I hired James Scott Farrin on September 4th, 2008 to help me with my disability case and fired them on December 21st, 2008 after frustration of them doing nothing to help me.  I was then approved for my disability case on December 29th, 2008. Then Frederick or Rick Fleming whom I had never heard from contacted me on December 29th, 2008 to say that his law office was taking their 1/3.  Rick Fleming then contacted the Social Security Commission to tell them, he had won this case and was due his 1/3 of the money.  The Social Security Commission didn't know what to do or who to believe so they gave him his 1/3 of my money, they did this simply because he's an attorney and his credentials are better than mine, I'm just the little guy with a disability.  Rick Fleming was not aware that I had and have  a VOICE RECORDING  from his office from (my contact person Cameron Boyette)  dated December 21st stating that his law firm had been fired and wanting to further discuss this. I then called them back the next day and a couple days later to re-affirm that they had been fired on December 21st. I still have the voice recording of the admission of the law firm being fired. 

Rick or Frederick Fleming of the Law Offices of James Scott Farrin has no ethics what so ever, he's a liar and thief and owes me the 1/3 that he took while knowing they had been fired.

Call the North Carolina Bar Association and report this offense.  James Scott Farrin is no stranger to the North Carolina Bar Association.  They will thoroughly investigate your claim and punish James Scott Farrin for any wrongdoing.  This firm claimed to represent myself and several family members in a large lawsuit but when I asked to see a my signature on a hiring retainer agreement they couldn't provide it to me.  They still said I have to jump through several hoops to fire them. So tell me, why should I have to go through such lengths to fire them when I didn't even HIRE them!!  They are bad people.

First, the individual you keep referring to as "Ms. Surprised" did use an actual name in her rebuttal. It clearly states that the rebuttalist's name is "Sylvia."

It doesn't take an employee or agent of this firm to recognize that there are some issues with your complaint.

You stated that you fired them on December 21. Your case was approved a week later. The mere fact that you were approved gives rise to a presumption that they did do something for you. The fact that the approval came down so soon after your termination bolsters that presumption.

Now, did you actually find all of the necessary forms, fill them out, and timely submit them, along with all the other requested documentation, without ANY assistance from this firm? Were you actually approved on the original application without ANY assistance from this firm?

They didn't even do so much as to tell you what forms needed to be filled out and submitted? And there was never a denial of your application?

If all of this is true, that they did in fact do NOTHING for you, then you may or may not be entitled to a refund of your money per contract law. But it could be the case that things went so smoothly with your application that the firm didn't have to do a thing. If such is the case, then merely standing by in case they were needed may be enough for them to have earned their fee.

It probably won't be worth the time or cost to hire another attorney to sue them, but it's certainly an option, and you may be able to find an attorney to review your matter for free to see if you have a viable case. Alternatively, many state bar associations have fee arbitration programs where you could lodge your claim and allow a neutral party to determine whether you are entitled to a full or partial refund.

Sylvia (no city) obviously works for them.  They seem like a pretty scummy outfit to stoop to such a low level.  SUE THEM!  These shysters need to be stopped and taught a lesson.

Well Ms. Surprised, it's quite obvious that you either are chicken turd Rick Fleming or you work for James Scott Farrin. There's NO WAY you can possibly think they did right by anyone. I think you forgot I have the law firm recorded stating they had been fired on December 21st, that's 8 days PRIOR to Rick Fleming speaking to me about the case.

I have never heard of anyone or company HAVING TO AGREE to be fired and that's what took place.  This law firm will reach to any low level or manipulation to get their wanted result. 

And you mentioned that they possibly did all this work behind the scenes for me, OK, their FIRST and ONLY phone call to the Disability Office took place on December 29th, 2008 as I spoke to Donna Gould at that office every week through my year long deal. She told me that Rick Fleming called her on the 29th whereas she told them THEY HAD BEEN FIRED by the client and she couldn't give them  any information, I asked her about all their contact, she said NO FAXES, NO EMAILS, NO CALLS from JSF,  TURD>Rick or anyone else until the 29th.

So you go ahead and recommend these THIEVES all you want to, you'll get burned or you could come out from behind your chicken-turd name Ms. Surprised and MAN UP to the TRUTH, something that evades you.

I am surprised to hear that you feel you had a bad experience with Rick Fleming and James Scott Farrin. My experience with them has been nothing but fantastic. James Scott Farrin has helped several friends of mine with both Social Security Disability as well as personal injury, like helping my best friend after an auto accident. Maybe it would help if you knew more about Social Security law. I worked for the Social Security Administration fpr many years and here are things that I believe to be fact: 1) The attorney doesn't contact the SS Commission to tell them the outcome of any case, favorable or not. It is SSA that contacts the attorney. 2) SSA doesn't give money because they don't know who or what to believe. They give money based on a signed fee agreement. It looks to me like he was your attorney for almost 4 months and while I can't be certain, I am willing to bet that in that 4 months, someone at the firm did something to help you - fill out forms or applications for you, etc? 3) Attorney fees are set by SSA and they are the same for every attorney - 25% of the back pay amount (that is 1/4 - not 1/3).  Your case was approved, so, you got 75% of your back pay and 100% of your monthly checks from here on out, correct? 4) You can fire any attorney of any kind at any time you like, but it doesn't mean that they don't get paid for any time their employees spent on your case up until that point. I am sorry you think your experience was a bad one and I am not saying that it wasn't, but it certainly is unfortunate. I just feel like there must be more to the story than maybe you even realized. Even if there isn't, I just wanted to note that my personal experience with both Rick Fleming and other attorneys and case mangers at James Scott Farrin were wonderful ones. I have referred several friends there and will continue to do so, in fact, Mr. Fleming is about to represent my own mother in her disability case and I have no qualms about that whatsoever.
