I found a 2000 Ford Explorer for sale on Craig's List, it looked pretty descent in the pictures, so I went to see it in person on Tuesday, September 4th, 2012. When I got there it was just as good in person, looks wise anyhow, and I was excited to be buying a newer car, so I neglected a few very important things.

I was approached by the salesman James, and I said I was interested in the vehicle, at first he tells me a totally higher price for the truck than the add which stated $1550, he states oh, they must have changed it to a special price for the add, unfortunately I should have realized that was the first RED flag. He attempted to start it for me, but the battery was dead, and again I was excited and loved the fact that the interior was pretty descent for a truck with a little over 205,000 miles on it.

The mileage did not seem so high to me since I deal in auto parts and sell to taxi cabs in the 5 boroughs that have higher mileage, some close to 500k. I put  $1900 down on the truck and say I will pick it up on the weekend and pay the balance, I ask James to get the plates and the inspection taken care of, on that Friday, I fax them the insurance card and the next day,Saturday, after work I go out to pick it up. 

The truck is out front parked on the street and I go inside to pay the balance, the complete total was $2221.00 and get my keys. I get in the truck and that is when it goes down hill, I start the truck, there is a ticking sound coming from the exhaust, RED flag # 2, I also now notice the ABS light is lit in the dash, I step on the brake pedal, to the floor it goes, RED flag # 3. I go back to the front of the lot where the gentleman, Rick I think his name was, not sure, anyhow, I state that we have a serious problem, the exhaust is leaking, and the truck has no brakes.

I don't take delivery of the vehicle, because I am not dumb enough to try and drive back to the Bronx from Brooklyn without any brakes. I tell Rick, I am leaving the truck and I will call james on Monday. I get home, and decide to do a search on the car dealer, and I find the other article about the same dealer, the same salesmen, and unfortunately, yep, my truck that I own on paper.

I am not a happy camper right now after reading the other complaint, so I unfortunately can not call James back until Tuesday, I tell him I don't want the truck, that it was not inspected legally, and I want my money back, of course he tells me he has to speak to his boss and he reminds me that the truck is now in my name, and I confirmed that the title will take about 4-6 weeks to get back from DMV. I get home and after careful thinking I decide I still want the truck, and i send James a text to please fix the truck, I still want it, which he replies I will call you tomorrow.

This is where James and I play text tag back and forth about when the truck can be picked up, back and forth for 2 weeks, and various  excuses. I rag on to him how messed up his latest delay is, and how I have lost a days pay to come and get the truck that he says, I'll deliver it to you, yet just another lie to shut me up for the moment. The saga continues another week, this time I have a lawyers advocate calling him, saying about taking him and the dealership to court, at first he seems to respond to my promise of a lawsuit, but that did not last long, after he fails to keep a promise to call me back again at a specified time, I send him one last text, either give me my truck fixed, or give me all my money back, or my lawyer will proceed further.

 It is now Wednesday, October 3rd, and I get a call from the dealership around 2 pm, the gentleman on the phone, Will, the car purchaser from the dealership, he has called to tell me the car has been stolen and i need to come down to make the police report. I can not get there until Friday due to work.

 I arrive at their repair facility and I call 911 and report the truck stolen. I waited for the police to arrive, and since they had no clue who I was , I did not want any issues. The police started questioning the workers and the owner, Joe and that is when I find out during the questioning by the police, the truck was parked outside their garage, on the sidewalk, and the keys were in it above the visor.

I have never had a vehicle stolen before so, I did not think to ask the owner, or the boss of the shop for their insurance info, and as of today October 17th, they are giving me the run around on the phone, and it seems no city or state agency can help me get the insurance info I need to contact them and make a claim. I swear this is out of a movie, and I can not believe I have not lost it on anyone as of yet, as of this date I have lost out on the total cost of the truck, 4 days pay, and transportation costs, let alone all my personal time.

"I neglected a few very important things"

Neglect wasn't the problem. Lack of common sense was your problem.

You agreed to pay 40% over the advertised price for a vehicle that would not start. That's not a good negotiation.
