Just another example of how US Bank, and most likely many others, manipulate transactions on low balance accounts for profit:


This has happened to me before and I am glad to say that EVERYTIME it happens I've had to march into the branch, check the CS manager, and promptly demand that any and all fees be reversed or "credited" as they put it.


Last Friday the 18th I made 2 deposits. Account transfers so funds were Avail the same day. 


The deposits totaled $100.00 so minus a few things I had 69.00 AVAILABLE bal on that Friday at COB(Close of Business) I went to the ATM that evening (my receipt says 18:53 (6:53 for those non-military) and took 40.00 from the ATM leaving a 29.00 Bal, ok cool..we were going to a concert.


Later that night(after midnight) we stopped to get a few things to eat and I over drafted my account by 8 or 9 dollars. No biggie, because today is now Saturday and I had no outstanding transactions come through on the 18th that would generate any NSF fees...or so I thought..lol!


Upon this notice via text mesg I promptly transferred another 100.00 to this account to clear and post positive any errors. Sunday comes and goes..all is well. On Monday I notice a 37.50 NSF fee for the ATM transaction done on Friday the 18th..WTF!!


So I called US Banks customer service 303-585-8585 and was told that "Yes" as the online banking states "You" overdrafted your account when you took the 40.00 out of the ATM. I quickly rebutted the cs agent by telling her that "No" I have a receipt that shows a 29.00 avail balance at the time of this transaction and that "They" have made another accounting mistake, I will need this fixed ASAP.


Well after hearing the usual BS about how they can't do anything via phone, I understood and walked my paperwork (receipts from the evening in question) into my local Cherry Creek branch office. I was met by a man that had a CS manger sign on his desk who proceeded to review my account. He printed off some generic spreadsheet of transactions and agreed that "Yes" it was the 40.00 ATM that caused the fee,(Which by Monday had escalated to 186.00, due to outstanding auths that were now paid) 


I asked him how this was possible and produced the ATM receipt that showed the accurate account bal at the time of this transaction. He proceeded to tell me that my account had xyz authorizations being held on the account "Prior" to my ATM withdrawal. I again asked him how this was possible for US Bank to claim that I made transactions "Before" they really happened!?


Now, I'm a collections manager and haggling is what I do for a living so I asked to speak to another person because he was not capable of assisting me. I spoke with "the next man up" and he tried to give me a "deal" I was to pay for 2 NSF's and they would "credit" 2


I told him to F**K that idea and to let me have a look at his generic paperwork on my account. He did and I noticed that every transaction I made on SAT the 19th was placed on the 18th thus making it "Look" like I did overdraft this account with the 40.00 ATM withdrawal. I produced my receipts from the food purchases that were all dated 12/19 and demanded to know why their accounting system had moved them to a day earlier!?


Needless to say he had no response for my paperwork vs his paperwork. It was a clear picture that US Bank has this practice of escalating authorizations on their books to "Create" NSF's. Any dummy with half a brain would have caught this but they talk a good game, and even will try to show you some generic spreadsheet that has the transactions placed the way "They" want them to be..lol! I took the half and half deal off the table and gave it back to him, he credited ALL fees and sheepishly sulked back into his glass hole!


These Banks are amazing, and the funny thing is they just do it, with no regard to whom they may be doing this to. My advice to anybody that banks with them is to check your statements close but more importantly KEEP any and all paperwork you have. I tell this to consumers that I speak with everyday "Documentation beats conversation anyday of the week...Where is yours??" 


You the consumer MUST have some form of this because the bank sure did! And no matter how inaccurate it may have been, if I had not had my dated receipts I would have been up the creek even though I was right and they were wrong!-

Ok, obviously we can't see your bank account, but you said "Last Friday the 18th I made 2 deposits. Account transfers so funds were Avail the same day". 

So were they deposits or transfers from one USBank account to another??? That makes a big difference in terms of funds availability.

Windigo,

You're accusing USB of manipulating the records so your account will be forced into overdraft. I understand that. (It's sad that you think that, but I understand it.) So, you're saying that USB is committing gross fraud every day, potentially with millions of people's accounts, and you're the only person brave enough and/or intelligent enough to point out this grave injustice? You do realize that banks' records' are routinely audited by the government, right?  

Well, that's fine, but I believe you said "...we stopped to get a few things to eat and I over drafted my account by 8 or 9 dollars..." That being said, who is really "manipulating" your account into an overdraft status?

it shouldn't be surprising that many customers are experiencing problems with their bank accounts, right?


Let's face it, the banks are still obviously in deep financial trouble due to the FORECLOSURE problem in America, correct?

The banks obviously need to generate profits as fast as possible to compensate for the TREMENDOUS amount of money that was lost when they got involved in the booming housing market in the USA by providing mortgages to so many people, right?

Many banks, and even investment banks like- Lehman & Bear Stearns, were investing in these mortgages which are now being labeled as TOXIC MORTGAGES, correct?

Very interesting...

That is a very interesting claim and sort of explains my problems with US Bank as well.
They claimed a transaction, from your account happened earlier than it actually did. In my case they claimed a transaction happened in the future. Your lucky, because in my case they were later able to claim that it had a 'hold' on it, which was BS because the money was coming FROM US Bank TO US Bank, and there was no explainable reason for it.

It seemed the girl I talked to first when I called customer service was more correct when she said. "Oh yeah, it looks like you took it out at 3:00 today".. with me going.. "what do you mean.. it's only 2:00, and I requested that advance yesterday.".. "Interesting.. Let me put you on hold.. (fetches the manager, who manipulates things to make it look like the advance had a hold on it, and that they didn't actually manipulate times)"

I'm glad you were able to catch them in their dirty tricks.

They are manipulating time...

..in a sense..and, they are already defendants in a class action lawsuit because of  this, and other tactics used to fleece customers financially due to any customer errors, or any overdrafts that may have been caused regardless of customers register accuracy, such as unknown/unauthorized merchant holds and charges, as well as posting/processing times.

Whether any of this is/was actually legal or not WILL be decided by the courts, not any of us..but I believe it doesn't take that much brains to see there is something to this complaint. As a matter of fact, if you haven't yet received notice, there are already law changes that are at least addressing part of the issue. There is more to go but exposure and complaints is a good first step.

Some bank defenders will argue some rubbish about signing contracts and "terms and conditions", but what they will FAIL to mention..is there are contract laws in the USA that void a contract or make in unenforceable. Such as if anything illegal is in the contract, if any "element of unconscionability" is in the terms, if there was any "lack of good faith", consideration, meeting of the minds, "manifestly unfair",test of reasonableness which deals with whether the customer had the bargaining power to negotiate better terms etc..I could go on and on since I actually researched a little on contract law, and have a room mate who happens to be a UCLA law student. I think I can state this with a degree of merit.so any debate here? I got plenty more left.

U.S. Bank, JPMorgan Chase, Citibank and others. The complaints were filed in the United States District Court for the Southern District of Florida in Miami, where all federal lawsuits brought against the banking industry for abusive overdraft fees have been coordinated before the Honorable James Lawrence King.

    The collection of excessive overdraft fees, usually around $35 per transaction, impacts millions of Americans each year and has become a multibillion-dollar profit center for the banks

"The collection of excessive overdraft fees, usually around $35 per transaction, impacts millions of Americans each year and has become a multibillion-dollar profit center for the banks," explained lead plaintiffs counsel Bruce S. Rogow. "In many instances, these overdraft fees cost customers hundreds of dollars in a matter of days, or even hours, when they may be overdrawn by only a few dollars. Charging a $35 overdraft fee when a college student uses her debit card to buy a cup of coffee is unconscionable."

How Bank "Overdraft Protection" Works and Why the Abusive Collection of Overdraft Fees is a National Concern

Today, when customers open checking accounts, banks provide debit cards for the withdrawal of cash from ATM machines and the purchase of goods and services. Many bank customers are not aware that as part of the process of obtaining the debit card, banks automatically enroll their customers in "overdraft protection." The overdraft protection kicks in if the customer spends more than he or she has in the account to cover the purchase, up to a limit of a few hundred dollars.

Banks could simply decline to honor customer ATM or point-of-sale transactions if the account lacks sufficient funds, or could warn customers that if they go through with the transaction an overdraft fee will be assessed. In fact, until a few years ago, most banks simply declined debit transactions that would overdraw an account.

"Banks do not record charges and purchases on ATM or debit cards in the order they actually occur," stated plaintiffs counsel Michael W. Sobol of Lieff Cabraser Heimann & Bernstein, LLP. "Instead, banks reorder the charges and purchases so that the largest charge or purchase is the first one paid by the bank. This manipulative practice is intentionally designed, the complaints allege, to maximize overdraft fee revenue."

In 2007, banks collected more than $17 billion in overdraft fees. That number nearly doubled in 2008, as more and more consumers struggled to maintain positive checking account balances. In 2009, banks are expected to bring in up to $40 billion in overdraft charges from nearly 50 million customers.

"While all bank customers have been affected, these overdraft fee policies disproportionately affect young people, the elderly and the poor, who are most likely to maintain low account balances," noted Mr. Rogow. "Moreover, these fees have the tendency to create a domino effect, resulting in even more fees."

Bottom line: You admit that you overdrafted. You got a fee. You have no case. Take responsibility for your mistakes.

if you don't like what they did to you, and you can prove that beyond a shadow of a doubt that they altered banking reality then why don't you just take them to court and exercise your rights as an american citizen for god's sake. There is nothing in US Bank policy saying that you can't.



btw acting a little professional goes a long way in this business which runs every aspect of what we call... um... "our lives", but i guess i wouldnt expect you to know that since your in collections..... moving on. They gave you all info regarding how transactions post to accounts and you just shrug it off with the comment "they talk a good talk"... the fact is, the only reason they credited you back is because they're sorry a*s people... just like you... yep we're all in this bull s**t together. fun huh?

Looks like when you put US bank on blast nobody has anything to say..lol!! Where are all the people that like to login and post rebuttals about how stupid we as consumers must be for NOT keeping accurate records??? Fact is this bank and many others employ criminal-like tactics for profit! I dare anyone to say otherwise as I have watched this happen many times over. Because I have the money and the time, I've set up situations that would cause NSF's just to see if they(US Bank) follow their own policies as stated in the account contract and they don't. Best believe I'm keeping records for the imminent lawsuit that looms around the corner for this bank. I plan to collect accordingly..:-)
