On Several occasions I had clients reporting to me that they had applied for a mobile home in the Sun Valley Estates 55+ Mobile Home Park. Each time those clients very strongly felt that they were discriminated against and profiled. Upon review of Florida Statute 723.061 that has a small section in there regarding grounds to be denied an initial application is if that person or person(s) poses a threat to the safety and well being of the community.

Since, my office has gotten numerous complaints, we decided to post this information by stating 100% facts. Recently a 62 year old male applied to buy in Sun Valley Estates they made him pay an up front fee then denied him based soely on the fact that he had a conviction (19) years ago for possession of marijuana. The Florida Rules of Evidence does not allow the use of any convictions in the court system that is older than (10) years old. This is just one example of what has been going on at this park. 

 

How can a simple marijuana conviction (19) years ago be a threat to the safety and well being of this mobile home community that is NOT in any gated community but wide open for anyone to walk the grounds. Including real criminals!! Our company has decided to monitor this mobile home park for violations of federal Fair Housing Act and any other local or stat housing laws.

first of all Robert, I have no idea what business of yours this complaint is about or what my company monitors compliance in. Thought you might be smarter than that. Simply put, their license to operate. Get it! start reading. Second, there appears to be violations and what they are , is our information for further review and action. If your so interested in what the laws are I suggest  you consult with a Law yer and find out what may be the issue. We will not disclose our case to you some busy body. You are not part iof our review nor own the park in question. If you do then expose that in your rebuttal. I will not let some rant like yours expose our findings.

The he post was to enable anyone else with issues  with this mobile home community to contact our office. We are entitled to our opinion and to post a notice such as we did. I will not expose anything to you in our review. Those who will see our findings will be those who work in the state, federal local governments or regulating authrority when we feel the time to produce our findings . 

By by the way Robert I myself am 52 with no record and was denied townership in this park for reasons that were absurd and that was a small part of our review. For the record ...............since  your sooooooo interested in our internal operations and findings. Corportion who operate, and/own mobile home parks are under a license here in Florida and their are regulations that they are required to follow. Second, there are federal laws regarding discrimination. Like denying a black couple and not one black person lcurrently owns and/or lives in that community.

Contrary to what you may think, yes I did read your report, and before you start accusing people of things such as you did..perhaps you should also read.   I asked some very simple questions.

When you went to this development what did they say about your accusations?  You FAILED to answer or even acknowledge this one.

I asked you for a specific section of the Fair Housing Act that listed criminal activity as being covered. What did you give me?  You told me that you are doing this for free and are a Federally Certified Contractor.  I never asked for either bits of that information.

Companies that do "compliance"(or as you call it COMPULANCE) review, generally know the regulations that they are checking for compliance on in extreme detail.  Especially if they are going to go "public" with the accusations.  But what do you do?  Instead of saying, yes you are right there is no Federal law that states that, BUT here is the state or city law that says it is covered.  You go with the lawyer double talk and just refer back to how you said "and/or".  So I will ask again...give me the "OR".

Remember YOU posted your example of the past criminal activity, it wasn't something I made up.  You are right I don't know what the other complaints are.  But generally people go with their "strongest" argument meaning that if this is the strongest you got, the others must not even be close to this.  Of course if this isn't the strongest one has to ask why are you keeping these other cases a secret.

So since this is the example you went with, it must be the violation that is occurring...it's only common sense that anyone reading your report would come up with. 

Oh and if you are going to come back with more lawyer double talk and say you only said "monitor"..don't bother.  But with that I wonder if you will come back if your "monitoring" turns up nothing and report the results.

for the record we did contact the association president who claimed they have no decision making on potential applicants that it's all done by the owners of the park. A corporation in which we also contacted them and was referred to theor attorney. Their attorney who works for  a large legal firm stated that he was having some kind of surgery and would get back to us next week we'll that was last week and we still have not heard a word on the mattter. the client even requested copies of the report used to deny the applicant. And after suggesting that such a big firm surely someone could send the applicant the report. just for the record Robert! We are through in what we do we don't just post reports for no reason or to have fun.

Robert, if you read what was filed it says AND/OR local or state......but maybe your the type that just reads part of the report you want to complain about.  The report is facutal....and FURTHER!!!!!! you have no clue what the OTHER complaints are about I just gave you an example of ONLY ONE of them. Thats what my company does. COMPLUANCE REVIEW and we do it FREE. No charge....its a community conrbution by us. We are Federal Certified Contractors.

Since you have decided to "montitor" this situation, you of course didn't just come here and post a report. You surely started by going to this development and talking to them about this..right? 

So how about adding what they said to your "100%" factual report. 

The last time I checked the FHA covered race, national origin, color, religion, sex, familial status, handicap.  I don't recall anything about criminal background.  So since you are providing "100 facts" can you please provide the specific section and text of the Federal Fair Housing Act that states that he can not be denied based on criminal record(regardless of age).
