on dec. 9th the guardian group was given all of my paperwork and the check for $1595. this check was cashed on dec 14th.  i called wells fargo once or twice a week to check on the progress. i would then follow up with ggf to let them know wf had not rcvd any inquires besides myself. ggf kept telling me i was speaking to the wrong department. when i would call wf they would tell me there was no such department. on jan 7th i spoke to someone at ggf who told me that the stop sale request was submitted. on jan 11th i called them again to let them know i called wf and the attorney in charge of the sale and they told me the sale was still on and they had recieved nothing to stop the sale. on jan 12th (sale day) i was on the phone for 3 hrs trying to stop the sale myself. i did not know until i went to my house at 5pm and found someone had broke my locks and was in my house going through our belongings that's how i found out my house had been sold. that person then gave me a 5 day notice to vacate or i could rent my house. i have been calling ggf since the sale and i have been told 3 times the check was mailed out. on feb 5th i was told the ceck was mailed out for the amount of $1295. when i asked why not the full amount i was given another phone number. i called and got a recording so i left a message and i still have not rcvd a return call. there was a big headache for me and it is nothing but a scam.

Cheryl,

I want to say thank you for the information. I just contacted both Morgan and the Attorney Gen. office.

However, I was wondering if I could get information on who to talk to at Wells Fargo regarding my loan. There is a unique (maybe not) situation I'm in.

Wells Fargo is my loan holder. The loan was purchased from Meryll Lynch in their bankruptcy sale, I'm sure for pennies on the dollar. The Servicing company is stating to me that since it is NOT a Freddie or Fanny loan, I am not eligible for the HAMP program or any other government program. Even though Wells Fargo does participate in the program. I do believe there is an isurance policy that gaurantees 80% of the purchased value if I default. (Make money if I leave property) They would get $200k if I foreclosed or short sold.

I have found a loop hole for the banks not to participate.

This loan was purchased from Merril Lynch on the hopes I was going default. The only answer they have for me is. You want to short sale?

Is anyone else in this situation?

Recap: I have (1) loan that I am current on. It was an 80% ltv loan. It's and interest only loan that will mature in 12 months.

I have lost approx. $300k in value in (home value) the last year. I am currently about $220k upside down.

I do believe I pay more than my fair share of taxes and believe I should be just as eligible as everyone else.

I would like to get the contact information to either Joshua Apodaca or to Morgan Lowe with channel 5 news.

I gave my $1595 with all the qualified info. I was told this was the ultimate package. I was on time with my payments and have one loan that was an 80% ltv. Which is now $225000 unside down. I lost $325000 in one year. Everything was turned in Dec 10, 2009. There has been no correspondence. With countless calls and emails, (none being returned) How could I not think this is a scam.

Joshua Apodaca, if it is not a scam, please give me your contact info or feel free to ask for mine.

Anyone having a dealing with GGF should be calling Channel 5 on your side as they are doing an investigative report currently on GGF.  Give them and Arizona Attorney General's office any information you have to help the investigation of this company.

And one more thing, GGF "NEVER" purchased my house. I checked on line and the same company that showed up on the day of the action and gave me a 5 notice to vacate is now the owner "NOT GGF" unless they are going under "ANOTHER" name.  That's okay I have special agent Caritola from the Attorney Generals office checking into the GGF. I'm done here."


First of all because just like all other affiliates I was a representative, I Put that as a representative of GGF. Yes, I told you I would personally insure that I would make sure that it went to FEDEX. So I spoke with Finance and they told me that they were going to go to FEDEX and have it taken care of. All of my facts are straight. I am not here to lie to anyone. 
As a matter of fact Guardian asked me to leave their office and conduct all business either related or unrelated to GGF from my own location . Their reason was because they needed the space, but I honestly believe it was because I was creating so many waves because I was trying so very hard to get answers for clients, and help clients. You are not the only person that I have gone to the extremes of standing on just about everyone at that office to get some answers. This has impacted my relationship with GGF so much that it has been difficult for me to even arrange a meeting to get some answers. 
By the way, I never said that GGF bought your house I said that they negotiated a deal to buy your house and you denied it. Why would anyone buy an empty house if the homeowner was not going to stay? That is not the intentions of the program. So another investor may have purchased your home. 
I want you to know Ma'am that I have tried everything in my power to address your situation. Unfortunately I am in the dark just as much as you are these days. I would love to see how else I could assist you and every other homeowner that has entered the program, I just can't seem to get any answers either. 
Also, I don't mean to come off so aggressive or rude, just please understand I feel that I am being attacked for trying to do the right thing. Let me know if there is anything that I can do, and I will try to help.

Thank you sir for being understanding and approaching me in a respectable manner. I too understand the frustrations that all clients and affiliates are currently experiencing. I hope that I am able to answer all of your questions. 
  As far as receiving a foreclosure and who can stop it, I do know that a homeowner may be able to stop their own foreclosure by submitting a loan modification package. If you have already been denied then I would encourage all homeowners to seek professional help. 
I am not employed by Guardian nor have I ever been. I was contracted for Sales and Marketing. My title VP of Marketing is the title I hold with my marketing company. I carried that title over when I got contracted with GGF to attract business. My contract was 1099. I did worked out of the GGF office as a contractor. 
As I recruited affiliates for sales and marketing deals were brought in from many different avenues.
Unfortunately, I did not know the authors situation as all files did not come directly through me. As soon as files come through the door at GGF they go directly into file intake and then to processing, then to underwriting then to Negotiations. So as the clients file came in, it went directly into processing, etc. GGF seen that the file was about to go to foreclosure and the file went to legal. During this process, I was unaware of the files status. 
Many affiliates have signed up and submitted files, especially on short term notices. As these affiliates were signed up the files may have been sent in incomplete, in a lot of cases the numbers are inflated/deflated in hopes of acquiring a principal reduction. Now that is neither here nor there and I would agree that underwriting should have caught it. But how is it that I would be held responsible for an affiliate submitting a file that I didn't know about. Regardless I am not trying to pass the buck I just want to clarify the confusion.
At this point in time I know of three deals that have been done and as of last night I was told that GGF just completed another 5 deals. Unfortunately I have not received those proofs but I am being told that they should be sent out over then next few days. As soon as I receive anything I will post it for all inquiring parties.
Originally when I posted 60-90 days this is what GGF promised all affiliates. We later found out just like yourself and so many other affiliates and clients that this was not the case. Had I known that the process would have taken a much longer time frame I would have set that expectation. GGF had told us that in most cases it could be accomplished in as little as 45-120 days, but that the average deal would average 60-90 days. The contract has always read 365 days, but it was what everyone was led to believe including myself that it was actually feasible to process these deals in such a short period of time. 
I don't understand what you are talking about as far as running a company under GGF on the web, yet it doesn't exist.  The company does exist. you can locate it on the Arizona corporation commissions website. Please elaborate.
I understand how great this program would benefit all homeowners that are upside down. I did addressed the way affiliates were signed up. I believe that controlled growth and a process of elimination through an affiliate application process was necessary and as per the owners they were opposed that idea. The reason they said they want to keep it open was that they wanted to be able to help out as many homeowners as possible. 
I hope that I have answered the questions and provided enough insight to concerned homeowners. I am no longer working out of the GGF office, they were short on space and needed to make the space available to their direct employees. I still attend to affiliates, and try to help out as many homeowners as possible. 
 I am not hiding, and I am open to helping anyone I can. I just want everyone to know that I will do everything I can to help out.

Josh- a few simple questions

Josh,

a few easy questions, that if answered could do a lot to help/explain/ end some frustration by many at this and other sites.  Granted many consumers do many silly things and do not help their situation, as the saying goes there are 3 sides to every story.  People if you have received a foreclosure notice- only an attorney can help you at that point!  I am not attacking but asking you a few reasonable questions

1. I have seen your title in several places as a marketing director but also as a VP.  Are you an employee or not? your letter says no, so then what 1099/ independent?  Yet you work out of GGF office?  I don't care about your compensation, per se, but you either are or are not an employee and you either do or do not get compensated from deals that you bring in.

2. You mention the deal was brought in by one of your affliates?  see question above?

3. Should you not have known her financial situation before you agreed to her application?  would not a red flag or several have been raised as some point during your "underwriting process"?  surely you had proof of her inability to pay or the fact that the house was "not even upside down that much"?  If not then your company is even scarier than some of the people have stated.  Please explain?

4.If you were the top of whatever affiliate chain brought in her application then yes you are responsible, how can you say that you are not.

5. Do you not have any proof of settled deals that you can post and calm many people's fears?  with all the time that you have had, why is it that no one from or "affiliated" with GGF can produce anything other than one closing from last year?

6. why would you continue to have posted that the GGF process is a 60-90 day process when it is clearly 120+.  If you were more accurate upfront with consumers you could lessen some of the stress.  Everyone knows that short sales are in the 6month + timeframe.  I am assuming this is the case for your program as well.

7. Why would you run a company under the GGF name on the web, yet none exists? I am told that the "contract" you have is done with Guardian Group, LLC.  Subtle name changes are always a warning sign. Can you explain to ease our fears?

8. A program like this could be the answer to many people's troubles.  why is it not run in a traditional b-to-b manner.  the fact that is looks like a MLM and that "anyone" can be an affiliate creates doubt in your legitamacy? i.e. this is most often how scams are run.  why?

If you would be kind enough to shed some light on this, then maybe some of the panic would/could go away.  All people want is true and correct information so that they have proper expectations.  Thanks

Guardian Group Fund snagged us too

We would love to call "3 on your side." It has been over 120 days with us and now we have 3 weeks before the foreclosure happens. We will file with the Attorney General also. Nothing has been done; no phone calls returned; no short sell contracts as promised; no reports from their bank negotiations. What a scam! $1,595, and for what?

Well, I must say this posting is a slap in the face. My name is Joshua Apodaca and I am the gentleman that has been mentioned in this posting. I was contracted for sales and marketing just as so many others across America have been. I first came to know the author shortly after she came into our program through one of the affiliate partners. Now if I remember correctly you were going through a divorce, you were living with your boyfriend in an apartment and you were trying to get the house back for you and your boyfriend. So we fought for you, negotiated and got your house. As a matter of fact you were not even upside down that much because after we negotiated with the bank the most you were upside down was a measly $16,000 and you denied the program because you wanted a payment at $750...Wait now as I recall it was not so much that you wanted a payment of $750 but you couldn't afford a payment for any amount above that, and at $140,000 the PI payment alone would be $978.00 and you told us unless the payment was at $750 then you didn't want the deal. 

   Now Let's be real, the program is meant for great things but miracles were not in the cards....Mathematically it is impossible. 

  But that has nothing to do with how we met, as I remember you had come in rather upset about losing your home and you wanted your money back. I hadn't known the whole story nor did I care, I just wanted to get you your money so I could move forward with my day. Unfortunately, I am not employed by the Guardian Group nor am I in a position to issue a Refund check. I was simply using my resources to help you obtain your goal or at the very least relay the message to the Guardian Group Fund Chain of Command. Now you seen with your own eyes as I addressed Luis Belevan in regards to your situation. The second time I heard from you when you called because they still hadn't issued you the refund check. So I again went to the chain of the command and submitted a request on your behalf again. I told you the check was going out because that is what Finance told me. Then I didn't hear from you for a couple of weeks, and then your refund check was returned to sender. Evidently you were not at the address that we had on file for you, So I called you immediately to let you know what had happened. I then got the correct address I went Directly to Finance and then they Sent the check directly to you. So I made sure you were a priority every time we encountered each other. I just don't understand how you can make suck a remark and then on top of everything you smear the name of the only person that tried to help you out, nor was I obligated, I was just trying to do the right thing. I later found out that the check that was issued was for $1295, Guardian Group Fund informed me that that the $300 was for a processing fee for the 3 months they worked on your file to get an offer that you didn't like. So I apologize for trying to do the right thing, a small sign of gratitude such as a simple thank you would have sufficed. I have a good name and if you have a problem with a particular company make sure that you address the company and not individuals that are trying to help you out.

There Is No PROOF!

Johnny your still floating around, huh!  Let me ask you, how many loans have you funded with Guardian Group?


There still is no PROOF that Guardian Group can accomplish a principle reduction thru PPIP or a Hedge Fund or what ever.


The only PROOF, is that people are giving Guardian Group $1595, which now amounts to MILLIONS of dollars.  90 to 120 days till Fund.....where's the PROOF (should be hundreds of examples by NOW)?


Until this company provides more than one example of a funded deal, I'd suggest to everyone out there...do your own due diligence.

Did you pay Guardian for foreclosure defense? Or to try to buy your note and do a cram-down on a home that had already gone through all foreclosure proceedings through the courts?? Sounds to me like you sat on your hands and did nothing, living in your house rent-free, without defending any foreclosure actions, then when time was expired, expected a miracle. Grow up, learn, and have a plan next time, don't blame it on someone else. $1595 was how many months worth of payments you never made?????

I would like to answer a simple problem that you have experienced and you can iyilze for your future reference.
I have been in the Mortgage banking industry for over 16 years and have much Knowledge with Real estate and Commercial properties as well.
If you are in a foreclosure process that means you have a legal entity pending in records of a default on your loan which is recorded and becomes a legal document.
The company that did what they did is legal and i have checked this company out .
The problem is when clients ask for help on the principal reduction it is assuming that you meet the eligibility requirements and DTI  requirements as well as an underwriting approval.
however , the only person that could stop a foreclosure or short sale is a Real estate attorney . You can do it your self by filing a motion to the judge to request a hearing to delay a short sale & delay the foreclose process , every state has this .
If you are in a foreclosure or and pending a Sale date , you MUST hire an attorney to delay that process.
The only way the judge will delay is to prove the reason. Well if you are pre approved pending underwriting approval, and the judge sees the documents ehrthher its a loan modification or Principla reduction, he will grat you a sufficient amount of time to delay the process. Actually an attorney can delay it up to a !1 year if he wants , maybe evn longer.
If you didn't receive your monies back then that's one thing but you should of revived the title insurance and the survey fee back at least because these things are not done till you close . The appraisal will not because it has to be done, so you should only lose that cost and a credit report charge , that's it.
They can do the Principal reduction but they do9nt stop foreclosures , they cant!!!
You the homeowner is responsible for that part and that's when it gets difficult.
I have many client i help when they are in foreclosure , they can go get there own attorney and pay over 2500 or i guide them to do it themselves for free for 1 hr and its that easy. Of course the attorney wont tell you that, you are taking money from them, you can of done it many times and helped many clients for them, no charge by the way.
The Principal reduction i believe takes 90-120 days to close, so it is imperative you work on the foreclosure end, its not Guardian groups job, a lot of times the rep[representative if he is fully educated and knows the business he will be aware of this , its normal in the mortgage and real estate business to know this. But the representative may have led you to believe that they would, that's wrong!!
You must delay the process altogether in the meantime the company guardian group will process and try to close the loan within 120 days.

So to the person "James" that said GGF saved them $210k... where is your original note and where is the new note? You could save everyone on here some heart ache. Post the note somewhere, link to it so everyone can see it and be done with this.

For those of you uneducated. I called them to get some information as I was talking to another company in California that seemed to have started this. Guess what contracts look exactly the same, short of the logos at the top? You guessed it, Guardian Group and PropertyRelief. Not only do they have the same contracts, but their power point presentation is awfully similar. All they did was steal a legitimate idea from another company, spin it off as their own (without any originality to the program) and then tell people they are backed by first, a $5b fund, then a $20b fund then a $40b fun and now a $65b fund. Make up your minds. My husband knew this was a scam from the get go... we did a LOT of due dilligence, calling more than once as different individuals and got different answers, none of which made much sense.

I got my refund!!

I got my refund on fri the 12th of feb. I demanded it or I would come down with the media.  I am in process of filing a complaint with the attorney general.  They need all the customers who are in the same position to file a complaint. so we can see Josh and all those scammers and latinos and latinas in jail.  Have you noticed they only have Hispanic young girls and guys working there. Is it a w***e house or a place of business.  Josh knows what is going on in the scams and continues becasue he gets 300 dollars for every scam he gets in.  What happened we will call you in 3 days to see if it was going to go through.  And nothing was said no phone calls no nothing. 


please file a complaint to the attorney general. go  to the website and file a complaint. keep all you paper work. 


plese respond if you need more info.  I am now dealing with an honest family friend hopefully this will be the last person i will deal with.

yes my house was in foreclosure, more than 30 days out,but I was told on dec.4th that if i came up with the $1595 that ggf could stop the sale while they worked with wellsfargo to buy the note. after the check was cashed(which should not have been done if they couldn't) i started following up with wf every week, sometime twice a week.wf kept telling me there was no activity other than myself. ggf would tell me i was speaking to the wrong department the sale was postponed and tell me not to worry everthing was taken care of. when i asked for a # and ext they were calling for wf' i was told they could not give that to me. when i asked wf for that department, they would tell me there was no such department. it is feb. 16th and i still have not received my full refund. nothing!!!!! i was told the 1st time (1/22/2010)it was mailed out. then the 2nd time(2/1/2010) joshua apodaca told me he personaly made sure it was sent out  that day by fedex and the 3rd time(2/5/2010) was when accounting called me and told me it was mailed out.  my question is, how do you know so much about this issue of mine, that i did not mention in my report? are you working for ggf?

WOW---After reading your complaint, I realized you were @ the Notice Of SALE stage. This means that you were NOT PAYING your Mortgage (rent free) for at least 6 to 12 months, maybe more in todays foreclosure world. GGF saved me over 210,000 on my principal balance reduction, but I was NOT LATE and surely would not be @ the NOS stage. two things I can see, 1 is you probably couldn't afford your home in the first place (or had a hardship) 2. Got away with NOT paying your mortgage for ???? months / year? and now want to BLAME someone ELSE. Why is that?? You should have went to one of those Loan Mod companies, they would have charged you 3500 and not even returned 1295 (honorable) and you STILL would have FINALLY had your home Foreclosed on. As i said early on, it's always the loosers who like to BLAME everyone else. If they can save me 210,000 for $1595, I'd take that bet any day of the week. BESIDES they tell you it will take 60 to 90 days to purchase your note at Todays Market / Appraised value, So WHY DID YOU WAIT till the Last Minute to take ANY Action Period??

Question for you regarding your situation

Hello.  I have to ask you a question?  By the way your story reads, it sounds as if your house was going through a short sale or a foreclosure....is this correct?  I am currently in this process and have been nervous about it as well.  However, I did get a letter from Wells Fargo about 1 week ago (I started this on Jan 14, 2010), and the letter said that they received a communication from the Guardian Group Fund that stated I have given them permission to speak about my loan on my  behalf.  I felt a little more at ease when I received it because it let me know that something is being worked on.  However I wanted to ask you this because in no way am I in a situation where my house is at risk.....I have never been late on anything, nor am I at risk of foreclosure.....my home though is about $200,000 less than what I purchased and have my mortgage for.  If you could please let me know if you were in foreclosure, etc., I would appreciate it because if not, and you all of the sudden saw your home go like that, would cause great alarm.  I'm very sorry to hear this happen to you.
