In June of 2006, I responded to and add for United Debt Services. At the time, we were deeply indebted due to credit cards, charge accounts and medical bills. At the time we had a few late payments, but no serious delinquencies. Because of the amount of debt, we were making no progress in paying any of it down and there was no chance that we could ever pay it off. This company offered an oportunity to pay our creditors without bankruptcy.

After paying UDS for 6 months (over $3000) it became clear that they weren't giving me any help or support with our creditors. When lawsuits began to be filed against us, we were forced to file Chapter 13 bankruptcy.

At that time UDS was called and informed that we needed to cancel our contract and were told that we had to have a notorized letter to that effect and another letter requesting a refund. We were told to overnight the letter and the bank draft would be cancelled and it would take 90 days for the review committee to decide on the refund and that I would be called. Of course, that call never came.

After overnighting the letter, our bank account was drafted again about 12 days later. After numerous phone calls, I was told that they only do mail once a week and that my letter didn't get there in time. Actually it took 4 phone calls to get that information. My overnight package took 5 days to get there because the information that I was given at the beginning had the wrong address. About 3 weeks after that draft, while I was on the phone with them, they finally cancelled the upcoming draft just one week before it was set to draft again.

After the 90 day period, I began to call to get information on my refund. I was promised a call back with the decision. By now, I new not to expect a call back so I called every day for a week before I was told that I wouldn't get a refund. I wouldn't even get a refund for the last draft since my letter didn't get there in time.

We have now paid an attorney and are in Chapter 13.

We are ready to pursue other legal action at this point to get the refund.

Dear John & Margaret,
On or about May 30, 2006 we did receive a signed Power of Attorney from the both of you acknowledging that you agreed to be bound by our program guidelines. As provided by the program guidelines "Either party may discharge the other at any time by written notice. Client must send their notice in with a notarized signature. Client further understand that any request to withdraw from the program must be in writing, must be notarized and must be received by United Debt Solutions. at least 10-14 business days prior to any scheduled electronic debit in order to stop further debits.

Only original documents will be accepted, faxed copies are not honored. United Debt Solutions. may terminate the agreement if the Client fails to promptly pay any fees, in Client acts contrary to United Debt Solutions, advice, if Client fails to provide United Debt Solutions, Inc. with the proper information in order to negotiate the debt of the Clients behalf, or if anything else occurs that in United Debt Solutions, judgment impairs the relationship. Client understands that if either party terminates this agreement for any reason, all fees paid by Client up to the date of cancellation shall be deemed earned and are non-refundable."

Your choice to file bankruptcy is an unfortunate one and had you followed the guidelines and had proper funds to settle we would have been better equipped to negotiate on your behalf. You enrolled in a 50 month program and were only a part of the program for 8 months which is a difficult period in which to negotiate nearly $65000.00 in debt.
