I ordered the Vital Acai and wasn't told that the 15 day trial periods starts when the order is placed not after the merchandise is received. I called the company and asked them to reverse the charges of $78.91 and they refused. I even offered to return the merchandise since I hadn't even opened it and was told they don't accept returned merchandise. They only offered to refund me half of my money back and I refused their offer. So I called my bank and started a dispute and I was told that this company has swindled many people with their false and misleading advertising. My bank advised me to file a complaint. So I did. My advice IS DON"T ORDER ANYTHING FROM THIS COMPANY. PERIOD!!!

Dear Jarri,

Our terms and conditions are clearly listed on our order page in plain, visible language. They clearly state that you will have 15-days from the date ordered to determine if the product is right for you; if you choose to keep the product and leave your account open, when the 15-day trial ends you will be billed for the shipment. To finalize an order with us, you must check a box stating "I Agree to the Terms & Conditions" - if you do not, your order will not process.

This information was also sent to you in a confirmation email immediately after ordering, so your claim that you "were not told this" is disingenous at best: you agreed to the dispalyed terms which were also sent to you an in email immediately after ordering.

We cannot refund customers who exceed their trial date as this is the whole purpose of the trial - it is a time-sensitive test. Our terms and conditions also clearly state that we do not accept returns on shipped products; this is because we do not re-sell shipped products due to tampering concerns.

We offered you a 50% refund as courtesy because we empathized with the fact that you ignored the terms repeatedly while signing up; we did not have to do this and would have been in the right to offer you no refund. However, we were willing to break our terms and conditions because we do understand that sometimes people jump head-first into things without thinking them through (or reading them through in this case). However, it is your right as a consumer to dispute the charge with your bank instead of accepting our offer.

Please be aware that we do keep detailed records for all of our customers and do have a digital signature on file showing that you agreed to these terms and conditions which were clearly displayed - it is your right as a consumer to dispute a charge, but just because you dispute a charge it does not mean you will win the dispute.

Based on the evidence on file it is extremely likely your bank will rule against you in the dispute and release those funds back to us.
