I have received some alias civil papers that were served to me by the Sheriff for a debit collection from Unifund. I have never heard of this company or received a phone call in regards to this matter. They are trying to collect a debit on a credit card that was open in 10/99 and charged off in 12/03. This debit will be officially off my credit report in 01/09. I have been reading some horrible stories about UNIFUND and I am astound that they have changed their name numerous of time within the past two years. They are trying to make me pay back double what I originally owed on the credit card. Isn't this a statute of limitations since this account is past 5 years old? this company needs to be band from doing business ever again, because all they are doing is ripping people off to collect and take money from people.

I am barely making ends meet and for someone to try and rip me off for something that has been closed for 5 years and will be off my credit report in January 2009, I feel that this isn't right at all. Someone needs to get tot he bottom of this and stop this company from collecting real old debit on people. The country is already messed up as it is, and for this company to serve me papers on something that will soon be erased is very unsatisfactory. I looked them up on the BBB of Cincinnati and they have an unsatisfactory record with over 100 complaints that has not yet been resolved from UNIFUND.

I have written a defense on my behalf and I have mailed it to our County Clerk's office to put in my file about this debit. Does anyone have any suggestions on what else I should or need to do? They are doing a lot of falsifying documents, because the papers that I received were dated at the top 5/5/04 and I could tell where they were photocopied because they weren't clear to read. I strongly feel that his company needs to be band from ever doing business again and I think that they should pay everyone that has suffered through pain that they have put us through. I am very upset with this issue and what they are trying to do in regards to this debit that they are trying to collect. I am doing everything in my powers to resolve this. Please someone help me......

i tryed to fight them.. like i said before they know how to be very nasty to get what DOES NOT belong to them.. i told the judge that they never showed me a thing that i owed them.. again they won ONLY because they servered em with papers 3 days before the SOL was up... if ihadnt been home that day.. they would have been S??? Out of to who ever wlse is out there and going threw what i had to do... if you see a sheriff comeing up to your house.. dont answer the door, or have someone else tell them oyu are not home and DO NOT TAKE the papers or let them touch you with them.. Unifund takes from those and it dont belong to them...... we can fight them on this if there was a way to get together on it......again best of luck to every one......keep posting things and let us know who you turn out...... FIGHT THEM DOWN TO THE DIRTY GROUND THEY CAME FROM...

Sounds like you work for one of these bottom feeder collection agencies
To the original OP - make sure all your paperwork is in order including any and all letters sent to you - If you did not receive any letter from these bottom feeders make sure you let the Judge know and ask for copies of "letters" sent to you
Show up for court - check your Secretary of State's website to see if these lowlifes are bonded to collect debts - In the State of Texas all collection agencies MUST file a surety bond with the Secretary of State

best of luck to you on this.. they came after me and i did go to court against them and im not done with them yet.. but they won ONLY because they were very nasty in what they did.. they had me served with papers like you by the sheriff, i had NEVER heard from them or gotten a call or mail NOTHING!! they came after me for a credit card debt that has BEEN DELETED off my credit report.. This debt is gone, the only reason it belongs to them now is because they bought it off the bottom of the scum line for pennies on the dollar... and came after me.... So yes now i have a judgement against me.. they are nasty people and they will get you..they lie, and do what they can to get money.. I never had a crediot card with UNIFUND and or COMO Law.. SCUM SUCKERS.. and yes they need to be stopped... best of luck.. i told them in court i can pay them $25 a month.. I have now closed all and any accounts in my name so there is NOTHING they can frezze like my checking, saveings i had it all put in someone elses name.. I have no assets, all gone..and i only work p/t and i might just be gettting load off... so then what will they do????? there is nothing they can do..I am here to support you if you want to start a class action.... and i can get a few more from my home town and a few towns around me.... BEST OF LUCK!!!! o and i thought the statue was up in my case to.. well they know how to play the game, when i was served it was 3 days before the SOL was up..... again NASTY SCUM..

You still owe the debt

Just a friendly tip for you....You might want to make yourself familar with the law as it relates to your debts. Check out the Fair Debt Collection Practices Act (FDCPA) as well as the Fair Credit Reporting Act (FCRA).

Short story for you....whether or not the debt is appearing on your credit report has no bearing on if you actually owe the money. If you are saying that indeed this is your debt and it was charged off 5 years ago, they have full rights to sue you to come after that money.

The only protections that the FCRA gives you is how long that debt can appear on your credit report, which is 7 years (interesting that yours is gone already). But that has no bearing on collecting the money from you.

The FDCPA provides the guidelines with which collection agencies can attempt to collect debt from you, things they can and cannot do and say and so forth.

But get to the root of this...if this is your debt, simply because it's "old" (according to your definition of old) doesn't mean you don't owe it anymore. That's like saying if you stole a car and nobody caught you for 5 years that you get a free pass when they did catch you.

Be careful're being sued, so you should get an attorney. Lawsuits can result in liens on property, garnishing of wages...etc.
