I came in to cash  a check I had received from my last job since I had lost my job. I decided I was going to take my kids out for ice cream once I had went to UNbank to cash it. Well to my surprise, the lady at the window told me that I had took out a loan with Unbank a few years ago at another location and that she could not give me my check back because I owed the company.

I was shocked that they could get away with this. I did remember getting a payday loan from them some years ago which i was not able to pay and had to file bankruptcy since  I had some financial problems.  I immediately left the location and called the police. The police told me that that there was nothing that they could do and that I would have to take them to civil court.

I felt like I was totally violated because the woman took my check through the window and told me she could not give it back to me. I told her that it was not her check to convescate. She said thats the way they do business there. When you owe money to someone you can take them to court and make payment arrangements to give them the opportunity to pay. But they did not attempt that.

I felt she stole my check in my name that did not belong to UNbank! I hope that no other check cashing companies where you can take a loan out can just do this to a person without taking them to court.

You're Right

A postpetition (after you filed your bankruptcy) obligation cannot be used to set off a prepetition (before you filed your bankruptcy) debt. See, e.g., klgates.com/files/Publication/56da8ca6-ba6a-4973-8fa4-3b2d8aaf05a5/Presentation/PublicationAttachment/77554d2e-5845-481f-9f1c-4f3a7f161e4d/ba1205.pdf. Contact your bankruptcy attorney immediately.

What they did may have been illegal depending on bankruptcy laws.

I do not know the details, but a lot of debts are cancelled when you declare bankruptcy.  That being said, it
is incredibly stupid to try to cash a check at the same place you borrowed the money from. Frankly, you should have a bank account, but for some reason poor people love to use these payday loan/check cashing places.

Oh and another thing: nobody gives a s**t that you were about to take your kids (who you obviously cannot afford) for ice cream.

Run to an attorney!!!

I did remember getting a payday loan from them some years ago which i was not able to pay and had to file bankruptcy since  I had some financial problems.

If this prior debt to them was DISCHARGED in bankruptcy court, then you need to run to an attorney and SUE THEM IMMEDIATELY-the debt to them no longer exists.  There is no "right to offset" for any debt that is discharged in bankruptcy court-the debt has been absolved.

Gather up your bankruptcy paperwork and run to the nearest law offices of any attorney.  Your case is a slam dunk and any attorney will take up your case with little or no up front fees.  You will get your money back, plus some extra and it's easy fees for the attorney.  Do this quickly so that your attorney can subpoena their surveillance video before they destroy it!

Seriously?

You took a loan out from one of thesy shady cash advance places, then you ripped THEM off by not paying them, and expect them to cash checks for you without taking their money back?

Which what they did is questionable, I wouldn't call it a rip off. They are getting the money back from you that you ripped off from them. You might even be able to take them to court, depending on the contract you signed. If you did indeed declare bankruptcy, you should probably call the lawyer that did the bankruptcy for you and talk to them about this.

"I told her that it was not her check to convescate."

That's correct; but it was their check to confiscate. You ripped them off and then tried to cash a check at their location. Not your best idea.
