Patrick McKenna of 3D Specialist was contracted to perform coordinated HVAC shop drawings with a payment schedule that was mutually agreed to in writing: $3,000 upon receipt of shop drawings, $3,500 upon approval of drawings, $3,500 upon receipt of as-builts. 

To date, 3D Specialists was paid $3,500 for initial drawings ($500 more than the schedule amount), 3D Specialists was contractually obligated to make necessary adjustments so that the Engineer approval would be obtained prior to receiving further progress payments. 

He refused, demand to be paid up front.  3D Specialist’s contract was terminated for failure to perform.
