Please observe the present state of play Re a case No C6558/2013 with the VCAT in Melbourne Australia Against the shoddy shonky and unscrupulous businessman Innovation Square one man show Tjhin Franky pronounced as GIN by him over a favoured telephone hook-up arranged by the VCAT-Civil in Australia whilst discriminating against me unable cope with or handle the truth to meet with fairness.

Ref: C6558/2013 Self discriminated and humiliated whilst businessman JIN Favoured in Procedure & Judgement by the Victorian Civil & Admin Tribunal. The following are extracts of my most communications with VCAT-Civil in Melbourne Australia.

The businessman Tjhin Franky was allowed two postponements of the hearing in case No C6558/2013. I was discriminated against initially not being given a postponement to attend another court matter Re malicious Licence less driver’s damage to my motor vehicle in Dandenong Magistrates court in deliberately fixing the hearing date the very date I requested the VCAT-civil to avoid in a 2 week period. On further pleadings and seeking of media help Re the partisan, partiality shown to the defendant by the Vic-Police and the VCAT-Civil it was postponed apparently with collusion between them. The VCAT-Civil Member J Kefford with the help of the Registrar M Sotto over-ruled Senior member Barker and permitted a telephone hook-up at hearing and judging member R Buchanan acted as the defence council and dismissed the case to favour the respondent whilst trying hard to render greater favours for the Respondent. There were missing documentations and wastefully re-printed documents in two folios of about 4 to 5 inches thick. R Buchannan refused to examining the documents in a USB storage device that I presented and refused to grant an adjournment to the hearing acting with total partiality and favours’ to the Respondent that gives the impression that there is much waste and corruption within the VCAT- civil that need to be brought before the newly created Independent Broad based Commission against corruption in the State of Victoria. The hearing and judging member Buchanan did not trouble himself to call the Interstate transport company or the driver who made three attempts to deliver the item in question but all the time acted as if he had already a prior arrangement with the Responding Defendant selectively using his false assertions to buttress his favoured judgement to him with hardly any regard for the truth or fairness. When the Rip-off, complaint pertaining to the defendant was shown to the member hearing the case R. Buchanan; he ignored it and was determined to favour Jin that I have lost all confidence in VCAT-Civil along with experiences with other involvement at the VCAT from even earlier periods. The Australian media has a great role to play unless it too is failing the public only to serve other smaller and larger business and Govt establishments to the detriment of the ordinary man in the street in failing to investigate and expose the waste corruption within VCAT-Civil.

Please observe this thread of communications with the VCAT-Civil and note how wasteful, incompetent, dishonest and incapable of handing the truth and serving the Vic Public the VCAT-Civil is demonstrating and exposing itself when sending this email of not being able to handle attachment when member R Buchanan has displayed great partiality and utter disregard for the truth and fairness in dismissing the case on the 22nd of April 2014 with only one my sister’s only being a witness to this wasteful, corrupt partiality displayed by a Tax-payer funded institution in the state of Victoria n Australia. Will the IBAC and/or the media take note of this and initiate an inquiry to better serve the people of Victoria?

The massage chair iS Groove that was bought from Tjhin Franky for $4,238.00 was through a misleading, deceptive and deceitful conduct without proper warranty certificate and is detailed in the 3rd party report that I have had to return it spending $298.00 on transport plus $308.00 for the 3rd party report asked for by pay-Pal. These needs to be refunded due to your not being upfront and transparent in your dealings mostly concealing and lacking much information and voltage tolerances for or it to work stably in Melbourne. It does not have the C-Tick as well that I was to exposed to potential harm and injury. You don’t have any evidence of this massage chair having got clearance from Australian safety approval. I am not willing to risk my life and limb for your illegitimate non-Australian and specially for non-Melbourne voltages conforming product.

As already explained to you’ll at Pay_pal why this is not possible due to the nature of the cutting edge product and me not having my vehicle. What are you doing with seller what evidence are you asking them. Why is Pay_pal putting the entire burden on me when the seller with a 5 year warranty cannot help in the commissioning and testing?
Please refer this case to someone more experienced and senior as this is not a run of the mill ordinary case. The product and circumstances need a different approach like the founder of pay-pal had in starting up pay-pal and developing it thus far. You need someone with an innovative approach to handle this case as a run of the mill approach will tarnish Pay-Pal and encourage dodgey sellers and undermine the faith and trust people have in pay-pal.
Please go through all the evidence and documentation I have already submitted and asked the seller for cooperative approach even as they reduced a $200.00 for misleading and giving the false impression that a 3 or 5 year warranty gave free postage and handling on the iS Groove chair. They are trying to correcting it in large print on their website with detailed clarifications. If you take the correct approach all three parties can grow and evolve without a robotic yes or no that may help you’ll close the case early but do untold damage to all three parties when the media gets involved.

Thanks will await their response to this e-mail by e-mail so that Pay-Pal is across everything. InnovatioSquare said they would send me some spare fuses. Have they sent it? When will I receive it and is it safe to switch on iS Groove with the underframe tubes A and L not connected anywhere? Will it overload and cause the only fuse to blow or open-circuit? Can you send plugs for those tubes if needed or else are they also meant to be like that? What was the reasoning behind these modifications? Why they are not mentioned in the instructions manual. Why are you‘ll taking so long to respond with added money for the 5 year warranty. How can I trust you’ll to keep to warranty when you are neglecting in the assembly. Commissioning and testing stage with pay_pal dead line hanging like Damocles sword. How much do you pay Pay-pal for this transaction? Is that a reason for Pay-pal to hurry? Should all the other claimed functions work as in the instruction manual what price reduction are you willing to offer? Do you have anyone here to give you a report on this? If I am to get another massage chair seller who does not have this type of cutting edge product to give a report will you reimburse such costs? All this is in the light of the detailed e-mail with pix that I have sent a couple of hours ago with many pixes and explanations re-repeated.

Further to the previous email found below, I forgot to mention that I had to undo the two screws holding a three-ply wood plank on which the seat cushion is placed on to the underframe to gain access to the manufactures’ air-tubing design main label in pix 23 to release the underside air tubes J, K, B/I. I omitted another label of an actuator in pix No 21, that may help estimate the date of manufacture that most other equipment have but not this so-called latest and cutting edge iS groove.

Your cut-off date for this dispute is is very unfair and favouring the seller and yourself to my detriment and loss in the light of the following facts.
This iS Groove massage chair from InnovatioSquare as their name itself suggests is cutting edge, latest and most expensive with air-tubes etc as per URL .innovationsquare.com.au/product/Massage-Chair/iS-Groove-Massage-Chair-Blue.php?page=specification#axtrainfo and most expensive in the field of massage chairs only available with them. I doubt there being anyone in Melbourne qualified to comment or report on it and had it been available here I would have purchased it in Melbourne. If they or pay-pal can suggest anyone I will ask them to come and inspect report.
I am without transport for the whole of this week as my vehicle is undergoing some heavy repairs. Please speak to Marcello Pizzirusso on 03 9543 7777 of B&A motor Body repairs if you doubt my veracity.
Other than all the shortcoming and errors of omission and commission in regard to labelling and assembly that I have pointed out to you’ll with pixes 1 to 22. I will resend some of the highlights with this email. My latest finding is that major modifications have been done to the seat cushion by innovation square staff to the air-tubing not intended by the manufacturers. The most recent pixes numbered 23 and 24 will attest to this. Pix No 23 gives the details air-tubing as the manufacturer intended as follows B,D,C for left side, A,L for Right side, in for the back-rest E,F,H,N and for the under seat cushion E, F, H, N.
Only the Right and left hand side are as the manufacturer intended. The rest have all been modified and changed and not mentioned in the iS Groove Instruction manual sent with it. The “in” back-rest is fitted as M and N as in pix 24 in the same pix you can observe that the seat cushion has only 3 I.J,K/B instead of the manufacturers intended four I,J,K,M. E, F.and H are not to be seen anywhere physically but there is a repeat labelling of A and L in the underside with nowhere to be connected. Will it affect the functioning if I were to power it and try it out in this state? Please ask InnovatioSquare to let me know at their earliest lest something go wrong and they blame for their misleading warranty advertisement and lack of ongoing support to assemble something they have changed and modified without any explanations in the manual.
Information Square staff say they are investigating my complaint and it is unfair by them too for you to want close this early when I am being used as a guinea pig and experimented upon whilst $4,238.00 AUD is locked with them I am sweating it out with great back-pain.
Please show some mercy and consideration to my plight as I now really believe that I have been foolish to make this purchase and I am trying to make the best of a bad bargain with pay_pal and InnovatioSquare help should this work the way they claim it would work in the instruction manual I am willing to keep it at a much a much reduced cost for all the pain and suffering that is being inflicted on me.

Here are two more pix Numbers 19 and 20 of the same RH arm-rest and underframe showing that labelling is missing on an air-tube on the connections as there were only 2 tubes involved here, I connected the unlabelled tube to the other but in the case of the seat and under frame the labelling is quite different not having the same letters on either side as detailed below. Hence there are errors no-labels, double labels and mislabelling. Hence how can anyone believe the claim by InnovatioSquare that this massage chair was connected and tested before sending it to me they are full of misleading and false claims as already pointed out in my earlier detailed correspondences Re the warranty and free Postage and handling claim which they have not really corrected in fairness despite reassuring so and I am unable to connect and test if all the claimed functions are working properly? Who knows what other functional claims are missing or absent until I am able connect up properly and test all claims Re functionality of this iS Groove massage chair.

Pay-Pal please give us more time in the light of these difficulties that I am encountering with Franky and the InnovatioSquare customer service.

I have still not got to cleaning it but I have had much trouble due to lack of proper assembly, labelling and installation instructions that when the pin holding the foot-rest to the under frame slipped and sprung out and logged itself in some crevice in the underframe. I took pix number 14 where two washers were stuck magnetically on the body of the Derrock Linear Actuator as it has left your assembly and testing place. These lose washers could drop off and cause shorting other probs which indicates poor quality of assembly and testing workmanship even as I sent you a picture of washer being fitted wrongly in the connection of the foot rest to the underframe. This was corrected with much time and effort with a friend of mine yesterday with my neck and back still aching.
Pixes Numbered 15 to 18 were taken obtain confirmation and advice from you in the connection as it’s not given in the instruction and installation manual. These pix will show you that I will be connecting air-tubes M and N to the respectively R and L hand sides of the unmarked back-rest plugs.
The two tubes labelled A and L in the underframe are not show where they are to be connected though on seat there are tubes marked J, K and B and I on the same tube numbering a total of 3. That leaves one tube without anywhere to connect. Do J, K and B/I go to A and L? Is one of one of them spare and if so which one? If so Which of J, K, B/I go to A or L from the underframe?
InnovatioSquare is causing me unnecessary pain and suffering due misjudgements and errors omissions and commissions.

Once we again we re-iterate that ALL the chairs that we sell are brand new.
ALL the chairs have been tested in the factory, meaning it would've been assembled, tested, and dis-assembled.
Once it gets to our Sydney warehouse, we leave it UNOPENED.
If a customer sends back a chair, we sell these off elsewhere as a used item. We don't re-pack and re-sell as brand new.
The marking you shown on picture 7 exists in ALL our iS Groove chair. It's a normal tooling mark (parting line).
Once you assemble everything none of the marking should be visible, as they're all inside covered by the leathers.
In regards to the marks left by the Quality inspector, you can use any leather cleaner and these marks should disappear.
Let us know if for whatever reason you can't get the marks off.

This is a chair that someone has used and returned within the 7day trial period. There are other marks of touch and pasting on the RHS of the underframe. I will take those pix of them and all when I am able assemble it with the help of a friend who has agreed to come on Thursday.

Please be rest assured that all our products on our website are all brand new.
You will have noticed that some bolts have been placed in their respective spot because we test every single one of chairs down at the factory prior to packing it and getting it delivered.
This is to ensure that you receive a fully functional chair.
We do not sell touched up / re-conditioned chair, as should be evident from the leather.
I have sent these photos across to the technicians for them to analyse.
At the same time we will also be organising the spare sets of bolts for you.
Also, when you finish assembling the chair, the arm rest and the whole chair (most bits) should be covered in the leather parts, which should look beautiful and flawless, hiding all the internal parts.

3rd Close-up of unassembled Left leg and foot side to the underframe.
4th Overall Pix of both left and right sides of underframe as unpacked from cardboard box.
5th Please the upper part of this pix at the damage on the right hand side of underframe.
6th Further damage on pix 5 more to the back of the damage on right side of underframe.
7th. more damage on the right leg and foot rest side.
8th Left side unassembled washer that I placed but not fitted to show that there is no gap between the underside frame and the washer when placed with the correct side facing the frame.
9th. Right side assembled I placed a small yellow handled screw driver to show that there is a gap between the underside frame and the washer when placed incorrectly with the wrong side facing the frame.
10th Same as pix 9 but a more close-up view.
11th Same as pix 8 but a more close-up view.
12th Same as pix 4 but a more close-up view.
When these two card boxes have travelled by road all the way from Sydney with only one side of the leg and foot rest assembled and the other dangling all the way; this would have caused much stress and strain on the Right leg and foot side taking the full weight, that should have shared equally by each side that the small bolt may or will break when I start using the chair with the washer too wrongly placed causing additional looseness and vibrations. Hence send me a spare set of bolts for this part of the assembly along with the fuses.
I am also beginning to wonder if I should assemble the chair on the ground floor and test it and then disassemble it and take it to the 1st floor only if it works properly if not I will have the extra trouble of bringing it back to the ground floor to return it to you’ll. What do you suggest? Am I being experimented upon?

If we included the technician's cost in the price, we will have to increase the chair's price.
Most of our customers understand and they don't mind installing the chair themselves.

A. Spare fuse is never sent. If the fuse for whatever reasons popped, we can send you a spare one.
The spec for the fuse of transformer is 10A 250V; Fuse of PCB is 6.3A 250V,Fuse of power input area is 5A 250V
Please send me some spare fuse.

Is this another way of making more money and creating employment your company folk? I can copy what you'll have done on the RHS and likewise to the LHS but this should not have been so; is it neglect or deliberate? you'll need to lift your game despite it being already quite good and easy understand manual. You'll are very good but there is better and best practice to go by to strive for excellance.

We don't make a lot from our chairs, so if we start offering free postage and handling on the chairs we'll become a charity.

Are you too not doing something similar if not the very same thing to me only here it’s a much smaller amount, is it not?

Tjhin Franky and his mercenary reputation damaging IT cohort masquerading with false names like Rakesh Sahi and Deep Kumar, Contact: 9878673913 appearing on Facebook as https://www.facebook.com/search/top/?q=deep%20kumar Deep Rana Bilaspuria claiming to be on Facebook as a Team Leader SEO at Him Tech Pvt Ltd., SEO Executive at WEB Setters and Sr. Seo Executive at GnM Alliance Lives in Ottawa, Ontario.

I wish to reiterate in this renewed update without having had any responses to my previous rebuttals that these are utterly fake, false and fraudulent erroneously self-perceived revenge report by Tjhin Franky due to his lack of maturity and hubris due to the high level Chinese business connections, money, influence and power that he wielded even in the Victorian Civil and Administrative Tribunal as previously detailed in this thread of approximately 19,500 words that mysteriously disappeared and reappeared after I brought it to the notice of Ed Magedson. Rip-off website has demonstrated partisan interest in misrepresenting and deceiving me from the removal of report no # 1142794 of 27th April 2014 by sending me a fake URL without it an actual presence in the Rip-off website.

The report number #1142794 filed against me on 20th March 2017 is a fake, false and fraudulent revenge report filed under a false name taking my profile pix and bio-data from Facebook and LinkedIN and fabricating falsehoods and distorting the truth at the instigation of one Tjkin Franky of the company named Innovation Square. 3. Now that the demurrage costs on the returned item has approached the cost of it as per "info@interstate.com.au" info@interstate.com.au. Tjhin Franky has resorted to perpetuate this ongoing falsehoods and fraudulent claims and fake and false names having managed to remove or relegate it from a Google search appearing at the top as he has succeeded in machining it for me through the false report based on information’s and profile pix of me from websites of Facebook and LinkedIn. Mal Spencer then offered me some leading cutting edge technology that he can procure at a cost of $20,000. The catch is, he wants it upfront. Mahulchandran Chelvaraj Spencer claims to be a grandfather, claims to be an earnest hard worker who never cheated anyone in his life. Well Mahulchandran Chelvaraj Spencer, GIVE ME BACK MY $20,000 YOU LYING PIECE OF SCUM! Mahulchandran Chelvaraj Spencer is a Liar, and a stalker too. When I started voicing my concerns about the goods I purchased he started making threats, stalking me online and offline, and even asked for more money! Mahulchandran Chelvaraj Spencer, I hope karma hits you back real hard."

Over to you Mr. Founder; are you going to keep on censoring inconvenient and embarrassing truths about your website for it to be published by other websites? Update On Tjhin Franky's Attempted Blacmail & Extortion.

Please link this as an update as of 29th May 2015, on the current situation as part and parcel of another counter-rebuttal in the ongoing thread of communications to the original complaint against Tjhin Franky by one John McAlister from Perth, in the Ripoff website whom I tried to help with my experiences with Tjhin Franky (TF).

TF has not only persisted with dishonest and defamatory false accusations and claims. But has been emboldened by the oral order made by Mr Robert Buchanan (not wanting to implicate his misconduct by giving any reason as it should be) of the Victorian Civil & Administrative Tribunal (VCAT) case Ref C6558/2013 on 22nd April 2014 after many deliberate frustrations, manipulations and manoeuvrings to the process and procedures to favour TF by removing the evidence (even as VCAT has done before in my case against Telstra in 2000) of the invoices for the technical report and return of the merchandise to TF from the case file and thereafter refusing to view what was submitted by me in person on the this same day and time which I had brought as an additional back-up in a USB drive electronic storage media. All this took place in the hearing room without the presence of any other VCAT staff to help and condone the misconduct by the VCAT of the member Robert Buchanan.
By the above and other mean and low actions explained in previous communications with the VCAT; Tjhin Franky was embolden to gamble further and collude with the Legal Practitioner (LP) Mark Stanerawick to send me an illegal letter of attempted intimidation, blackmail and extortion for the sum of $200.00.00 with the subject heading as “Legal Letter”

Having complained to the Legal Services Commissioner, the Australian Federal Police and the Ombudsman for the state of Victoria in Australia; my most recent response to them regarding the illegal, intimidatory misconduct of Tjhin Franky and his LP Mark Stanerawick is copied below with attachments of previous commutations in this regard. From which it may discerned that Justice System in this state is trying to defend, protect and shield these errant businessmen with little regard for the first and primary fundamental principle of seeking the truth to dispense fairness and justice.

Is it now not more disconcerting and painful to know that you persist in erring as in the above quote with not only being fact-resistant but being an added law-resistant human as well in having applied the LEGAL PROFESSION ACT 2004 - SECT 4.2.10 Summary dismissal of complaints. Are you not further trying to maintain your erroneous and fallacious position already taken with ongoing abuse and misuse of your power and authority in misapplying the facts and law quite like the apparently influential Legal Practitioner (LP) Mark Stanarevic (MS)?

2. Why are you not being selective in your in your response of the 21st of May 2015 in not responding to all my queries and doubts in many sub-questions under each of the six numbered paragraphs in my previous response to you?

3. Why have you broken the thread of the e-mail correspondence and got Ms Tina Stagliano to sign this e-mail for you with a superfluous PDF document when I had already scanned and attached in the previous e-mail?

4. Does it not indicate that you have some moral and/or legal compunction to what you have stated as well as ignored in having to sign misleading, untruths claiming lack of power and authority when its contravening and violating the LSC+B Corporate Values of Impartiality, Integrity, Accountability, and Human rights & Leadership?

Even in the NSW defamation laws there is provided for request the publisher for more information and correcting the alleged defamatory publication etc within a stipulated time period. Is not the LP, MS’ dishonestly absence of integrity and ability in misusing the NSW Defamation laws meant for a publisher that I am not?

In your response why are you missing or ignoring the woods or the forest for a tree or two in dealing with the LP MS’s abruptness over the telephone, which is the least of an issue whilst trying to cover your nakedness with this fig leaf when compared to the larger matter of the intimidatory and fallacious claims without any evidence in MS trying to blackmail and extort $200.00.00 from me in misusing and abusing the invalid non-applicable interstate laws that is a serious criminal offence in the large amount of money demanded?

Having perused the LSC+B most recent report which is quite a profitable business in its own right with a sprinkling of non-lawyers but without any ASIC presence as thus confirmed:- “Name: LEGAL SERVICES COMMISSIONER ABN: Status: Not Registered-Organisations Of Type 'Nonc','Nret' Type: Non Registered Entity (Nret) Locality of registered office: Regulator: Australian Securities & Investments Commission Information for purchase No information for purchase found Documents No documents found” In the light of the above; How is an ordinary person or a member of the media to verify the authenticity, accuracy, honesty, integrity and abilities’ of what goes on within the LSC+B?

Please also let me know as to who audits and/or checks the veracity, accuracy and credibility of the claims made in your Report_Legal_Services_Board_and_Commissioner_annual_report_2014; which also been signed by you as the Acting CEO of the LSB and also as the Legal Services Commissioner regarding other matters regarding performance statistics, efficiencies and finances as it would be having an inherent business class conflict of interests in preference to a reform needing victims like me?

Thus based on the above renewed submissions and the contents of the above mentioned US based independent worldwide RipOffreport website would you please reconsider your decision and also make me part reparation from the fidelity fund for the unethical, illegitimate and illegal $200.000.00 money demanded from me; based on the practice certificate that he is operating under the LSC+B. As well as for all the ongoing waste of my time, pain of mind, humiliation and mental sufferings that I am being subjected to not only by MS and his client TF but also by the LSC+B which is trying to further humiliate, intimidate and victimise me the for the past two months that its having an adverse effect on my health and well being.

Is it not absurd and a travesty for and of truth, fairness and justice for you to ask me to appeal to Victorian Ombudsman (VO) whilst at the same time stating that the VO’s office has no authority to change your decision but to merely to re-examine your decision? Why should you wait for the VO to ask you to do it ignoring all my above and previous rational and reasonable questions which you have ignored but the need desperate need to answer them honestly and truthfully will remain for all time?

And there are a great many people who don’t tell the truth when they are in power in administrative positions.” The final big question is would you, the Vic Ombudsman and all others reading this be amongst the “great many people” mentioned in this quote?

The above is mostly if not mere cant and “tall Talk” whereas as the reality of my experience with Tjhin Franky over the past nearly two years has been most disappointing and horrendous waste of time. money and energy as I was duped by his colourful and misleading terms and conditions on his then website that he did not live up to and some he even changed for his advantage disadvantaging me during and over the purchase of a massage chair in June 2013. With some difficulty I got PayPal to refund the cost of this item but when I tried to recover the return transport costs and technical report costs through the VCAT, I met with much resistance; unfairness due to VCAT’s either subservience to his influence or may have even been some form corruption of certain members from late 2013 to-date.

I state the above despite VCAT’s rejection of his counter claim for the cost of item that that was refunded by PayPal and he has refused to accept thrice from the Interstate Transport company and he even changed his business and store address during this ongoing saga that the transport company has stated it have sell the item to recover demurrage costs.

He has brazenly lied to the VCAT and made many false the claims and defamatory remarks against me on the Ripoff.Com website and he is now in the process of trying to blackmail and extort money from me through his lawyer .Mark Stanarevic of MS Lawyers. Update:

Thanks for inserting the attempted blackmail and extortion at the top of the reports regarding the conduct of Tjhin Franky and his lawyer Mark Stanarevic along with my other rebuttals. Please insert this most recent 6th April 2015 rebuttal of mine hopefully the last after TJ’s false claims without supportive evidence unlike what I have submitted to Ripoff of my case being thrown out etc by misleading, distorting and falsifying the facts of this case in a similar manner to the product he tried to sell me was vindicated by PayPal returning only the costs of the cost of the item to me.

 

TJ did wield much influence at the VCAT that I had to remind some of the conspiratorial, dishonest and corrupt members of the two primary issues at stake in my application were TJ's refund of transport and technical report costs. These invoices were removed from the case file by some VCAT members even as it was done once before in a case against Telstra Corp that it was not made available in the two 2 inch thick folders that a partisan and corrupt member Robert Buchanan declined orally, with only a sister of mine as witness to this hearing where TJ was allowed telephone hook-up after many postponements in violation of VCAT procedure and countermanding a previous senior member of the VCAT disallowing it to be heard over a telephone hook-up.

 

The VCAT member Robert Buchanan not wanting to commit untruth and falsehood to writing has stated merely stated “The proceeding is dismissed for reasons given orally at the hearing”. I have already submitted a copy of this immoral and illegal order as supportive evidence that TF has not done to-date.

Further the VCAT hearing application fees were wrongfully twice deducted from my debit card without my approval for the 2nd time as I had reduced my compensation claimed to come within the original application cost. Yet the VCAT out greed to grab more money did, which even an ordinary internet trader would not do.

Thus VCAT morally and legally disqualified itself from being honestly able to adjudicate and give an unbiased quality decision when the quality of the member Robert Buchannan lacked the honesty, integrity and ability to give a fair decision after removing the invoice documents from the case file and refused see or read the back-up e-copy that I offered him on 22nd April 2014 mainly to disadvantage me the applicant and favour TJ the defendant.

It was the above that prompted me to help a fellow human in strife like one Mr John McAlister but the consequent false, misleading and defamatory claims made against me by TJ necessitated going in at depth and detail for TJ understand where he erred as well as well as to help other potential consumers in preventing them from similar strife with him.

As I am also a man for others as much as for myself and having lived almost 71 years on this Earth, being a non-smoker, teetotaller, celibate disciplined life by choice, circumstances and cultural upbringing; in my usual public spirited manner as most of my interactions from my youth have been was to try and help Mr John McAlister recover his money from TF. Though now in hindsight observing the high-level of influence he has wielded with the VCAT, I do really suspect that it is most likely that TF may have himself or obtained the help from his contacts and used the name of John McAlister to promote his business and gain an enhanced commercial inter/multi-national profile for himself even as he calls his business with a grandiloquent, high sounding and misleading name of “innovation square” where he simply forwards his goods from China without inspection which would have saved much of our time, money and energy from this ongoing “Rip-off” modus Vivendi now with now you as well in the fray.

 

  1. It may also have been in TJ’s more lucrative game plan to use lawyers like who are lacking in honesty, integrity, ability and responsibility. If you are as public spirited as the likes of me and those operating the Rip-off website; then please return TF’s money and send him the letter you have sent me with the relevant changes and further expose him for what he really is and save other unsuspecting customers. An apology too from the two of you along with some form of compensation and redemptive work for consuming much of my time in responding to this would be in order for all the ongoing turmoil that you’ll are causing to my aggrieved health and life.  If not I will have to consider the suing the two of you under the most appropriate law and court with you Mr Mark Stanarevic as a co-respondent for all the pain of mind, sufferings due  fundamentally to his conceit, hubris and personal greed.

TJ on the rip-off website has heaped a whole series of untruths and falsehoods about me without any evidence contrary to what I have done and informed him on that website that I may have to sue him defamation. The decisions for PayPal refund the money along with Google and Rip-off publishing my experiences with TJ were based on truthful corroborations of the evidentiary materials and documents that were submitted. TJ still owes me for the return transport costs in terms of initial terms and conditions which he avoided by not answering his only mobile phone then he also still owes me for the technical report costs that he has circumvented by using influence with the VCAT that I had to appeal to the AG, Justice and quality minister where they are in process trying to make changes to enable an aggrieved complainant to empower him to complain against a VCAT officer independent of the VCAT’s internally flawed and influence rand dishonesty ridden self investigation system.

The above is a very relevant and important extract in part from the CONCLUSION of Mr L.J.King’s article on The Attorney-General, Politics and the Judiciary to substantiate my concerns regarding the proper role of the Dept of Justice, the AG and Courts and Tribunals.
Please note the above and with reference to your response dated 25 Nov 2014, bearing ref CD/14/490388 as from the deputy secretary responsible for civil justice. In the light of what have quoted and stated above does not a question arise as to whether or not the cause and course of justice in the state of Victoria is being thwarted and countermanded by the bureaucracy of the Victorian Dept of Justice as your response both in letter and spirit is in way not different to and quite similar to that of the VCAT hierarchical where some staff members of the VCAT give the impression of covering-up, protecting and shielding the errant member Mr Robert Buchanan’s conduct in the hearing and order made to my application Number C6558/2013. Having insisted for the complaint to be on a prescribed form in sham, shamanistic and ritualistic application to be witnessed by someone who knows nothing about the antecedents of my grievances’ and the most recent application with the VCAT.
Is he not conducting himself without any regard to his responsibility to uphold honesty, integrity and fairness in the discharge of duties held with remunerations paid for by the Victorian taxpayers’? This so-called VCAT is performing even below the efficiency and integrity of the and lagging even behind the Financial Ombudsman Service where one could lodge a complaint on line without the hoops and hurdles crafted for some of its members self interest, survival and thrival at the tax payers’ expense. Their mode of operations lacks in competence, fairness and justice being metered out and is far behind and sometimes nowhere near that of the popular TV justice programmes like “Judge Judy” and “The Peoples’ court” we observe and study so frequently. Is it fair, just and conscionable for you as the deputy secretary of civil justice to turn a blind eye and be indifferent to the unjust orders made by some members of the VCAT sometimes even countermanding other VCAT senior members? Should there not be an ongoing need for reform, improvement, reformations and a seeking and thirst and quest for excellence within and without the VCAT in reality and not in pompous platitudes as in this show piece document presented as a facade at 3 year intervals?
Further there was quite an absurd and silly situation where in VCAT Ref: G14/2008, I was named and treated as the applicant against the “Department of Justice of the state of Victoria in a traffic camera reliability matter. The Dept of Justice should in reality be functioning as umpire and adjudicator regarding complaints against courts and tribunals and not be functioning as a partisan adverbial litigant. The above citation bears out my contention and would plead with you to reconsider your actual and truer role in serving the public of Victoria above the apparent mateship considerations and the apparently false and pseudo-independence of the VCAT from the Dept of justice to consider it itself beyond the law and act as law unto itself assuming to be free of the Dept of Justice.
The AG being the first law officer of this state is most certainly responsible for the state's courts and tribunals. Please don’t let negligence and the misinterpretation of the law, facts, lethargy and apartheid like indifference stand in the way of serving the people of this state. Further your hubris is showing in your stating that “this Dept will not enter into further correspondence on this subject”. When phoned the AG’s office Danielle to clarify some matters and request for your email address I was asked to call your office directly and in doing so your staffer Kathy’s was unable or unwilling to provide your email address but took down my email address. She too seems to be covering-up for you apparently once again out of mateship considerations seems to be trying help you in filtering me in your reluctance by your own statement above and capacity and for handling and/or facing to the truth in fulfilling your duties and responsibilities that this too necessitates my copying this some media outlets.

This customer by the name of Mahulchandran or Mal c Spencer have been abusing all our staff since day one using ridiculous excuses.

Mahulchandran or Mal c Spencer abused not just us, he abused PayPal customer service, he abused the courier guys, and he emailed us hundreds of emails including a lot of respectable professors and doctors.

Going back to Mahulchandran or Mal c Spencer's issue, he even got a 3rd party independent report confirming there is NOTHING wrong with the item that was purchased.

On the hearing date, Victorian Civil and Administrative Tribuna (VCAT) went through Spencer's evidence thoroughly and within minutes they dismissed Spencer's claim.

The tribunal members all unanimously agree that Innovation Square has done nothing wrong, and is a respectable business.

Since then, Spencer have been abusing not just innovation square members, but now the VCAT team as well.

Please observe through this response of Tjhin Franky (TF) to the Rip-off website http://www.ripoffreport.com/r/Tjhin-Franky-Innovation-Square-Sydney/Sydney-Select-StateProvince-2765/Tjhin-Franky-Innovation-Square-Sydney-Tjhin-Franky-Unit-2-59-61-Edward-Street-Riversto-1142794 how he is exploiting to his advantage the negligence, lack of adherence to the truth, fairness or justice and diligence and the specially favored treatment rendered to him by some members and senior members (SM) such as Robert Buchanan (RB) of the VCAT where ordinary members have issued orders countermanding senior members to favour the defendant TF amongst other matters in even allowing him an audio presence where he was only called upon to pronounce his name by SM Robert Buchanan to create some sort of a false impression that TF was not known previously to RB though he could have dealt with him through a friend or a friend of a friend at the VCAT. As per attachments already forwarded to VCAT- Civil the VCAT rules, regulations and guide lines state that in the absence of the defendant the application should automatically be decided in favour of the applicant.

The SM that RB ignored me my many pleas and requests and did not want to see the evidentiary proof that I gave him on a data storage device along with about six pages of my most recent submissions to the VCAT on this application as these relevant and pertinent material had been removed from the case file similar to what happened in my matter against Telstra in the 2000 to 2005 year periods but contained many superfluous and repeat documentations regarding electrical matters of the item in question from the defendant that were irrelevant the application ref No C6558/2013 which was only for the costs of my having returned the item in question and the cost of the technical report as Pay-Pal had already adjudicated returned to me the cost of item in question. The defendant TF and SM RB were covertly and overtly trying to undermine the PayPal verdict and tried crookedly exploit this application of mine to their advantage with the help of some corrupt members and senior members at the VCAT.

The SM RB did try repeatedly to go beyond the ambit of my application and tried very much to favour the defendant TF that I had to repeatedly both in writing and repeated oral submission remind him as to the real limited purpose of my application and his unfair and unjust attempts to go outside the mandate of the VCAT-Civil and my application before him. Further this hearing was conducted without the presence of any other person from the VCAT other than the SM RB which was also another violation and disregard for their other irregularities’ of VCAT violating its own rules, regulations and hearing guide-lines of this matter as I have repeatedly enumerated and detailed in my previous communications to the VCAT.

4. Please note that TF, RB and the VCAT cannot continue to deceive people like “”frogs in a well” in this age of the internet when they will be scrutinized by people at large through the World wide Web that it is high time the ministry of justice and VCAT awoke to their repeated follies in continuing to ignore the many pleas that have made to date where I the victim am being further victimized whilst the wrong-doer TF has already been adjudicated by PayPal that he was in the wrong that it refunded the cost of the item though VCAT and some of its staff seem to have a peculiar justice system to favour people with contacts and connections and who may know if they be even corrupt enough to be on the take that the VCAT that has an inherent conflict of interests does not seem to report anywhere its own findings of its internal inquires hiding behind privacy and secrecy to shield its own apparent corrupt members that it has not found fit to respond to my concerns for three weeks. 1. I am not asking for any private and/or privacy related information regarding complaints and actions taken with regard to particular member or senior member of the VCAT by name. The reason for my asking this is that I need to know if it’s worth my while of making a complaint primarily regarding SM Robert Buchan’s conduct though many other too are involved if you were to go through the many postponements, rejections and rescheduling and hearings in violations of VCAT process and procedures to favour a defendant from Sydney to talk the least over an audio connection with Mr. R Buchan acting as his counsel and not wanting to even see the evidences resubmitted at the hearing whilst the case file contained superfluous and wasteful reprinted documents over and over again etc. It is here that I observe another absurdity to make a complaint against each of them when they are all intrinsically bound by the same application Ref No ref C6558/2013.

The absurd, incongruous and filibustering- time wasting requirement is for me to obtain an affidavit when the person who signs for me knows nothing about the complaint other than to attest my signature. It took me almost a year at the Financial Ombudsman Services over a motor vehicle accident claim where everything was done via the World Wide Web through the internet without any affidavit or other procrastinating and devious methods and procedures.

4. If as you are trying allude that such general information too Re VCAT internal complaint matters are not available at all to the public then the whole process seems to be a sham and a farce with inherent conflicts of interests amongst all VCAT staff to shield and protect each other whilst getting us to waste our time and effort at best as a sort of psychiatric couch for us to vent our feelings and for you’ll to do nothing about it that, I would save my time and VCAT charade of inquiring into its own staff conduct secretively and not being transparent or open to the general public of Victoria. The VCAT betterment plan should run concurrently and wait for 2014 to 2017 end of period and here I am affording you a golden opportunity to put into practice the intended betterment pan for the VCAT starting with this godsend opportunity and chance should the VCAT betterment plan was not to be a mere theory in the clouds and meant to be really practiced then this the moment to commence the change and if not supply and point me to the very general information’s requested for.

2nd Rebuttal of TF's Dishonest & False Claims.

Please note the following responses to TF point by point and it would be better appreciated if Rip-off would make all my attachments too available to this rebuttal of the 9th of Nov 2014. TF is also falsely insinuating that I am also the other original complainant Mr c John McAlister, from Perth as it was seeing his complaint that made me respond in this manner to help him. Had only TF abided by his original terms and conditions none of this would have to transpire wasting much time and effort of many people and I suspect that after all this TF would need to change his name and/or his company name to continue with his dishonest antics to fleece more unsuspecting customers as neither he nor his assistant would name one customer for me to talk to prior to trying renegotiate even after PayPal endorsed returning. Should TF not withdraw or apologise for all these misdeeds, I will be forced to take him to a higher court on charges of deformation.

 

1.This customer by the name of Mahulchandran or Mal c Spencer have been abusing all our staff since day one using ridiculous excuses.

I am not really a customer of TF as he refers to as I have not bought anything from TF rather a much disappointed, angry and frustrated at the amount of time and effort wasted. I being a onetime purchaser of only an item which had to be returned based on an independent technical report as well as due to TF’s misleading and untrustworthy claims that Pay-Pal found it proper for me to return the purchase but despite Pay-pals fairness I went out of the way and tried hard to accommodate TF and work-out something with TF but his never ending incompetence, hubris and arrogance of never ever speaking to me over the telephone and only twice his one only assistant or help-mate calling himself as John responded stating that TF had gone to China. Part of or if not most of the correspondences that Rip-off has made available on this speak for themselves as whether they are really ridiculous excuses as TF would like to label it.

 2.Mahulchandran or Mal c Spencer abused not just us, he abused PayPal customer service, he abused the courier guys, and he emailed us hundreds of emails including a lot of respectable professors and doctors.

The above is sample of his untrustworthy, misleading dishonest and bombastic false claims to prejudice people against me and will Rip-off please ask him substantiate with evidence. Yet this apparently hearsay claim also indicates that he has some informal and back-door exaggerated and falsified information given to him by some unscrupulous staff at the Victorian Civil & Administrative Tribunal who are aware of my struggles for truth, fairness & justice that have been frustrated by the adversarial system of justice that initially crafted for the robber barons of England in the 11th century. 3. Going back to Mahulchandran or Mal c Spencer's issue, he even got a 3rd party independent report confirming there is NOTHING wrong with the item that was purchased.

The above is yet another dishonest and false claim that exposes the lack of his intelligence, honesty, integrity and ability of TF trying to claim that even PayPal are fools compared to his bloated intelligence when in reality all these are the consequence of him being driven by his baser and not the nobler instincts.

4. On the hearing date, Victorian Civil and Administrative Tribunal (VCAT) went through Spencer's evidence thoroughly and within minutes they dismissed Spencer's claim.

5. The tribunal members all unanimously agree that Innovation Square has done nothing wrong, and is a respectable business.

6. Since then, Spencer have been abusing not just innovation square members, but now the VCAT team as well.

 

The above three assertions too are yet more  dishonest and false claim of TF, as  when I filed this application in October 2013 to recover from him the technical report and return transport costs that would have been lesser had he kept to his terms and conditions. After many postponements and manipulations by TF with either influence from the business class and/or money/goods  On 22nd April 2014 a partisan and partial and apparently corrupt member one Robert Buchanan (RB) refused to see the receipts I gave him in a message stick as the VCAT had removed them it from  my application case file No C85578/2013 that comprised of two, two inch thick files with many superfluous duplicates and triplicates of TFs product literature along with procedural unfairness and violations of VCAT’s own rules and guide lines TF was given favoured and special treatment and allowed an audio connection for RB to only ask him to pronounce his name as JIN and acted as his counsel and tried to go outside of the mandate of my application that he had to be reminded repeatedly as to what this application was really about. RB even foolishly tried override PayPal such is the state of justice in this state. An appeal is pending with the Vic AG’s office and the Minister of Justice for Victoria as the VCAT too has corrupt practices to inquire into the corrupt practices of its members and staff and not report it anywhere even statistically and are shielding themselves secrecy and privacy for their own staff survival and thrival at the Victorian tax-payers’ expense.

7. Pointing out the truth and exposing unfairness and injustice like this Rip-off website is not abuse instead it’s a great service to mankind to name, shame, expose humbugs and evil villains who are ever willing to make a fast buck at the expense of the unsuspecting and trusting public that needs to constantly re-educated by all and sundry at all time like what rip-off is doing is what I have been doing from my 17th year to my present 70th year and to-date and go on to do until my last breath..

8. Should TF not withdraw or apologise for all these falsehoods, misdeeds and character assassinations, I will be forced to take him to a higher court on charges of deformation.

RE:- the above sent yesterday with three attachments, I am not sure if all three meaning the Technical report Tax invoice from one  Alfio Tomaselli of O Relax for the return transport costs to TF , Tax invoice for the independent report the basis on which PayPal refunded only the total amount paid to Tjhin Franky who is really a one man show at best and another to help at worst is in reality masquerading as a big establishment with a showy website with misleading and false claims in his rebuttal and the tax invoice from interstate transport the company that was used to return to return but is accruing demurrage as confirmed by Sam of Interstate Transport due to TF refusing delivery on about 3 occasions as per Interstate Transport company responses that I have already forwarded to the VCAT and you’ll. All these three items did not show up on the attachments only the last to be attached that showed. Rip-off needs to look into this to show all attachments. Here is another attachment from the Attorney General’s Dept of Victoria which indirectly admits that all is not well with VCAT and that they trying improve it.
