Called terminex in April,they sent a man down to check out the situation, yes I had termites he said it would be 2,000.00 I paid with my credit card, few days later, terminex came down to install cylinders into the ground, checked once in may, and never came back. it dawned on me when sitting in my backyard and noticed the grass growing over the cylinders they installed.

I had alot of activity this past summer getting a pool installed and also, new electricity in the backyard so it really didnt dawn on me, Terminex wasn't here.

on August 26th i called the passaic county office 973-428-9470 and spoke to a girl Tina, she told me they have been alot of promblems withour area no-one was doing their job, and they moved out of the area. there was alot of Clifton NJ complaint's she assured me she would have some-one come down the next day 8-27-03. no-one showed the next day. i called 8-28-03,I got tina on the phone and she was a little hostile, she said don't yell in my ear honey. i wasn't yelling i was excited. she turned the phone over to this man Johnathan, he was very nice and said you know how many complaint's i have from Clifton Nj I will have some-one out the next day 8-29-03 between 8am-12pm, no-one showed

I told him 2,000.00 was not a drop in thse bucket and he said i understand still no-one showed. and it caused more damage to my home HELP! what do I do

I am sorry to here about your problem, i work for Terminix. You should call there office and ask for a computer print out of your termite baiting system. This will show each station that is in the ground,the date each was checked and how long it took them to check it.

Each stion has a barcode whitch is scaned when checked.all this info is on there. If they dont send you this then here is who you call.1 800 992 5994 this is dow agroscienceces phone number they have a link into terminixes computers and can get this info. dont let them fool you. they make the baiting system. this printout should should the very first month to the last month that it was checked. an average home has about 22 stations this should take about 14- 18 mins to check all 22 if it is done rite. Boy i could get in trouble for this so. you not here it from me.Just trying to help

Terminix USA is nothing to do with Terminex UK

Are you aware the company being mentioned in your reports is called Terminix. This has nothing to do with and has never been part of Terminex Ltd in the united Kingdom. Please make this clear in your information about Terminix USA.

Terminex is a highly regarded and experienced Pest Control company operating in the United Kingdom, does not trade in the USA and has not been involved in any of the cases you have mentioned.

Terminix puts a binding arbitration clause in their contract that prevents you from suing them in court.

In this case, small claims court might not be an option. Terminix puts a binding arbitration clause in their contract that prevents you from suing them in court. Commercial arbitration is expensive and heavily favors the company. Consult an attorney since laws could be different in your area. Keep in mind that this is not an isolated incident, this is pretty much how this company does things. Look them up on Google sometime, they have quite a reputation.

Also, termite bait stations are not very effective. The most effective treatment currently available is Termidor (http://www.termidorhome.com). I'm not affiliated with that company, but the product did get rid of the termites around my house.

Finally, it's best to choose a small local company to do this type of thing. A national company can get away with shoddy work, a local business doesn't have that luxury.

have the credit card company reverse the charges

When charging something on a credit card, if the seller does not deliver, have the credit card company reverse the charges (due to whatever reason, such as non performance of contract or poor workmanship). They are willing to do that, especially if you can provide another contractor's opinion that the job was done improperly. But it has to be done within a reasonable amount of time. BUT TRY ANYWAY ! Then the burden of proof is on the seller. And you can build a case from this site, the Better Business Bureau, Google, Yahoo, etc.

Heres what you do:

Go through your books and find the copy or original cancelled check that you used to pay Terminex.

Dig up the contract that reflects the visits that Terminex said they would make for $2,000.

Write down on a note pad all phone calls that you made and basically what was said on those phone calls. This Rip Off Report letter is actually perfect--print it off.

Contact your local courthouse in Clifton, N.J. and file a complaint in small claims court. Name the owner or the manager of the business in Clifton NJ as the defendant.

Ask for the full $2,000 back plus court costs.

Im confident that you will win because they failed to fulfill their end of the contract. Its $2,000, do not allow Terminex to stall you. Once you get your money back, call a few local real estate agents and ask what companies they use and then choose from those. Real Estate businesses are notoriously good sources for bug companiesthey use them so often.
