This post is made in rebuttal to the false and defamatory accusations made by Robert Allison (under the alias “Henry Krinkle”) against TriStone Financial, LLC (“TriStone”) and its owners James Greenie and Ken Kilinski. TriStone, Mr. Greenie and Mr. Kilinski have filed suit against Mr. Allison due these defamatory posts. This suit is pending in the Superior Court of Gwinnett County, Civil Action File No. 11-A-01136-9.
 
Neither TriStone Financial, nor Mr. Greenie, nor Mr. Kilinski has ever engaged in fraud, forgery, stalking, harassment, defamation, deception or any other fraudulent conduct.  There is no court order against TriStone, Mr. Greenie or Mr. Kilinski. As shown, Mr. Allison/Krinkle has now retracted all statements made against TriStone, Mr. Greenie and Mr. Allison.
 
In fact, because Mr. Allison’s allegations against TriStone and its owners are completely meritless, Gwinnett County Superior Court Judge Tom Davis has issued a Temporary Restraining Order against Mr. Allison, which is provided in its entirety below:

ORDER
 
This matter comes before the Court on Plaintiffs’ Motion for Temporary Restraining Order and Preliminary Injunction.  Upon consideration of the Plaintiffs’ Motion, Plaintiffs’ Verified Complaint, and the oral argument of Plaintiffs’ counsel during the February 9, 2011 ex- parte hearing, it is hereby:
            ORDERED that Plaintiffs’ Motion is GRANTED.  Specifically, it is ORDERED that:
1.                  Defendant is restrained from interfering with Plaintiffs’ business relationships, including directly contacting, whether by telephone, mail, email, Internet posts or blogs, or any other means, any of Plaintiffs’ business partners, customers, potential customers, Facebook contacts, banking partners and/or vendors, with the purpose of disparaging Plaintiffs or encouraging said business relationships to not enter into or continue a business relationship with Plaintiffs;
2.                  Defendant is restrained from continuing his ongoing, online posting and emailing of defamatory statements and other libelous actions against Plaintiffs; and
3.                  Defendant is restrained from continuing his ongoing utterances and other oral defamatory comments about Plaintiffs;
4.                  Defendant is ordered to take down all Internet posts, blogs, emails and other written statements that reference Plaintiffs, including, but not limited to, posts on www.RipoffReport.com, www.ComplaintsBoard.com, www.craigslist.com, www.facebook.com, and www.yelp.com; and
5.                  A hearing is set on Plaintiffs’ Motion for Preliminary Injunction for March 25, 2011.  Plaintiff is required to serve Rule NISI for said hearing on this Defendant within five (5) days of this Order.
 
Plaintiff will make arrangements for this Order to be delivered to Defendants within five (5) days.

As indicated, the Honorable Tom Davis has ordered that Mr. Allison take down these posts.  However, Mr. Allison cannot do so because www.RipoffReport.com refuses remove posts once they are submitted. I've been contacted (a violation of my TPO) ,threatened,intimidated and harassed for telling my story.

I informed TriStone Financial's Owner/Registered Agent Mr.James Greenie of the issue by certified mail after several emails to him went unanswered. He sent an email claiming that he wished to discuss the matter,but only by telephone and not by email. When I contacted Mr.Greenie by phone at his request, he offered no apology,was evasive and defensive.

When I contacted WSB-TV Reporter Tony Thomas and told him of the exchange,he wrote that it is very interesting that Mr.Greenie didn't want a record of our communication.

This entire affair has been disgusting embarrassing, and offensive. Psychological evaluation and treatment is highly recommended. I hope to have John Memoli prosecuted.

I received a letter from a Paul Fleming,claiming to be Mr.John Memoli's attorney.He claims that he has been hired to stop the harassing,threatening and defamatory postings he claims have been made by me on the internet. He claims that it is his intent to take whatever action is necessary if I do not cease my harassment of his client.

I would like to know if that action includes compensating me for over two years of lost income,emotional anguish,defamation,harassment,fraud,stalking,computer forgery,etc. I have not threatened anyone,harassed anyone or defamed anyone. I have only told my story. If John Memoli had any idea how to behave like a mature adult,none of this would have ever come to pass
