2/11/2012 received a billing from Texas Tollways claiming I owe them $2.80 with threat of $350 plus if not paid by 3/08/2012.  Texas Tollways is in effect Texas DPS as they seem to have the force of the law behind them, according to the billing sent to me.
 
One: vehicle license tag listed in bill has NO ETAG from them nor have I ever had a ETAG.

Two: I never was at the location (SH130) in Jan 23,2012. I've not been on any tollway for over a year. If I have been on any Texas Tollway the last time was well over a year ago and that was Houston , TX Beltway 8 where I pay cash at the tollbooths. Never in my life have I had any Tollway ETAGS anywhere.

Three: I did not visit the location listed SH130, that is in central Texas. Not been that way in some years. (general area).

 THe billing indicates I have a account number with them and they do list my vehicles tag number correctly. However I NEVER set up any account with them of any sort, nor did I ever travel any tollways in well over a year.

 I am sending copies of the false billing to various state agencies, Texas congress reps, and media this coming Monday along with a letter explaining in detail the situation.  I've already contacted two local consumer reporters and hope for followup.  I plan to call Texas Tollways on Monday 2/13/2012  and attempt resolving peacefully.

It is my opinion as of this writing both they and I are the subject of scamming and someone is using known weakness's in their system to create false ETAG Tollway ID TAGS. However this is a state agency in effect, so as of this posting it is also my opinion that the state is  using the force of law to try to scam me out of money using threat of great harm (350 dollars potential plus I suppose records infringement)

 I refuse to bow to this without a fight. If I do, whoever and whatever is pulling the scam will just get away with more and the State of Texas is probably sending out false claims to other innocents. I can not be the only one.
 
If you have been the subject of a similar attempt by the Tollway authority I encourage you to post as I have a feeling this is just one example of how ETAG system is broken and there are scammers out there faking etags and attaching Texas Tag numbers to them. That is my supposition at the moment.

 I should have updated this over a year ago but better late than never.

TL:DR  Situation resolved and I no longer owe scam money as the account I never opened is closed:

 

 Mid Feburary 2012 I recieved a reply from TXTAG.ORG  :
