Sunshine Car Imports Refusal to refund deposit after car not ready as promised Ft. Myers Fl 33901Ft. Myers Florida

We visited the car dealers website and called on a van that we were interested in and was told that it was in fantastic shape and ran perfect. We went to do a test drive that evening and when we arrived we were told that the van needed new seats (that had been ordered) and there was a lifter that was stuck in the engine.

They informed us that those 2 things would be corrected and we could test drive the van tomorrow 12/28/07.

We left a deposit until those items were fixed and we could test drive the vehicle. We did some preliminary paperwork that night.

Came back the next day, the seats were not there and the mechanic advised me that there were a few other things that needed fixed. Again we could not drive the van. We told them to call us once the van was able to be driven.

We were informed on the Dec 31, 2007 that everything would be fixed and we could drive the van on Jan 3, 2008 and when I called that day I was told it would be 1 more day. I called on Jan 4, 2008 and was told she would call me back by 4pm to verify that it was ready to be driven. I never got a call and tried to call by 4:30 - 6pm that night. I left 2 messages. I continued to try and call through the weekend and all day Monday, when I never got a call back or got in touch with anyone, I called around 4pm on Monday evening stating that id I didn't get a call by the night, I wanted my deposit back.

We never did get a call, however we called again Tuesday morning 1/8/08 and our salesperson put the owner on the phone who stated rudly that we will not be getting our deposit back since all these repairs were being made for us. I asked if the vehicle was ready....the vehicle is still not ready and this is 2 weeks later.
