10 months ago I was contacted by phone by a represenitive of the said company NACS. I was "pitched" the package, but was quick to cut the solicitor off and say that i wasn't interested. he then started to go into his little pitch again, and again I cut him off. I laughed and said (and i qoute) "the only thing i need that i cant afford is a mini DV camcorder, not a vhs or vhs-c, or an 8mm, but a mini digital video, blah blah blah. Here is a copy of the letter i sent them 2 months ago restating my case, it explain it all.
To whom it concerns,
Last November, after numerous attempts to fix my problem through the customer service line, I was instructed to send in my complaint in writing to you. I sent in a letter in December and again in March, it is now almost July and I have yet to hear back from you, so again I called the customer service line only to be told to write again because my first 2 letters were never received.
Here is my problem: I was contacted by phone last winter by one of your phone solicitors. I was asked if I was interested in signing up for your credit catalog package. I am very familiar with how credit packages and catalog clubs work as I have used Fingerhut and Spiegel and though I paid high interest rates and such I was happy to do so as I was able to make purchases of products I would have had to have saved for months to get, the high interest rates were ok with me.
When contacted by your representative I had recently started working on a documentary and was looking for a digital video camcorder to shoot my documentary with and decided to ask if this was something your catalog offered. I specifically asked the following do you have digital video camcorders?, to which I was told yes by your representative.
I then said specifically I am not interested in anything other than a digital video DV camcorder, I know I will end up paying twice what it is worth in the end, but I am only looking for a high end DV camcorder, are you sure you offer these in your catalog?, to which I was assured that there were many fine electronics in our catalog by your representative, to which I replied but I don't care about anything other than a DV camcorder, can you assure me that there are DV camcorders available in the catalog, because if so you have a new customer, again I was assured that I would find a wide variety of camcorders including digital video camcorders.
So, after verifying numerous times that I was going to be able to purchase what I was looking for from you, I signed up for the catalog package. Around three months after I signed up I had to call and get the catalog sent to me as I had apparently been lost in the system and had yet to receive anything other than a three hundred dollar decrease in my bank account, once I did receive the package I was shocked and disappointed that there were no camcorders in the catalog.
I called the customer service number and was told that the electronics catalog would be sent at another date and that it contained camcorders, I explained that I was only out to purchase a camcorder and that I had no other reason for signing up and that I would like a refund, I was told this wasn't possible without sending a written complaint to the company, I sent a letter stating what had happened in December and again in late February or early March to which I never heard a reply.
I decided today that I would call and once and for all get this matter resolved, I was told by the first person I talked with that my request for a refund had been denied and when I asked for a reason why, none was given, when I asked if there was a supervisor I could speak with, I was told it wasn't important enough to require a supervisors attention, when I again asked to speak with a supervisor it was again dismissed and when I asked what I should do, I was told to call back and talk to another phone representative.
I called back and spoke with another phone representative who told me that it had been a long time since I contacted them and the matter was not negotiable, and when i again asked for a supervisor I was put on hold and then told by the supervisor, whom I believe was actually the same guy I had been talking to, that my request for a refund was denied and that they had never received a letter from mewhich makes me think I'm writing this third letter for no reason and is why I have gone to all the trouble to have delivery confirmation. I was told there was nothing that could be done, and when I again asked for an explanation as to why my request for a refund was denied, none was given.
You can check your recorded conversation with me from day one, check it, I stated so clearly in my initial conversation with your sales representative what I wanted that there was no margin of error, I didn't sign up for anything other than to be able to purchase a DV camcorder, and since I was mislead to believe this could happen I feel as though I have been completely ripped off, I didn't sign up for this package because of any reason other than I was mislead to believe that I could purchase a DV camcorder from you.
I am not a wealthy person or I would never have needed a service such as the one I was told you offered and also because of my lack of wealth I cannot afford to throw money down the drain, which is exactly what I'd be doing if I didn't get a refund. I am 27 years old and have a wife and three young daughters, and a mortgage payment, three hundred dollars is a lot of money to my family and your company under the false pretenses your representative claimed, stole it from us.
That is why I write again today, This is my final attempt to collect the money I am owed, I have spoken with my family attorney and have been assured that I have been mislead with false pretenses and have the right to a refund, if I am not given a full refund by September 01 2004, I will be forced to take legal action for my money, I feel I have been left no choice. I will not let this matter go, I will pursue it until it has been ruled on in court, if that's what I must do. I am at the end of my rope with this matter and am very displeased it has come to this.
So that's the letter i sent and i heard nothing from them, so last night i sat down and fsearched the web, found this site and a ton of useful info, to day i called and got all the proper info and addresses and i called (and recorded the call) to see if they would work with me and not have this go to court, they declined and got hostile over my desire to take this matter to court. i am preparing to file a suit by the end of the week.
