Show customers why they should trust your business over your competitors...

I am seeking contact with people who have had a simular experance with TD Bank.

TBank has hurt my family. By providing false information to check systems the police and credit reports and government agencies.

TD Bank had me arrested by providing false information to the police. I was arrested and put in jail while my daughter 12 years old had to watch.

I cannot open a bank account cash a check or get a credit card. I have a felony on my record and the felony was obviously dropped. I have been put on a black list By TD Bank! I am not the same since my arrest I am so afraid of getting arrested again and going back to jail. I stay home all I can, since 2009.

TD Bank has lied over and over again and used the police to extort money out of me.

I am asking people who have had a simular situation with TD Bank to contact me at (((ROR redacted))). And tell me your experance.

We are in court with TD Bank and they are fighting me as if I hurt them.

TD bank did the same to me . But my story takes the cake

Td bank had me arrested bevauSe I was given a scam check ( in the mail , now I'm aware of these scams) I was arrested at 18 years old in front of td bank for supposed fraud

There are several other websites like this that are set up to let the public know people's experiences. I plan on spending my weekend posting my story and using any outlet to get my story out and let people know what kind of bank this is. Like I said before I have had now 8 people (2 within the last couple of hours) contact me with similar situations.

We are suing TD Bank and we are in court for well over a year, going on 2.  We will be seeing the case to  the end and cannot wait to go in front of a jury. All your points were well taken. Have a great holiday weekend.

It still does not change...

This still does not chnge most of my previous response.  First of all had you the actual situation in the other post it would have gotten right to the issue.  But anyways...

I'll try to keep this as simple as possible since it appears you are still leaving what is probably a few key things out.

First off you go from being assured the check was good, to being arrested.  There is a big 4 month gap here in your timeline.  Since you of course review your statements every month.  Are you saying that in the 4 month period they never reversed the funds from this check out of this account?  If this is truly the case then yes they are wrong, and nothing else really needs to be said except good luck in your suit.

BUT...if you don't review your accout and the funds were reversed your lack of attention to the situation most likely caused your issue in being arrested.   First a bit of history for you.

There is something known as the Expedited Funds Availabiity Act.  This requires banks to make funds available at a certain time.  It does NOT mean that the check is truly valid or could not come back as bad in the future.   This is most likely what happened to you. You "thought" the check was valid, the bank at the time had no indication that it wasn't.  But at some point the check did come back.  Once it came back YOU are responsible for it..again look up the concept of "Holder in Due Course".  There are also laws regarding fraudlent checks(which technically ANY returned check could be considred) .   This same conccept is also what the bank will claim as to why the are not responsible for any damages and the initial arrest was valid..regardless of the charges being dropped. 

But these same laws and concepts are what you can  use to go after the person who wrote you the bad check..yep if you really wanted to you could file charges on them and have them arrested.  At the very least..his business since you should have all of this information.  If he is close enough to are close enough to sue.

Of course if there is more information, I would still love to hear what exact documents they falsified.

That's not what's what happened. Thank goodness the state attorney saw that I did nothing wrong and dropped the case and the bank's employees admitted under oath that I shouldnt have been arrested.

I put an ad on CL for a piece of business equipment. The check was from the buyer's business in another state (not country) to my business. I deposited the check into my business checking acct and the buyer said when it cleared that he would come pick the machine up. No one asked for money back and anyone would know thats a scam. After a couple of days I called TD bank more than once to let them know that I was holding back equipment until they verify that the check is cleared.

I was told the check is clear. I called again before he came down and they assured the check was good. The buyer picked up the machine, shook hands and said he may want to buy the other machine that was available. 4 months later during a routine traffic stop I was put in handcuffs and spent 5 days in jail for grand theft. All charges were dropped. TD bank falsified documents to pursue the arrest and their investigator admitted that it was a mistake and there was no probable cause. Now do you understand?

You are not going to like this....

You still didn't give a lot of detail but it is enough that I can tell you pretty much what happened.

If this was not a face to face transaction.  You were contacted by someone on Craigslist who offered to purchase your item.  They gave you some reason why they had send you a check.  When you go the check it was a Cashiers Check for well over the amount you were going to sell the item for.  When you contacted them they gave you some lame excuse such as their secretary screwed up.  But to keep the sale going they give you a generous offer for you to cash the check, take an extra couple hundred for your "troubles" and send the rest back through Western Union(sometimes GreenDot or other Pre-Paid debit cards).  How am I doing so far..I bet prety close.

So then you deposit the check and wait until the funds become available.  They become available the next day and you go ahead and send them the money.  But then everything goes to heck.  A few days later the bank comes back and says the check was bad and you owe the money.  

Oh and how do I know this..because this is a COMMON scam that has gone on for decades in various forms.  So much so that if you actually read the Western Union Transfer forms or right on Craigslist that warn about this exact scam.

So now the part you won't like..TD Bank is correct, and this same thing would have probably happened with any other bank as well.  When you deposit a check YOU represent the check as being good.  If it comes back as bad you are the one who has to "make good" on the check.  You can look up the term "Holder in Due Course".  If you fail to do that you can be reported to ChexSystems.  Also, in some cases due to the exact circumstances this can be considered Theft and criminal charges can result.   

If this was a face to face transaction, where you didn't send them back any money then it must have been for a significant amount to actually be arrested.  And again it is your responsibility to make sure the funds are good.   That means cash ONLY, even if that means you go to their bank having THEM cash the check and giving you the cash.

Now, you asking for a DL # won't work.  Because if this person was going to give you a counterfeit or fraudlent you really think they are going to give you their real number?  

Your only "out" would have been to go after this person and sue them to repay you for the check..and actually in turn could have charged them with the same crime you are being charged with.  But this person did not give you any valid information.  Their name was fake, if you contacted them by phone it was to a "throw away" cell phone or Internet Phone paid for with a Stolen Credit Card.  If they gave you an address it is to an address that does not exist or is not related to them.  They love using vacant lots as addresses.  Oh and the biggest thing..they are not even in the US.  So finding them is basically next to impossible.

We are in court still because we are suing TD bank. TD bank reported me to chexsystems and many other agencies for fraud.

TD BANK PROVIDED False information TO THE POLICE saying that I comitted thieft. This has literaly ruined my life.

I just hope no one has to go through what I am going through.

I sold something on craiglist accepted a check and deposited it into my TD bank account. Four months later I was arrested for grand thieft.

You are asking specific question. Did you go through something similar? If you ever accept

You don't get arrested for information that is in ChexSystems.   So if you are being truthful then what is the entire story.

What false information do you say that they provided to ChexSystem and the Police?

What other Government Agencies are they reporting this information to?

Where were you arrested?

What were the exact charges you were originally arrested for?

If the charges were dropped why are you still in court with them?
