We have a very very serious problem.
First, You apparently didn't read my email in its entirely. I did very plainly stated CANCEL MY MEMBERSHIP IMMEDIATELY and refund my monies to me.
I apologize for any miss understanding you may have, but I am and will seek legal counsel as well as discuss these UNAUTHORIZED Transactions with my Bank.
I also am planning to file a Formal Complaint with State of Tennessee.

I will Request an investigation into this matter.

The RUSH is like most Fitness Centers, they use a used car salesman like tactics, and pressures to force individuals into contracts for membership.

THE RUSH FITNESS CENTER take monies that does not belong to them. I DID NOT RECEIVE ANY STATEMENT FROM THE RUSH FITNESS CENTER STATING, THEY WOULD CONTIUNE TO WITHDRAW MONIES FROM MY ACCOUNT AFTER MY TERMS OF THE CONTRACT WERE FULLFILLED.

THE RUSH FITNESS CENTER CALLS IT MONTH TO MONTH. HOWEVER, IF YOU DO NOT FULLFILLED THE CONTRACT TERMS COMPLETELY, THEY WILL SUED YOU FOR MONIES DUE THEM AS PER THE CONTRACT.

Please, let be perfectly clear, The RUSH was not authorized to withdraws any funds past Aug 2005. The contract was SCHEDULE TO BE FULLFILLED AND COMPLETE AT THE END OF AUG 2005.

I THEN COULD DECIDE IF I LIKE TO CONTUINE MY MEMBERSHIP.

I did not use MY MEMBERSHIP AFTER AUG 2005. MY LAST VISIT TO ANY THE RUSH FITNESS FITNESS CENTER WAS IN MAY 2004.

he Rush Fitness Center DID KNOWINGLY WITHDRAW $1285.00 from account and is refusing to return my funds. They Didn't use Gun, They used MY Checking Account.

PLEASE DO NOT USE THIS FITNESS CENTER, THEY PRACTICE BAD BUSINESS TACTICS AND WILL NOT ADMIT TO ANY WRONG DOING. (see response from THE RUSH FITNESS CENTER below: Stephen Massey Response:

Mrs. Mashburn did indeed read your email in it's entirely and so did I. As she stated, we will not issue a refund for the monthly dues you have paid. I understand that this is a lot of money you have paid. However, you apparently didn't read your agreement in it's entirely because it does state the following:

TERMINATION OF MONTH TO MONTH MEMBERSHIP: You may terminate your MONTH TO MONTH membership upon (1) written notice to the club and (2) return of your ID card when your membership ends.

I can also understand that this is frustrating for you, but we must abide by the agreement. Feel free to seek legal council or file a formal complaint with the State of Tennessee. We don't want it to come to that, but that is your right. What I am willing to do is allow you to use our services for the next year without paying. This is the best compromise I can offer.
