My brother entered into an agreement with a dating service called Together while he lived in Kansas City, Missouri. My brother had moved to Kansas City a few months ago and my father gave him a credit card to be used only in emergencies. My brother is emotionally unstable and was very loney. He received a mass mailer from Together and he ended up charging $3600 for 36 dates with Together. When he told my father about this, he was furious and Mark (my brother) realized he had made a mistake. Being the way he is, he packed up and moved to Arizona trying to run from his problem. Before he left, he did call Together to try and get a refund, but they basically said tough luck. Since I live in Kansas City, I contacted Together only a couple of weeks after Mark entered into the contract explaining that Mark was emotionally unstable and had left town and since he had received no services, I offered to settle the issue for $200. I felt this was very reasonable since they had not provided anything for Mark. They did not respond.

I turned this over to the Better Business Bureau, but they could not help me because I wasn't the one who entered into the contract. I understand Mark entered into the contract, but he did not receive any services and I believe when this dating service interviewed Mark, they had a pretty good idea he was emotionally unstable. He only made $7.50 an hour at his job, but once they saw the credit card, they didn't care. I just feel that considerating the extenuating circumstances, Together should have refunded the money. I believe offering $200 was more than enough, since they didn't provied any service.

My father made the mistake of giving Mark the credit card, and now he will have to pay for the mistake. I know that I probably don't have any legal grounds to obtain the refund since I did not enter into the contract, however it would give me great satisfaction for people to know how disreputable Together is for preying upon someone and not being willing to compromise on an acceptable settlement.
