I turned on my tracfone and was told my SIM was unregistered. Therefore I have no service. I contacted their customer service which is located in the Phillipines. After 3 frustrating hours with their so called customer service, I learned that they gave away my phone number and transfered my 839 minutes to someone else. They argued with me. Wanting to know if I had a receipt for my purchase which was several years ago. Then they insisted that I had purchased a new phone and had the minutes transfered. I had to repeated the cell phone number time after time as well as the IMEI and Sim number. The last supervisor I spoke with (about 5 others could not be understood as they spoke broken English) decided that I had a damaged SIM card as the result of the transfering of my number & minutes. They will send me a new SIM card. In the meantime I do not have a working cell phone and lost 3 hours which was needed for other things. So they stole my phone number and stole my 839 minutes whick I paid for. I would like to know who got the number and my minutes. Is this a criminal act?

My phone was good until June 28, 2011. It was not deactivated due to non payment. When I dial the number the message is "Not accepting calls at this time."

Is this a criminal act?
- Depends. Companies won't just transfer your phone number and minutes unless they cancelled your account or someone else said they were you and had them do it. If what you are saying is 100% true it seems unlikely that they would have cancelled your account for the common things such as non-payment. But if your account was in fact cancelled and they took your minutes that is not a crime, but if you can prove they violated the terms of the agreement you could sue them in civil court to try and get your money back. However, it would be more likely that someone knows enough of your information to do this. If this is the case then it is a crime, but not by TracPhone. The person who pretended to be you committed Identity Theft.
