I purchased a telescope/binoculars package offered by Mr. Vorce in one of his EBay auctions. Here is the URL to the auction.

Mr. Vorce stated in the auction that the telescope was brand new. However, when I received the package today, I found that the telescope was obviously used. There are scratches and marring on the tube, and one of the pieces of the telescope, its electronic eyepiece, was missing from the obviously-opened-before box. It is stated clearly on the telescope's box by the manufacturer, Meade, that the electronic eyepiece is included with the telescope.

When I emailed Mr. Vorce and asked him to send the electronic eyepiece, he refused and claimed in reply that the auction was for a used telescope, not a new one. However, the above URL clearly shows that the auction is for a brand new telescope, which should presumably include everything that comes with a new telescope including the electronic eyepiece. Mr. Vorce also stated in his email that he would send the electronic eyepiece to me if I could show him where in his auction that the telescope was described as brand new. I did this but he still refused to send the eyepiece.

Mr. Vorce also posted false and defamatory negative feedback about me on EBay in response to my posting true negative feedback about this transaction.

It is true that we did not send the electronic eyepiece with this telescope.
It is also true that we did mistakenly put in the Ebay ad that this was a new telescope.
But what he fails to mention, is that we never included the electronic eyepiece in the auction. We did specifically state everything that the buyer would receive and we did send exactly what we stated, so there was no ripoff at all involved here.
We did offer a full refund which the buyer did not take advantage of.
Also we did change the auctions' wording after this problem from new to refurbished and we then stated that the electronic eyepiece is not included so future buyers would not expect it in the package. This was a mistake, not a deliberate lie. When you put up 200 auctions a week some errors in the copy do creep in.

A true ripoff is a deliberate fraud and taking money under false pretenses.
A true ripoff never involves offering a refund. This mans' ripoff report is misleading and does not give any of the facts that he has to hide to make you believe him. We have a 99.8% positive rating on ebay. We didn't get that extremely high rating by being ripoff artists. If this man had been reasonable and had not been so quick to leave a negative on ebay, which makes us much less willing to appease anyone, we could have settled this problem amicably and you would not be reading any of this now. He was totally unreasonable and we could not reasonably do anything to make him happy. But he falls under the .2% of people that we consider bad customers and we blocked him from bidding on any of our products again, so this will be his only bad report about us.
