My boyfriend has lived in the Enclave of Naples for over two years. In that period of time, three of his family's vehicles and visitor's vehicles, have been towed off premises. Every time a vehicle is towed, the renter has to pay the towing company, Morley's Towing & Recovery located at 6344 Janes Lane, Naples, FL 34109, $120 to reacquire their vehicle.

Of the three instances above, the first one occurred while the family was on vacation in Orlando. They came back only to discover their car was gone! They contacted the office and they said it was because the car "had a flat tire." The car did not have a flat tire before they left. The car also had a parking permit in the front window.

The second instance was the family's SUV. The office claimed that this vehicle had no parking permit when it was clearly visible in the front window of the vehicle. The Enclave claimed they would refund the cost of the towing to my boyfriend and his family because of the mistake. This never happened. They were never reimbursed for the cost of the tow.

The third instance occurred early this morning, December 1, 2008. I had a personal emergency and was visiting my boyfriend for a couple hours. I walked outside to drive home only to discover my car was gone! We called the office and they verified the car had been towed because of no parking permit. My boyfriend spoke to the security guard that was on duty. He was absolutly no help. He gave us the number to his supervisor, Jason Clark, who was also no help at all. I have been to this complex numerous times for a few hours and never had any issues prior. I have never heard of such a rule! This seems like a pretty quick and easy way to make a little over $100! Especially if the Enclave and Morley's Towing & Recovery have a deal where each of them gets a cut every time a vehicle is towed! I'm sure if my boyfriend, his family and myself have had such problems with the Enclave at Naples, there must be many others! This towing scam must be made known so others don't have to suffer. They are taking advantage of their tenants and their tenants visitors!

Towing Problems and Improper gate Pass Rules at The Enclave at Naples.

The Enclave at Naples has a very bad system in place for their parking passes . It is causing multiple problems for me and my tenants. I have complained in the past about how ridiculous the parking pass system is at the Enclave and was told by the property manager that I have to raise the issue at a homeowners association meeting. When I asked the property manager when the next meeting was she said she did not know and she also said they are not required to notify me of these meetings. I do not live there as this is a rental, so I would have to drive there to see when they post it on the bulletin board at the office. It would be a guessing game for me. They need to come up with a better system like issue a warning on cars before towing them, and also have the security company check the plate number against a list of registered vehicles before towing them away. The only way to get a parking pass is to get one during office hours. If the office is closed, they make you call security so they can meet with you outside of the gates to bring a parking pass. At times, they do not answer their phones! This is very inconvenient for every one! They also need to start utilizing the key pad near the gate, which they refuse to issue codes to owners or tenants. I have lived in South West Florida for almost ten years, I have never seen or heard of a community that operates this way. It is very costly and I am losing tenants over this. We need to confront them at the next Home Owners Association Meeting about this and complain big time. I want to find out if they can legally do what they are doing...It sounds like a big scam to me between them and the towing company...

We called the police to see if there was anything we could do about it. The gentleman we spoke with said the only thing we could do was pay to get the car back. He also said that they have received numerous calls about this before and that Morley's already had a few formal complaints about their company. When we got to Morley's to pick up the vehicle (and pay to get it back), the gentleman working there verified that Morley's had many complaints against them but were "still in business."
