On Monday 4-27-14 I looked on southeasttexas.com and seen Mrs. Shannon Castille posted add online stating she needed someone to clear 10 acres of land. I contacted Mrs. Shannon but phone went to voicemail I left message stating My name is India Zeno and I was calling on the behalf of my husband about clearing her land and I asked her to call me back. Mrs. Shannon contacted me stating she needed a bid on her property at Legal Description: Todd RD TR 9 373 T&NO 159 5.010 AC & Lot 11 ANDREW DUNN 5.000 AC. I set up an appointment with her on 4-28-14 at 11.30am so that Timothy Zeno can go look at it and give her a bid. After going over property Timothy Zeno had India Zeno to call and ask Mrs. Shannon what she felt comfortable with paying before he give her a price she said 1,200.00 dollars is what she was comfortable because that was a bid someone else quoted her and she felt comfortable paying that but because the guy that quoted her didn’t have the time to do it she posted a add trying to find another person. I contacted Mr. Zeno and passed down the information he stated he couldn’t do for that amount he told me to tell her 2,500.00 dollars. I contacted Mrs. Castille to inform our bid is 2,500.00 to go clear land and bush hog it with tractor she stated she need to talk with her husband and get back with me by the end of day. Mrs. Shannon contacted me at 3.00pm on 4-28-14 and agreed to the bid and asked how should she pay us I stated I will call her back let me get with Mr. Zeno. I then contacted Mrs. Shannon back to let her know 1,250.00 dollars is to be paid up front and the other 1,250.00 when job is done and she agreed. I informed her we would start on Tuesday at 7 am.

On Tuesday 4-29-14 when the worker got to property with equipment the tractor was too small to cut lot so we couldn’t start. Mr. Zeno informed her we were going rent a bigger tractor and would be out on 4-30-14 at 6:30 am she said ok. On 4-30-14 all the worker was at property on Todd Rd for 6:30 am no one was at property to pay them up for Mr. Zeno called no answer he started the job anyway. I called Mrs. Castile also no answer. She called me back around 8:05am stating she was at work and her husband will be going to property to write check. He was suppose be there for 6.30 am no show. I told he that’s ok I’m come meet her because I had the receipt book anyway that would have save me trip to go run to winne TX. She asked can I meet her at lunch time at her job at Ogden school 2300 Victoria street Beaumont Texas so she can write me a check I agreed. I made it to school at 11.00 waiting outside for Mrs. Castille when she came out side she asked me to wait because he husband shut down job because he stated he want land Bulldozed not cleared. I informed her that was not the agreement we had she I’m sorry I’m just pay yall for what been done. I called my husband and informed what was been said he informed me that he was walking over property with Mr. castille to let him see that 5 acres of land was already cut and finished. Mrs. Castille said she wanted to pay 600.00 dollars for the 5 acres that was cut at 11.00am I disagreed because I quote was 2,500.00 for 10 acres and 5 acres was cut meaning she owe half of that which is 1,250.00 dollars. My Mr. Zeno informed me that mr.Castille was fussing about price and stating he wanted it bull dozed. When they began to pack up he agreed to paid them the have and she talk to Mr.Zeno and he informed he the price to bull doze her property is not what we quoted her. She stated she miss understood and asked can they finish with job since they started he agreed. He was upset because he had hard time getting the to pay money that was already supposed be paid up front. Mrs. Castille then came back outside with a check I handed he a fly for when she get ready for us to do her fence. Mrs. Castille said oh you have a company I said this is work we do on side we working on getting licensed and bonded she said ok . She wrote the check in TI CONSTRUCTION –India Zeno I informed I don’t think you can write we a check under this name because we don’t have a business account or a license. She informed me she was sorry and only brought one check I could go to her bank and have them call her if not I would have to wait until she get off.

I have 7 guys I’m trying to pay and she was holding me I informed her the worker overheard everything so the was afraid to continue working because they felt threaten by Mr. Castille and they was afraid he would pay me to pay them. So I was doin my best to get the worker paid. I went to Five Point credit union 1300 U.S. 69 Nederland, TX around 1:00 pm (800) 825-8829 where Mrs.Castille bank and asked to speak to branch manager about cashing the check. She said no because they don’t normally cash business check so I call Mrs. Castille and I let her speak with branch manager she asked can she draw line through company name and initial it and branch manager told her no it would be a voided check. The branch manager informed us if I go down to a get a dba she can cash it this one time only but the next check will have to go in my name only not a business name she said ok. So that what I did I paid 30.00 to get a dba brought it to bank she made a copy and cashed it. I then call Mrs. Shannon but no answer she texted and said she was in meeting I texted her and let her know they cashed it but the next check will have go in my name she agreed and said she sorry for the mix up about the bulldozer. The worker was then paid and continue working until 5pm the a blade on tractor broke that was $800.00 I informed her the tractor broke but we be back tomorrow and we will fix it she said ok. The tractor broke due to the debris in land the property haven’t been cut in four years so the deeper they was cut the worst it was.

The morning of 5-1-14 the tractor was fix and workers was back on property cutting at 6:30 am. Mrs. Castille called and asked was the guys there and was the tractor fixed I informed her yes. Mr.Zeno called at 8:36 am me to inform me the blade broke again and that he didn’t want to take chance with the that tractor again after he fix it. He asked me to call her and she can pay 500.00 dollars and we get a bulldozier out there to finish job because it had a lot debri on land that we didn’t know about we was only suppose be cutting tree and bring it to a burn pile along with bush hogging but there were bricks and huge items in land the brick is what broke blade. Mrs. Castille became hostile and said we better do what she asked us to do are she want 600.00 of her money back she stated it wasn’t her fault the tractor broke. She started threating me saying I’m not doing good business and that she taking me to court since I now have a dba at that point I asked the worker to pack up and I paid them out my pocket for the other 2 ¾ of land that they cut. Mrs. Castille informed me she was not paying us for the 2 ¾ acres of land she said she will see me in court. Mr.Zeno informed her that she will be receiving a letter in matter. Later that day around Mrs. Castille pull up to my home address in a black jeep stating yall don’t have no lawyer and she began taking pictures of my home. I called Beaumont police and inform them what happen and then came out and informed me to contact small calm court and if she come back they will take her to jail I told them we felt threaten because this is our home. Mrs. Castille owe me $687.50 for the 2 ¾ of acres that was cut after after her husband left property. The tractor blade is another additional 800.00 I asking her to pay for since she hired us and we was on her property and that was debri we was unaware of. I have paid my seven worker out my pocket and I have taken a loss cutting her property. I charged her 250 per acre I have a video of property before we cut it and picture when we stopped.
