Statons Rental, TransUnion, Experian, Equifax Credit Report Agencys defamation of character for 5 years a civil judgement has been on my credit for RENTAL FURNITURE TAHT WAS RETURNED AND THE BALANCE OWED WAS $0.00. EVERYBODY KNOWS THAT, yet they refuse to take it off my credit. Allen Texas

on 06/18/02, my account was closed with Statons rental Co. They did file a riplivilin to get there furniture back, and when it was filed, I did let them pick-up the furniture. I was given a receipt of zreo balance left on the furniture.

two years later when applying for a morgage loan to buy a home, this showed up on my report, and had been there for some time. I immediately called Statons and spoke to the owner of Statons Co., and the store manager in Senatobia,Ms. They gave me my account history closeout papers, and a letter to give to the Justice of peace clerk to clear this off my report.

Nothing happened so I faxed the credit agencies in question the information, they told me they would perform an investigation (for the 10th time), and still this is on my credit. so I called and told them "hey you know like i know a rental store is a Rent to Own thing, if you stop renting you wont own it own it. give us our furniture back, and we close out your account."
told "we will do an investigation".

I need some help asap, this has been a bend on my credit for several hard years for me, and I want every point I lost because of this back.

Contact the Tate County Justice Court

When Annise contacted the store manager, I gave her the letter to give to the Tate County Justice Court stating that we did receive our furniture back. I contacted Ms. Jo at the Justice Court (662-562-7626) and she stated that the record was entered as "Satisfied". Therefore, all Annise had to do is contact all the creditors and have them contact the Tate County Justice Court or they could contact Statons Rental Purchase to get this matter removed from her credit. All the proper Documents have been filed to HELP fix Annise's problem here at Statons and at the Tate County Justice Court. It is now up to her to have the creditors contact Tate County Justice Court to have it completly removed. For any further questions, please feel free to contact Statons Rental Purchase.

Replevin

What exactly does your credit report say? If they used "replevin" to force you to return the furniture that says that you were deliquent in paying your bills. So if you're comlaining that your credit report shows you have late payments, well that's not coming off since it's true no matter if you now have a $0 balance or not. If they show a positive balance, well that's another matter.

(For those who don't know, a quick definition of replevin is when a court orders the defendant to return the goods in question at the beginning of a court action.)

Make sure all correspondence is professionally written. Format and grammar must be right.

Then be sure to send all communications by certified mail, return reciept requested. Make sure you put the certified # on the letter itself, and keep a copy for your records.

They are in violation of your rights under the FCRA as a minimum. These violations are worth up to $1000 each plus costs and actual damages.

Check with the NACA.org to get a good attorney who specializes in this sort of case. You can get them to help cheap or free.

You can sue the credit bureaus AND the retailer who reported it.
