I am a Canadian citizen operating a business in British Columbia, Canada (since 1993).

I am looking for US government consumer protection departments, government international trade departments, consumer advocates, amusement safety organizations, media TV networks, print media etc., who will assist me in exposing a NJ corporation and its gent (whom I have just received a judgment against through small claims court in British Columbia ,Canada and have duly filed said judgment in NJ Superior court) for selling a shoddy made and potentially dangerous amusement ride (The Dixie Twister Swing Ride) in January 2011 and breach of contract.

After several years of negotiations I contracted in good faith with defendants for a NEW carnival ride which must meet all Canadian and US engineering, electrical, highway and safety standards. I requested and received guarantees in writing, and verbally on several occasions from the defendant, that if the ride did not meet local (that is to say Canadian provincial and federal) compliance standards and regulations, then defendant would pay for all changes required to bring the ride into compliance. Defendant reneged on his promise and breached the contract.

What I actually received was a ride that was obviously not new and which consisted of shoddy made, used parts, many missing parts, inadequate parts, poor, or missing welds on the ride structure 90% of which had to be re-welded, crowd control fencing which welds were broken and or missing completely 100% of these welds had to be re-welded. The whole ride was condemned by the engineer, the electrical inspector, and could not be passed by the BC Safety Authority inspector until it was brought up to or exceeded compliance requirements..

I have fully documented my experience of the purchase of this carnival ride from Fun Attractions USA Corp, aka Fun Attractions Inc, aka Magical Enterprises Inc. and their agent Mr., aka Dr., Steven Poretskin of Toms River, NJ USA.

I have in essence been forced to completely re-manufacture an alleged NEW carnival ride in order to bring it up to, not just Canadian safety standard requirements, but also US safety standard requirements.

Poretskin was given numerous opportunities before I began my small claims action, during my legal action and after it, but he has consistently chose not to respond, to defend, or to offer any settlement or to honour his obligations both in my interest and that of the public who use the ride.

How many more rides made by this company are out there and in operation? What are the potential dangers to the unsuspecting public?
Who will work in the public interest? Why would a NJ manufacturer flout the law and place the public at risk? Do we have a moral obligation to expose such blatant disregard for the law and the interest of the safety of our children?

I have also found through the state of New Jersey website that Dr. Steven Poretskin is no stranger to litigation I can provide publicly available copy of his litigation history if required.

Update as of Jan 28 2013 Defendant is avoiding his obligations divesting himself of assets to avoid efforts by me to collect by way of Writ of Execution.

Further the safety inspector has advised me that the crowd control fence supplied with the ride does not meet minimum height requirements and the space between the upright pickets does not meet the requirements of no mgreater than four inches between the pickets as laid down by the ASTM (American Standards Testing Material) this now means I have to replace the fence for a new one that meets the ASTM requirements the quoted cost for this is $4,923.52
