I FILLED A APPLICATION, AND THIS APPLICATION WAS FOR THE STATE OF TEXAS. ON THE APPLICATION IT TELLS YOU TO LIST ASSETS. WELL THIS APPLICATION GOT THREW INTO THE FRAUD DEPARTMENT. DUE TO THE FACT I DID NOT LIST, I HAD A $18000 CAR. WHEN THE REP AT THE COMPANY WHERE I I FILLED OUT THIS APPLICATION CONTACTED ME. AND TOLD ME WHAT WAS ABOUT TO HAPPEN. DUE TO DEFRAUDING MY APP. I WAS IN A STATE OF SHOCK. AT THE TIME I DID NOT HAVE A CAR. WELL SHE GAVE ME THE NEEDED INFO TO CONTACT TOYOTA.

WHEN I CONTACTED TOYOTA, RIGHT OFF THE BACK. THE REP TOLD ME I WAS A CO-SIGNED ON THIS ACCOUNT. I TOLD THE REP, WHO NAME I DONT REMEMBER. THAT I DID NOT HAVE A CAR. SHE GAVE ME MY SUPPOSED TO BE ADDRESS AND PHONE. WELL I THEN CONTACT THE DEALERSHIP, I WAS GIVING THE RUN AROUND. I SPOKE WITH SO MANY DIFFERANT MANAGERS AND SUPVISORS. TO I CAME TO THIS ONE FINANCE MANAGER WHO WAS A HISPANIC LADY. SHE TOLD ME SHE WAS GOING TO TRANSFER TO THE PERSON WHO PUT TOGETHER THE CAR LOAN. SAID THE SALES MAN STILL WORKS THERE. HIS NAME WAS JEFF ROBINSON.

I SPOKE WITH JEFF AND HE TOLD ME TO NOT FILE POLICE REPORT. SAID THE PEOPLE WHO ACCOUNT I WAS ON, WAS VERY GOOD PEOPLE. AND HE HAD BEEN KNOWING THEM FOR A WHILE. SAID HE WOULD MAKE SURE I COULD GET A CAR TOO. I JUMP OVER ONE IMPORTANT PART. WHEN I FIRST FOUND ABOUT THIS I FILED A POLICE REPORT AND WRITTEN ALL REPORTING ANGENCIES. SO WHEN I SEEN THAT THIS DID NOT WORK. 2YEARS OR SO LATER, IS WHEN I CONTACTED STERLING MCCALL. BY THIS TIME I NEEDED A CAR. AND WAS IN A BETTER POSTION TO TAKE CARE OF A CAR NOTE. I COULD NOT GET ONE CAUSE THIS WAS SHOWING ON MY CREDIT. I THE BANK ONLY ALLOW ONE BANK LOAN. UNLESS YOU HAVE INCOME SUPPORT YOU BEING ABLE TO PAY TO LOANS, OR IF YOU ARE MARRIED.

SO NOW I MR.ROBINSON IS TRYING TO GET ME APPROVED FOR FINANCING. I KNOW WHAT MADE DO IT, I WAS YOUNG. AND I REALLY NEEDED TO HAVE A CAR TO GET BACK AND FOWARD TO WORK. WELL THE VERY NEXT DAY AND MR.ROBINSON GAVE MY APPLICATION TO FINANCE. HE GOT FIRED. AND WAS CONTACTED BY MR.BOB CANNON, WHO NOW WORKS FOR " STERLING MCCALL LEXUS " AS FINANCE MANAGER. HE SAID ALL THIS WOULD BE TAKING CARE OF. AND I WOULD GET A LETTER SAYING I NEVER APPLIED FOR FINANCING THROUGH STERLING MCCALL. WELL I NEVER RECEIVED THAT LETTER. AND STILL TO THIS DAY, IT'S SHOWING ON MY CREDIT REPORT. AT FIRST IT WAS IN GOOD STANDIN, NOW IT SHOWS IN BAD STANDING. WHICH HAS BEEN A BURDEN TO ME. AND I DONT KNOW WHAT TO DO.

EVERYONE TELLING ME TO FIND AN ATTORNEY. BUT I CAN NOT FIND ONE WHO WOULD TAKE THE CASE. AND IT IS REALLY A SHAM THEY GOTTEN AWAY WITH WHAT THEY HAVE DONE TO ME. AND I JUST WANTED TO MAKE EVERYONE AWARE THAT IT IS COMPANIES THAT OPERATE ON BEING DISHONEST.

First send a certified letter, return receipt requested to the Toyota bank stating that:

--You never co-signed for this loan.
--The dealer used your name fraudulently.
--You have filed a police report on the matter (enclose copy of police report).
--Everything related to this loan is to be deleted from your credit reports as soon as possible, but within 30 days in any case.
--They are not to attempt to collect any money from you for this loan, or include your name should they transfer it to any other party for collection.

Next contact all the 3 credit reporting agencies and dispute the loan as "Not Mine" because it isn't. With any luck, the loan should disappear from your credit file within a month, and you'll be qualified for your own car.

Now this is very important: DO NOT GO TO STERLING TOYOTA! You have firsthand knowledge that they are CROOKED AS HELL and should be in jail by now. Since the case is 2 years old I can see why lawyers are reluctant to deal with it, but if you can find Jeff and the right lawyer you should be able to sue him and the dealer for enough to buy a nice new car (from another dealer) outright.

Shop at banks and credit unions for car loans before going to any dealer. Then you will know how much car you can finance. Concentrate your negotiating efforts at the dealer on getting the lowest cash price. Refuse all extra warranties and silly added charges. Don't tell them you have a loan already, but when they try to lead you into the den of inequities that is the finance office, you just tell them "No thanks, I'll have my bank give you a check for the price we agreed." The dealer really cannot give you a better deal on financing than a bank can. They have to get it from a bank, and they expect to mark up the rate and get a profit for their efforts.
