Attempt to intimidate me and my household from speaking out about what has happen to me regarding hard earned money I've worked for and was scam out of. I have no reason to defame them out of any malicious reason beside speaking the truth in protection of other workers that may not have a knowledge of how they may be getting cheated out of their earnings. It's so slick you have to have a good eye and copies/screen shots of your records in order to start putting two plus two together. When I adding the two plus two other and got four. I seen They've cheated me.

Once I've sent my copies to Labor Commission and other place regarding this scam. I was let go and sent a letter of being sue if I say anything about the company basically. This came in a form of retaliation because I report to the BBB for their business practice. I will not be intimidate or made to feel like a victim by any one. Now I've been working very hard for this company for 1 year and 3 months. When I first cam on the company was a great place to work. That is until They hired a New lady Name Trish. This is where I start to see unprofessional business etilithic and conduct begin. Big company liability. Unanswer email regarding concerns about your pay, or she don't understand what you're trying to say, catty, disrespectfulness and racism when knowing I was African American. 

I don't think records of my records will show up but this is part of my complaint and the back and forth email I sent to them. After I notice my stats was incorrect and told Antonio I sent a copy of everything to the Labor commission. That's when the retaliation letter came and saying they have 30 days to pay us for previous payment. In other words we are not going to pay you until that moment. Causing emotional distress further on our family finance. The books need to be investigate. P.S. They wipe the whole system of all o our records clean good thing I made screenshots and copies.

 I work for them as a Independent Contractor (Phone Actress) for over 1 year and 3 month.

 

My Charge of claim maliciously tweaking/tampering with my commission pay and number that's call previous 28-day rolling Live Chat numbers. Now theses number in their system are very important to workers. The 28 days rolling Live Chat number will determine the amount of pay rate and how much pay out your commission will be. For example: if you log in their system for work on Monday. You earned 175 minutes for that day. You previous 28 days rolling Live chat minutes was current live chat 95 on Monday. The 175 gets added not taken away to the current live chat 95 after 12 midnight on Tuesday. When mean all together for the next day(Tuesday) after 12:00 am you earn 270 Now previous 28 days rolling Live chat minutes. Now if youÅ• previous 28 days rolling live chat minutes aren't over 2401. You only earn .10 cent on the pay rate scale and and 25% for your commission level payout. The higher you go over the 2401 previous 28 days rolling live chat minutes the increase of your pay rate and commission will go.

 

 Very recently I contact Trish the head person that you'ĺl talk to when a phone actress is having problem. I notice how my previous 28 days rolling live chat minutes were not being added up correctly. I asked them if they could take a look into the system. I told her that my previous 28 days rolling live chat minutes was suppose to be over 3,000. She wanted to know how did I come to that number. I sent my stat record and explain to her like I am explaining myself in this letter. After this email I didn't get a reply back for some days but I was still working and numbers were not being taken away from my previous 28 days rolling live chat minute each day I work. My previous 28 days rolling live chat minutes went from over 2,500 which place me on the pay scale of .15 cent per minute and 50% commission pay out level for each membership package sold.

 

 I start noticing that every since Trish notice how high number I would make certain attitude treatment I would get. For example, I had just put in like hour of work on the line and a conference refresh  course were schedule on a webnair. I and my daughter attend the meeting, we heard all the other women interacting in the meeting except us this was back in December round 28th 2013. We got muted it, a prompt told us that the leader had muted us out. I was shocked by this behavioral because Ive been a worker for the company since April 2013 and was one of their top performer. I was so good with my character Tiffany Telemainia offer to use her in their backpage with consent I choose not too because I wouldn't get extra money. This was the first thing I notice a change with the company since Trish came. In all fairness to the company before her arrival. When a vital issue like this would come up Antonio or Ann would take care of it right away. Now because you do have to go to Trish for everything, unprofessional business conduct, catty behavioral, unethical business practice, unanswer phone calls and email when she knows it's me or my daughter Dominique.  Back focus. 

 

When I finally sent a letter back to Antonio and called the office. I told them I sent a email copy of my stats record to the Labor Commissioner. Then I got a email back saying why did you contact them? Then Antonio  I guess the owner of Telemainia sent me a email saying a letter is being prepared for you and you should receive it either Thursday or Friday. Never got the letter. I also notice I worked and earned current live chat minute of 103 the next day it showed me to have earned only 4 minutes as my previous rolling live chat minutes.

 

I start suspecting fraud with the numbers, tampering with the numbers as a Certified Paralegal. Here's why? Their unwilling to correct my number right before the pay period ended as to keep me way under the 2401 mark and to bring me and keep me purposely in the .10 per minute level and lower commission payout level for new packages sold. I feel as if someone with the company that has a knowledge with the system number was tweaking, manipulating their own system. This would mean, I would work harder like in a sweat shop for only .10 per minute, no more bonuses that I use to get. This stop 5 months ago and I work all the time. My commission pay out would go lower. Like making sure before the pay period ended I would receive a more lower paycheck. More money would go inside of their money for not paying me accurate for the previous 28 rolling live chat minute I've earned that wasn't credit to me. So if I was suppose to be at .15 cent per minute but their system read me to be at .10 cent level. I lose out and they get extra money in their pocket by not giving me those previous 28 days rolling live chat minute I earned. (This is where the Paralegal inside of me is screaming scam, fraud) especially with the unwillingness to fix the problem that will affect someone pay. After my complaint. I went from high performance to low due to the problem that have to do with the pay wasn't promptly fixed right away.

 

Why Race Discrimination Charge? I meet one of the staff in person name Ann one day when my check didn't get sent out. I told her how I need my check and they told me I would have to wait. I explain, express I have a 3 year old in the house and I need to make it to the grocery store. Ann offer to bring a little something to hold us over until the check came. This was very nice of her. She seen that their top star performer was a full figure curvy, older mature black woman playing the role of Tiffany the white character they wanted to place on back page for advertising. Knowing who I am I would have random caller shouting out the ¨N¨ word. Some callers would describe a woman their looking for just like me. A older heavy set black woman. I am calling from Vegas. At first I thought nothing about this but then It were happening often after that in person meeting. I notice being out with my 3 year old grandson and daughter of all these stranger harassing us. Knocks on our door from complete stranger we didn't know. I felt that my confidentiality got broken and word spread like fire among each other that I and my daughter working for them is black. 

 

Why Age? Seeing I was over 40 that could adjust my voice to sound like a 20 something white woman and make sales from this as an older black woman.when Ann met me and Ann and Trish I think are in their 20's I think Trish said she was 26 my oldest son age.

 

Why retaliation? After I said I sent email copy to Labor Commissioner. I seen my stats previous rolling live chat minutes were reading 2,220 I earned current live chat minute of 103. After 12:00 midnight, my previous rolling live chat minute showed 2,224. I guess this was to be funny and cute. My whole 103 current today live chat minute weren't fully added only 4 minutes of my live chat work. Again as if someone is purposely manipulating my numbers. 

 

I remember seeing a review on the ripoff.com page of a woman complaining about Trish with the company and stating how they didn't pay her. I kinda got thrown back on it because I always got my check except for that one time. Now I see and understand why this woman made her complaint. It involve the manipulation of the system number with your previous 28 days rolling live chat minute and commission. No telling how many other people notice this and never made a claim. If a company have over x amount of employees independent contractor that they feel. They can get away with ripping them off because they'Å•e independent contractor. Thats a lot of unpaid money owe to this worker and no telling if the customers minute packages are being tamper with. Since last email my number keep decreasing. My number for Monday wasn't added. If your 28 days live chart minutes are only suppose to roll off every 28 days. Why is my number rolling off everything I login and work. It like I am working for free and is keeping me at the lowest pay rate. This is a copy of my commission page after 12:00 midnight. It show another decrease within 1 week my numbers went from over 2,500 to 2,265??? This is what its' showing after 12:00 am This is what is showing Saturday at 1:30 am in the morning. My rollover number keep going down. It went again from 2,465 to now 2,434 and my numbers been doing this almost every day. Instead of my live chat being added it decreasing. That's why I keep contacting someone about this because it will affect my wages, pay. Like last pay period I put in 1,514 of live chat minutes. But my 28-days rollover showed it as if I did lesser. I don't know if Carey is still over checking the system out to make sure all of my number are reading correctly. Because I am putting in a lot of work on the system.   I see I no longer get bonuses also anymore for the past 3-4 months. I used to get bonuses all the time from the moment I started in April 2013. Now I don't even get bonuses anymore.   I just starting to notice a different with my number from when I started a year ago. To now the past 3-4 months. Something isn't right. That's why I am trying to make copies and send it to the company so you may be able to see exactly what I am seeing.   I sent you a copy of my last pay period records but I havent heard back from you. STEADY going up I am having more longer calls.  I did a 2 1/2 call on Friday my average length was 170 and within minute this number along with my 28 days rolling numbers has been dropping quickly. As if someone is manipulating, tampering with my number every time my numbers are getting higher. Which means it will keep me at a more low pay rate and commission. At this point I feel someone is aiming for me in a malicious way. Every time I log in to work my numbers go down so does my rate of pay.
