I opened a Visa credit card account with Providian Bancorp on 10/98. 12/99 Providian Bancorp started raising my monthly payment, the payments got so high I started having trouble paying the full monthly payments plus late fees.
I told Providian Bancorp that I would pay reduced payments, until I could catch up on the payments, Providian Bancorp said Ok. Then on 5/00 they notified me they was closing my account. The balance was around $1,900.
Unifund CCR Partners sent me a letter 1/22/02 stating they puchased the account from Providian National Bank with a interest balance of $3,134.15 and current balance of $3,436.16.
On 8/22/02 Jeff Shaffer Unifund - Legal Dept., he's the General Manager, stating my share of the Providian settlement is $14.51 and they deducted that amount the the balance, stating that I now owe them $3,123.76.
12/02 Unifund CCR Partners file a Civil suit against me, with a Arbitration hearing date of 8/05/03, now they said that I owed them $3,453.68 plus attorney's fee of $690.74.
Total amount of $4,144.42
I got a letter in the mail from Tucker Arensberg, PC that Unifund won a judgement against me on 1/28/03.
They got a judgement against me for a debt from Providian Bancorp engaging in widespread misconduct by charging cardholders unlawful, excessive interest and late charges, and by promoting and selling to cardholders "add-on products" promising illusory benefits and services.

You have rights under the Fair Debt Collection Act. If you feel that those rights have been violated the you should contact the Federat Trade Commission and file a complaint. The FTC DOES NOT TAKE ACTION ON INDIVIDUAL CASES but the complaint is put in their database and if more consumers report unfair collection practices made by Unifund and they receive enough complaints the FTC will take action agaisnt the company.

In response to the posting listed, please be advised Unifund purchases only validly existing claims from credible sources.
Providian is certainly a credible source. Any issues relating to overcharges on interest have been credited by the bank , in full, on each account.
In order for a judment to be awarded, a judge needs to hear the case. Obviously , in this case, the judge decided it to be a validly existing, legally created, binding and enforceable agreement.
Any comments, complaints relating to the balance will ahve been heard by the judge and included in the decision. Further, any new information obtained which would impact our perception of the validity of the debt is welcome and appreciated.
