to the surgeon. Staffmasters is a company that works off a 5 point system. If a person call out sick the employee loses a point if the employee loses 5 points he/she is fired.

I am disgusted on how Staffmasters had treated me and National Benefits America. I believe to this day If NBA would have paid for me to visit Dr. Baker he would probably have required arthroscopic surgery and that is my opinion. I also believe that the reason NBA cut me off of any more visits and lied about my condition is because they probably knew that I would need arthroscopic surgery, and that is the reason they would not pay more existing medical medical treatment. Also that is why NBA said it was not a pre-existing condition.

According to the facts and opinions I had explained Staffmasters discriminates and are unethical and NBA is not ethical to injured employees. To this current day I am unemployed to the fact that I was injured. If National Benefits America would have compensated me to visit Dr.Baker he would have ordered me to have arthroscopic surgery.

I would have been able to find employment because my arm would have been healed properly where I would have current employment.
I have currently applied for disability due to the fact of my my injury (Triangular Fibrocartilage Complex Tears).

I believe Staffmasters discriminated against me because Staffmasters is a female oriented atmosphere and I have never seen males staffing specialists or male office managers work in a staffing agency. I have traveled to different staffing agencies. For example, Furst staffing and Manpower, in DeKalb Illinois, is a female atmosphere.

I have never witnessed any male employees ever working in a staffing companyas a staffing specialist. This is probably true with all the staffing agencies in Salisbury or any other city or state.

It sounds to me staffing agencies are discriminatory against males. To this day I believe of course Staffmasters did not want meto work in a female environment.

I did not receive workers comp pay or disability pay. Merridian Automotive Systems work schedule was 84hr/7 days a week and the company was understaffed.
