On Sunday June 8th 2008, Loan Officer: Mr Steven Levinson contacted my Company for Services.

He stated he has several residences in the Metro Atlanta area which he needs FHA Appraisals to be completed.

We discussed payment of services at the time of the order, Mr. Levinson requested I hold a check until that following Friday and the other two (2) properties we to be paid by Credit Card. I was unable to accept Credit Cards at that time. Therefore, Mr. Levinson stated he would collect the Fee's of $375.00 on each property through Top Dot Mortgage and remit a check for a total amount of $750.00. I told him I looked forward to providing him with any services he may desire in the metro Atlanta area and ended the phone call.

On Monday June 9th, 2008. I began receiving phone calls from the homeowners regarding the appraisal request, Mr. Levinson had ordered. I had just received the, night before and had not investigated the subject properties nor the sales data and would have to reschedule the inspection(s).

On Tuesday June 10th 2008. I inspected and completed my field work on:

On Wednesday June 11th, 2008. I inspected and completed my field work on:

On Wednesday, June 11th 2008, I received a phone call from Mr Levinson inquiring about the Appraisal Reports being completed and I stated to him I would do my best to have at least 2 completed and to him by the following day.

Upon which time Mr. Levinson got rude and told me he expected his reports within 3 days of them being ordered and wanted to know if I was holding back on the reports because I had not received my check. I stated to him I was not going to violate USPAP guidelines and where is my check. He got extremely rude and started telling me I had undone all his good work and I should have inspected the properties when he scheduled them, although I was not aware of the appointments.

Then told me he was going to tell all of his colleagues in his Branch and other Branches not to ever use me. I received several rude e-mails in regard to his opinion of my performance and so on.

I replied that he need to go to and and read the HVCC Home Valuation Code of Conduct and see what ethics he has violated and he better watch what he says to Appraisers. He might find himself in some very hot water.

On Thursday June 12th 2008, Mr. Levinson ignored my phone calls and would not reply to my e-mail messages.
I still never got my check.

After this discussion, I feared I was not going to be paid and sent the PAID Appraisal on June 14th 2008 and the remaining 2 reports on June 16th, 2008, hoping he was a honest person and do as he stated.

On Tuesday June 17, 2008, I searched the Internet and located the Corp Office of Top Dot Mortgage and found out all branches are independently owned and was give the Names and phone numbers of the individuals.

On June 18, 2008, I contacted , Mr. Jason Silverman and explained Mr. Levinson's attitude towards me and how unprofessional he was and asked if he was aware of his behavior. Mr. Silverman replied that the Mr. Levinson was upset concerning the fact, I rescheduled his appointments and the homeowners were their clients not mine and I was supposed to go to the appointments as they are schedule. I told him, I run this business and I prefer to not do any further business and I want my fee's for the assignments I have completed.

Mr. Silverman started cursing me and using fowl language telling me I would get my fee when they decide to send it and hung up the phone on me. To this day 09/05/2008 I still have not received my fee's nor any phone calls or
e-mail regarding payment for my services.

Mr. Levinson and Mr. Silverman were equally unprofessional and I request you to investigate this situation and Sanction them from conducting any further unprofessional business practices.

I have attached all documentation of e-mail messages, Appraisals and Order(s) from Top Dot Mortgage.

Mr. Thomas,

I can appreciate your frustration at trying to get paid for these reports, which you will. However, seeing that Georgia is a State that allows comp checks before full appraisals are completed, I do not feel as though my loan officer was out of line giving you a ballpark value in which our borrower felt their home was worth. We are just messengers of information and we are looking out for our borrower's best interest. When YOU stated that there were comparable sales in the area which would support the value that the borrower had told us, we obviously wanted you to continue with the appraisal order; even though you rescheduled the appraisal date 3 times pushing back our projected closing date 3 times. If you knew you couldn't honor the appointment right away then you should have let us know before accepting the order. Also, after confirming that there were recent comparables and then sending a report back to us at 60% of the anticipated value does not sound like good business practices. And not to mention that you posted these borrower's full names and addresses on the internet was not a very professional act of business. I am sure the borrower's will agree with that and all of the other aspects of this occurrence. Let's get back to payment for services rendered. Even though it is apparent that you really didn't do a comp check and just appeased my loan officer to get the order by telling him that the value was reasonable, you should be paid something for your efforts. Wouldn't you agree that you should charge these borrower's a trip fee? A customary trip fee is $75. I think that is fair and believe my borrower's would think that is fair too. You and I both don't want them to feel as though they were ripped-off by an appraiser who wants a full fee for poor service.
