My husband and I are currently trying to get out of a contract with Trendwest/Worldmark which we have been paying for for the last three years and which we feel was grossly misrepresented. We were not aware of what the product was before attending and were intrigued because at the time it sounded as if it was something that would benefit us and also our clients.

My husband owns a home construction/remodeling company and the salesman said that because the resorts were available to any of our guests/family and friends we would be able to use it for homeowners in the midst of the messiest time of construction on their homes. At the time, it sounded like it would be a great thing to offer our customers.

We asked for time to think about it, but were told that it was a ONE TIME opportunity and if we left we would not be able to attend again, per California real estate law. Not wanting to pass up an opportunity, we bought a half-share and financed the down payment. We were very excited by the potential and the opportunities presented at that time.

Our reason for wanting to now get out of our contract is because we've been members for almost three and a half years and have not once been able to use the services. Not once have we been able to book a vacation in the month we need or at the resort we'd like to use. We feel like we're in a one sided contract and are paying for something and getting nothing out of it.

We would like to be released from this contract and we are willing to forfeit the money already paid, but don't want to pay any more. As I've stated, on our side, we have paid all our dues, but the Trendwest/Worldmark resort/hotel has not provided ANY of the services we were told we could expect.

Following is a list of opportunities we would have liked to use the resort/hotel for, but were unable to book due to unavailability, lack of rooms.

The waiting list for the service is between 6-9 months. The salesman assured us that we'd be able to book resorts in "weeks" not informing us that the waiting list is actually in excess of nine months. We are unable to foresee six months forward as to when the worst of the construction period is, this was misrepresented. The salesperson said specifically that we would be able to get into resorts, booking them in just weeks. This may be true, but not anyplace that is desirable, local or wouldn't require long term planning, airline tickets or pet-sitting.

We purchased the timeshare in December of 2006 and were planning a trip to a five day long conference in Long Beach, CA in March of 2007, we were excited to be able to use our new resort/hotel service. But after calling and trying to make reservations, none (not one in Southern California) of the resorts had any rooms available. When we were unable to get into to the resort "just" two months in advance we had to pay for a hotel (sister-company to Worldmark) and pay for it out of pocket and in addition to the monthly dues. This was our first experience and we thought it was just a coincidence at the time.

We were married in August of 2007 and starting several months prior to the wedding we tried to make reservations at several of their honeymoon type destinations, but was unable to get anything, ANYWHERE in the month of August. In order to save money and use the services we'd paid for, we tried to reserve a non-honeymoon resort destinations, just so we could use our membership. NOTHING was available, and in the end, and in addition to our fees, we paid out of pocket for a resort for our honeymoon.

In December of 2007 we purchased tickets to Disneyland and wanted to use the resort/hotel in Anahiem, our tickets were good for a year, but after checking for months to see when we could book a resort it became apparent that there was not one opening in the nine month calendar or beyond. (NOT ONE) When we finally took our family vacation to Disneyland in November of 2008 we paid out of pocket for a hotel. It was really frustrating to walk past the WorldMark hotel/resort every day on our way to Disneyland and know we'd paid our membership fee every month for two years and were not able to use the resort.

We just want out, but when we called to try and cancel, we were told we could only cancel after we'd paid in full. This is unfair as we've never ONCE been able to use the service, they are taking our money for what? We've received NOTHING in exchange for what we've paid fro the last 26 months and don't have much hope for the future.

I hope someone can help us with this, it's fraudulent to promise so much, to take money under false pretenses and not provide any service to us at all.

I am also a Wyndham owner also and you claim: 

 

"The contract locks signers in to paying lifelong increasing fees with no way to get out of it other than to sell the contract to someone else, yet this is never pointed out, explained, or disclosed", and "Never was it explained that the timeshare I would be purchasing was a lifelong contract and that someone would always have to pay for be it me, my posterity, or a new owner and that it could never be dissolved." You have to be joking. There is a QA process that is done with every owner after you talk with the salespeople... This is the person you sign the contracts with. This person goes over AGAIN everything in the contract about the ongoing maintnance fees. You must listen and read what you are signing.

 

You also said, " They do offer a 7-10 day rescission period that virtually no owner can meet because of they require a written notification to be received within the time period." Have you every heard of overnight mail? Please, Please, Please do not blame other people for your lack of competence. 

Wyndham has 940,000+ owners. that is almost a million... I count 33 ripoff posts about them on this sight... that means that .004% have complained about them.

Give me a break!

Joel, it is clear that you have a vested interest in protecting Wyndham/WorldMark either as a calculated PR move or as a current employee. For you to dispute a couple's genuine, heartfelt story is just STUNNING to me and anyone reading your rebuttal.

Are you saying that they are lying, PLEASE! Whatever your personal experiences is with this company, HAS NOTHING TO DO with ANYONE ELSE's!! It is the same with any type of purchase. Just because I purchased a working TV from Walmart doesn't mean that some else purchased a non working one that required a refund!!!!!! That happens everyday across America! It's an apples and oranges comparison to compare YOUR EXPERIECE with THEIR's! 

Funny but with every genuine BAD REVIEW of the Wyndham?WorldMark Brand, there is always this one sided, biased, dogmatic, cult like response attached to it. This is about Timeshares, not Scientology! It's also just like the PLANTED responses to bad reviews in Yelp by the owner of the business! 

Joel, this couple had a bad experience, DEAL WITH IT. No one put you in charge of publicity over at Wyndham/WorldMark, OR DID THEY?

You are much a fraud as Wyndham/WorldMark and both the company and yourself should be ashamed of your actions!

I understand your frustration and am sorry they misrepresented what you bought. It's not a service, though. What you bought is an ownership and like owning anything...from a bowflex to a vcr...requires some learning to figure out how to use it to it's fullest. Unfortunately...what you own and how you origninally wanted to use it arent likely to work as easily as the sale person implied to you.

That doesnt mean that you couldnt get great use out of it...just that you need to learn how to get the time and locations you'd like. Some of the vacations you were looking to book might have worked out for you if you'd known how to work your ownership...waitlisting, piecing trips together, hedging your bets on vacations, etc.

You also dont need to lose the unused credits you've accrued. you can deposit them for exchange or at least rent them to another owner and get a bit of cash to put toward your dues.

Bottom line...they wont let you out of the contract and it really might as well be of some use to you since you're obligated to pay on it. Visit wmowners.com and get help booking your next vacation. It's a site built by owners for owners with a ton of great people trying to help folks like you learn more about what you own.

It really is one of the best timeshares out there...and will hopefully continue to be as long as Wyndham doesnt screw things up. Right now...let's just try to get you going.

I am a Worldmark owner, and your complaint has no merits at all. There are many things I am unhappy with my Worldmark ownership such as a lack of an independent BOD, and increasing dues, and TOT taxes. But buy and large I have saved quite a bit of money on vactions with Worldmark.

1. First never buy ANYTHING under pressure, don't buy retail! Pay cash and never finance! There are only 20 timeshare resale companies that sell Worldmark resales for a fraction of the cost of the price quoted at a reatil presentation.

2. To get prime dates you do have to book up to 13 months in advance but I never had a problem being on the waitlist. I get Xmas week in South lake Tahoe
every year and I usually get on the waiting list 5 months ahead of time.

3. Anaheim is almost always wide open! You can stay this week if you like with Bonus Time but if you want to save $$ stay in Worldmark Dlophins Cove for 40% less!

4. Most of my stays are Bonus Time, which is available 14 days out if there are still vacancies. I got Worldmark Indio NEW YEARS eve (Bonus Time), a 2 bedroom for about $58 without using my credits.

5. What I really like about Worldmark, after your membership is 4 years old (regardless who bought it first), they will pay you $50 tp $75 to listen to a short spchiel about the club when you visit. I usually collect $200 - $250 a year in "owner-update cash" which helps pay the dues.

6. I have gotten a few free nights as well from time to time when I bring my
freinds who agree to listen to a retail presentation.

7. There a are few thousand "activist" Worldmark owners that can show you how to use your membership at www.wmowners.com.
