Hello My name is Janet and I want to voice my opinion about these low down dirty dogs.

My nightmare began with US Bank in October of 2002. My home loan was transfered to them in October 2002 from Chase Manhatten Mortgage Co. In August of 2002 Chase sent me a letter stating that they were selling my loan and it would be taken over by US Bank on October 1, 2002. It also stated that Chase would stop taking payments from me on September 30th 2002 and US Bank would star excepting my payments on October 1st 2002.

Then I recieve a letter from US Bank in the middle of October stating that they took over my loan on August 1st of 2002. And this is were my nightmares began. They started to post all my payments as though they took over my loan in August instead of October 2002. I called and talked to several representatives to get this straightened out. I first spoke with a representative name Crystal Dant in October of 2002. I explained to her want was going on with my mortgage account and she stated that my loan was new with them and call back in 30 days because all my paper work was not in.

Well in 30 days my account was even futher behind. I called back in November and again I spoke with Crystal Dant. I explained my concerns again with my mortgage and let her know that I had spoken with her inregards to my mortgage in October. She then told me that I needed to speak with the person that handled my loan from Chase. Crystal then gave me the number of Debbie Weise the loan specialist that handled my loan from Chase. I called her in December of 2002. She was out of town, I then left a voice message for her to call me inregards to my loan.

She called me the following Monday when she returned to work. I explained my mortgage concerns and wanted to kown why my mortgage was showing at this point 3 months behind. She told me that she was accessing my account. After she had accessed my account she stated to me that she did not know what was going on that there was more than enough money showing on my account and that it must have been applied incorrectly. Then she stated that she would give me the name of someone that could help me because she did not want to tell me anything wrong.

She then gave me the name and number of Kara Knable. I called this woman and she really was a b***h and when I say a b***h I really mean it in every since of the word. This woman told me that I had to give them a chance to straighten things out because they had just acquired my loan. I replied that you people have had my loan going on 4 months now and I want to know why it is showing 3 months behind. She then told me that she did not see what I was talking about because she did not see were my loan was showing behind.

After going on with her for about an hour and half I told her that I would call back by the end of January. When I called back in January my loan had gotten even father behind. Kara then told me that I had to call Chase an request a payment history because she could not and she would review it and try to get things straighten out. I called Chase in Feburary requested the payment history and it was not sent to me until May of 2002. I called her in May to let her know that I just had received the payment history from Chase and would fax it to her to review. I faxed it then in August of 2003 I recieved a escrow refund check from US Bank.

Then in October of 2003 US Bank tried to do a forclosure on my home stating that I was 3 months behind going into 4 months behind when October began. Then they would not except my mortgage payment for October. I was told that I had to talk to my bankruptcy lawyer. I called my bankruptcy lawyer and was told that they were trying to foreclose on my home and that we had a court date for November the 12th of 2003. On November the 12th I met with my attorney and was told that they would settle if I had at least half of the money that they were claiming that I owe. I was so pissed. I told them the only thing that they were going to get was my October and November payments for 2003. I had reciepts and if they had proof(documetation)to show me where this money was owed I would consider paying it, but if not the only thing I would be only paying them for October and November. Since they could only get money for 2 months they then stuck me with court fees, $655.00 and told me that I could pay this over a six month period. I agreed to pay because at the time I was dealing with other issues. My grandson was dying and I really could not be bothered with this because I had to be there for my daughter.

After my grandson passed in January of 2004 I began to fight these low down dirty dogs. I filed a complaint with the office of Comptrollers of national banks and HUD in Febuary of 2004. I stated in these complaints that US Bank has in tentionally posted my mortgage payments to reflect 3 to 4 months delinquent, that have charged me excesses fees ( HUD property assessment fees, court fees,late fees, etc). They tried to fradulently foreclose on my home. They have double charged me for homeowners insurance. They took my mortgage payments up stating that my owners insurance and taxes increased $100.00 each. And that they had not properly kept my escrow account.

Kara responded to my first complaint stating that I expressed my issues, but my main concern was the take over of my loan she explained that August was the contractual take over date of my loan not the actual take over date of my loan. Then she went on to say that I was looking at my account on the internet and that it was not always accurate. And that according to her records I owed them approximately $1,000.00 in reared payments. And she called her self making a print out of my loan history through an excel program showing what my loan statement should have looked like instead of what it really looked liked on their web site and my mortgage statements being sent to me every month. I replied to her, the office of Comptrollers of national banks and HUD that yes I did express many issues and I did not want her to pick and choose which ones she wanted to answer. I want each and every one of my questions answered.

I then expressed the problem with her print out that she created of my account was that it showed what my mortgage account information should show but unfortunately it did not so we had still had a problem. And as far as their web site not being up to date, so in other words are you saying that I should not be looking at my account on this website.

Correct me if I'm wrong but that is the purpose of this web site is it not for me to view my mortgage account and when I pull it up I expect for it to be correct. Not showing what you people want it to show. And as far as me owing you approximately $1,000.00 either I owe you are I do not and if I owe you then you should be able to state how much. You do not approximately owe anything. It is either you owe it or you do not owe it.

I then sent in all my mortgage reciepts from 2002 through present along with my trustee statement and all documents showing where my mortgage insurance had been paid,a copy of the letter of transfer from both Chase and US Bank along with a payment history from them and Chase discrediting every thing that they have done thus far. Then Chase payment history shows that $4,000.00 plus dollars were never applied to my account, I was charged two extra mortgage payments totalling $ 1,429.00, two escrow payments that was never returned to me one for 2001 for $1.140.00 and another for 2002 for $952.00, then my September mortgage payment for 2003 was never credited to my account when it was western unioned to Chase on September 2, 2003. Then US Bank has charged me $528.00 for homeowners when it was only $407.00 which I paid my self.

Then they still continued to take out $33.52 per month for home owners insurance when they knew that this money had already been paid. I do not care how you US Bank lovers try to define this bank they are nothing but modern day loan sharks. I have lost a s**t load of money dealing with this bank and the sad thing about is that no one wants to do anything to help close these bastards down. I am interested in filing a class action lawsuit agaist them so If there is one in progress please contact me.

I have documentation to support everything that I have stated here and if there are others out there please file complaints and what ever else necessary to discredit them. These bastards need to go down.

I see why this may be very frustrating to you, however you seem to be placing all of the blame on ONE company rather than both. I find it difficult o believe that neither bank had any idea what was going on with your account. If you contacted Chase and they could still review your mortgage account information, then that means US Bank had not yet aquired your info and, therefore, could not be held responsible for those "missing" payments. It would be VERY difficult for Ms. Knable to have obtained your payment history and review it with you, if they had not even been assigned your loan yet. Often times when a company has sold or purchased loans, they send a letter well in advance to let you know that a switch is coming up in the near future. That does not, however, mean that it is instant.

Another thing...regarding your escrow being a "rip off". If your account has to be escrowed, you cannot go and simply switch compaies and pay it yourself and then not expect to have to pay those escrow payments to the bank. The banks are billed for the taxes and insurance on your property regardless. To my knowledge, go behind the bank and switch insurance without notifiying them is grounds for them to drop your provider and give you forced place insurance. The forced place insuracne can be very costly and you do not get to pick and choose which company you want.

You mention that you had filed bankruptcy. That actually stops any foreclosure action and you are generally given the opporunity to pay any arrearage on your mortage account during that time. Did you default a second time cuasing the bankruptcy court to issue a Relief of Stay? That would have allowed the mortgage company to conitnue with the foreclosure action. It just sems as if there are some loopholes in this story. It's sounds very angry and one sided. You simply cannot neglect mortgage payments becuase of illness of a relative or things like that. This seems to be all too common a misconception. If you needed mortgage assistance, you should have contacted someone in Default to see if you could get assistance from HUD like postposing mortgage payments until everything was straightened out, or until the hardship with your family had blown over. There are many MANY programs available with BOTH of these banking institutions that allow people like yourself to get help.

Since I filed this report and my complaint with the comptrollers of national banks and hud. I have not heard anything from US Bank,the Comptrollers of National Banks or Hud. US Bank has attempted to make adjustments to my mortgage account. They now seem to be showing my mortgage to be 1 month past due instead of the 4 months past due when this complaint was filed. They called themselves crediting $1,962.00 to my account but my balance have not moved. Then they have increased my escrow payments by $4.00 dollars but I was never sent anything in writting in regards to the change. They never did answer my second complaint letter that I sent to them in regards to Kara's reply to my first complaint letter. Nor has anyone been in contact with me to let me know where my unapplied funds and my two escrow refunds are for 2001 and 2002. None of this money,-($6,000.) and why have they not been applied any of this money to my loan only god knows. I have been doing a lot of research on US Bank since I found out what they have been doing to my mortgage account. This Bank has been sued 3 or more times, they have over 300 complaints filed agaist they. This bank needs to be stopped anyone know of a class action lawsuit please let me know. I am also in the process of writting the Govern's office for assistance with this matter and I am going to forward all the information that I have so far to all the local media stations here in Georgia. And I also found out that in 1999 when I first bought my home, Firstar Home Mortgage had my mortgage account which is US Bank. I found when I requested my credit report that they filed information on my credit report that was not true. They have my mortgage as being 30 days late for 4 months and 60 days late 2 months. I am filing another complaint to dispute fradulent credit reportings for 1999 by Firstar.
