Subsequent to various responses and counter-responses, I Andre Phillip Swanepoel, hereby withdraw any and all rebuttals tendered to refute the orginal report, and subsequent responses to the rebuttal, by Mr James Scott.

It is abundantly clear that Mr Scott, who was an integral promoter of the Monumental Capital project, supposed to have been funded by Swiss Charge, was in fact correct in the filing of statements to raie awareness of the deviant and subversive modus operandi by Swiss Charge, and in particular, what has now turned out to be gross misrepresentations by Mr Frans Rootman.

We will for the immediate period, refrain from further statements pending the response to  formal notification in terms of the lawfully required process.

It appears that a raw nerve was struck. All I will say at this juncture is that two quotes spring to mind:

"People who live in glass houses shouldn't throw stones."

Or perhaps more to the point: "... first take the log out of your own eye, and then you will see clearly to take the speck out of your brother's eye." (Matthew 7:5)

THIS STATEMENT IS WITHOUT PREJUDICE AND RESERVING ALL THE RIGHTS WE MAY HAVE IN THIS MATTER.

I, Frans Rootman as Project Manager for SwissCharge Zambia, make this statement for and on behalf of SwissCharge Zambia, myself, and all the parties in defence, mentioned in the malicious report posted on Ripoff Report on the 4^th of May 2015. This report was posted by a certain “Brandon”, acting in this matter as the alter ego of Mister James Scott, allegedly a Senior Partner of an entity known as Oaks Group International (‘OGI’), with email address supplied as james@oaksgi.com, purportedly operating out of Somerset West, Western Province, South Africa.

We will not get involved in the litigation of this situation in the public domain or via social media. Should any individual believe that he has an issue with another party then he has the rule of law available to him, in order to exercise the rights he may believe he has in such a matter. I have therefore no intention to respond to the malicious, and misinformed statements made in this so-called report. By not doing so, should and cannot in any way construe any possibility that we agree with any of the content therein, other than emphatically stating the following:

“Mister Scott James, was at no stage a client of SwissCharge Zambia. We do not have any prior dealings with him, or his company, other than a previous attempt by him, threatening us with this same type of actions, in an attempt to distort and solicit money from us, this he did via email sent to the management of SwissCharge Zambia, dated the 28^th of January 2015. To which we replied and cautioned him about his malicious actions, and the possible consequences thereof”. All the source documents proving this statement and the unsavoury actions of Mister Scott James is on record and available for scrutiny, should it be necessary.

We will not discuss the business or details of any of our clients or alleged clients with anybody, other than to state that all the applications lodged for Secured Structured Funding with SwissCharge Zambia, is done by the applicant, at his own cost and risk. The applicant pays no fees or administrative costs whatsoever for, and until the first drawdown as per an agreed to, designated drawdown schedule. We are further prepared to confirm that Monumental Capital (Pty) Ltd (“MCL”) has indeed applied for Secured Structured Funding, but still needs to comply with certain, and very specific conditions in the funding agreement, prior to the implementation thereof.

I trust that Mister Scott James will withdraw this malicious report, without any delay, and continue his actions, if any, which he may have with Monumental Capital (Pty) Ltd, should he have locus standi, in the appropriate forum in the appropriate fashion. But at the same time Mister Scott James, should refrain from any defamatory actions against SwissCharge and its associates, failing will leave us with no other option but to exercise the rights we may have in this matter, in order to protect ourselves and our clients against opportunistic behaviour as he displays in all his actions, and more particularly this effort.   

This is our only posting in this forum on this issue, any further communications will only be entertained via official channels and through the official designated addresses available. We further reconfirm our best effort policy to our esteemed and loyal clients.

Great to see the 'real' James Scott, dilusional as ever, now expose himself.

As I recount, and in our association over the past few years, I have yet to see a successful transaction pass your table.

How many companies tried you out in Perth? Four years and 'no show' - back to South Africa. Again No show?

Unfortunately, and once again, Mr Scott was unabel to conduct himself within the parameters of well defined Governance structures, proceeds to act out the bounds of his mandate within Monumental Capital and clearly defined company policy, and now the 'world' is at fault! No not the world, Swiss Charge and its officers, Monumental Capital and its office bearers have to be burdened with and held responsible for the cumultave failures of Mr Scott.

Plase understand that you have misrepresentd the position with Swiss Charge. You have no business, or otherwise relationship with them, and for posting the malicious statements you have posted regarding the bona fide status of Swiss Charge and its irreprehensible office bearers, you have done so with malice and defamation that will of necessity enforce legal processes deserving of such self-pitying behaviour.

If you have any contension, take this up with the company Monumental Capital - Note [A Company yet to be formed]. No and once again, you have no association with Monumental Capital (Pty) Ltd (Au).

Please check the documentation you signed, or would you prefer me to post such on my next rebuttal?

Please Mr Scott, once you take responsibility for your own self-inflicting actions, you will proceed to move forward.

Note: A Notice to the effect of imminent actions about to be institutd by Monumental Capital has been 'posted' to Mr Scott - alias 'Brandon'] as a result of his most recent actions.

Further to the phrase 'You have been threatened'; pease understand that for every action there will always be a response/reaction. Both Swiss Charge & Monumental Capital have previously released communication which were normal responses to otherwise, malicious and defamatory comments and 'intended' actions by you.

It appears that Andre Swanepoel is either extremely naive or is in collusion with the destructive endeavours of Swiss Charge, or both.

As much as he wishes to distance himself from the obligations arising from both Swiss Charge's contract with Monumental Capital, and to Monumental Capital's commitments to James Scott, he will be unable to do so as it is a matter of record that these obligations have arisen by virtue of contract, by virtue of work actually undertaken by James Scott and provided for in the Pro Forma financials, and by many written communications between the parties.

There is undoubted financial damage as a result of the delays and non-performance of the Loan Agreement, to James Scott and to those individuals and entities who have spent time and effort on trying to secure the promised funding and who have suffered financially as a result of their many months of commitment to try and hold out for the "imminent funding".

Real quantifiable damages have arisen out of misrepresentations made over a long period of time. Merely stating that James Scott is now not a part of Monumental Capital does not erase these.

We have taken note of the defamatory nature of a ‘ripoff‘ report posted by ‘alias’ Brandon of Somerset West, who is no other than “James Scott”, who was a fellow promoter of the Monumental Capital (Pty) Ltd Au project funding, since the recordal of some of the information could only have been captured by someone who was privy to the ‘Agreement Arrangement’ between Swiss Charge & Monumental Capital, however generally distorted, as can be accepted

Hiding behind a ‘pseudo’ name should already reveal something about an individual, and should be taken from whence it comes.

I , Andre P Swanepoel, am the C E O, Director & Shareholder of Monumental Capital, alongside Alec J Reid who is based in Australia.

In November of 2014, it became necessary to distance ourselves from James Scott due to misrepresentation and misguided expectations, which are evident in his attached ‘report’.

The following is an excerpt of a ‘Corporate Communique’ released to the office bearers of Monumental Capital on the 17^th of December 2014;

“,......As such, it is evident that James Scott has nothing to lose and will do everything he can to prejudice the efforts of S C, Frans Rootman, the office bearers  mentioned, and by extension, myself & remaining co-promoters of “Monumental Capital, - A Company Yet to Be Formed”.

In Actions he has unilaterally engaged in, and in his own capacity, he has by his own doing, effectively forfeited any rights or possibilities that may have arisen as a result of possible beneficiation from the “Secured Structured Loan Agreement” with Swiss Charge.

Additionally, it is apparent that James Scott has, and is soliciting the assistance of various individuals, friends, colleagues & or corporates, as a result of personal undertakings he has entered into with them, and is now resorting to incorporate them to into his misguided endeavours of holding others accountable.

Let it be noted that;

Any efforts of any nature to implicate, mention or bring into disrepute, Swiss Charge, Frans Rootman, myself Andre P Swanepoel, Monumental Capital (Pty) Ltd (Au) or any of the office bearers of the known companies, will be dealt with in the most vigorous way possible, and that any such individual or collective, will be held jointly and severally liable for the amount of €1,65b (one billion, six hundred and eighty thousand euros) which represents the amount that the a collective 5 (five) projects stand to gain in the event of successful funding; or lose as a result of misrepresentation or reputational risk brought against any of the above names or entities. 

We will nevertheless and in any event proceed with the misguided action of James Scott to the degree required, and to the extent necessary – Action is in progress!

We further distance ourselves from any action, intended or taken by James Scott as he has indicated, against Swiss Charge, Frans Rootman, myself Andre P Swanepoel, Monumental Capital (Pty) Ltd (Au) or any of the office bearers of the known companies, and further serve that this Notice serves as a ‘Notice Of Formal Separation’ from James Scott in terms of his fragrant disregard for unlawful breach of official company policy, and his further intent to jeopardise the possible beneficiation, as listed in the content of this writing.”

James Scott therefore may record anything he wants to, since he is in no way part of the company Monumental Capital, and in no way represents their views, neither does he have any form of agreement or lien against Swiss Charge, a company dedicated to the improvement & upliftment of Humans and their Environment
