I purchased a set of DVD's from this company with a 30 day trial period on 04/20/2009. I returned the DVD"s on 05/05/2009 by certified mail return receipt which was signed by a company representative of this company on05/09/2009. This more than fulfilled my obligation to return the material with 30 days and terminate anymore contact with this company. Yet, on 05/29/2009, I received another set of DVD"s which I did not order. I contacted the customer service rep by phone and e-mail and requested that he send me a call tag which would compensate me for the return shipping charges for the DVD"s. This he(Bill) refused to do. I also discovered that my credit card was fraudelently charged a sum of $106.50. I am curious if any laws were violated by this unwarranted use of my credit card. Any assistance with this matter will be greatly appreciated. Thank you.

#1 UPDATE EX-employee responds

Norm isn't telling the whole story

AUTHOR: James Smith - (United States of America)

POSTED: Saturday, March 06, 2010

I will only comment on what I know about this cas, but I will say Mr. LaCrosse isn't owed any money.  He ordered the product, but though he might have returned it which I doubt, he hasn't mentioned anything about following the company's return procedure.  The reason I bring that up is because we only give them the correct address for the returns department after following the procedure, so I have no idea where his certified letter might have gone if it was every sent.  Also when some one follows the correct procedure their account is marked inactive, and they're not charged.

Now he claims Bill refused to give him a call tag, but the company doesn't offer free shipping to anyone.  If this "gentlemen" had simply followed procedure he wouldn't have been charged, and this could have been avoided by simply paying the few dollars for shipping.  Now the "fraudulently charged"  is funny, because I know customer are only charged for modules they keep.  The customer is given additional weeks to return the module, but M. LaCrosse seems to have never initiated return procedures, so his account was never canceled.

No laws were broken and this customer threatened to call the the Attorney General of his State and New Jersey, but if he's here ranting I doubt the government saw any merit in his case.  That being said I don't have his file in front of me, but he sounds like others who don't follow the rules and are charged for it.  I do know if he did follow the return procedure and was charged by mistake he would have his money returned to him, but he never said he called to cancel his order, and was automatically charged.

Try mailing your cable box back to your cable company or any product back to any other large company.  Now assuming it arrives do you think they will just stop providing you with service?  No, they will keep charging you every month, but if you call and explain you want to cancel I'm sure they will tell you how, and what to do if you have to return anything.  Sounds like Norm didn't follow the rules, and did what he wanted.  Hey the customer is always right, but that doesn't make him correct.
