There are many regulations concerning your plight. The DFS governs control over both the insurance agents, claims protocols, and financial institutions handling of these matters.

Your case may be a legal one wherein your wife was on the policy and your name was not, she therefore would have the insurable interest and you would not, even though you may have been decreed the property in a divorce settlement.
