Variation Media failed to deliver the product. After endless delays, now refuses to deliver the product/services or refund the money.
On 11/7/14 Variation Media, through Elliot Whyte agreed to build a web application for us for the total cost of $5,600. He agreed to have it completed withing 25 days. I paid him a deposit of $1,120.00 for the project and the other payments were to be split throughout the project. After many delays and excuses, he asked me for additional funds. In good faith, I paid an additional $560.00 on 11/28/24. After more delays and continually asking for more money,I sent him an email on 12/22/14 asking him to please clarify the timeline remaining on the project because I felt no real progress was being made on the project. In fact, ZERO portions of the web application have been delivered. The only thing has been shown to me is a handful of images that are completely useless. I also asked him to please deliver the portions of the site he claims were completed before I would pay and additional $560.00 which he invoiced me on 12/22/14.

Now Elliot Whyte is demanding that I wire money to him before he can deliver my website.  The fact that this company is suddenly demanding wire transfers and western union payments is exptremely alarming. Once a payment is wired, there is no way for one to recover any money.  I have always read to never send money in such a way.  

Either way, I am out of $1,680.00 and am suffering an indefinite delay in my business launch.  I wish these people could feel the hurt and and dispappointment they cause people like myself who have a business idea and put it completely in their hands to help us create it and then get scammed.  Maybe if they put themselves in our shoes, they wouldd't be such scammers.

Once again Elliot continues to lie.  I printed a copy of my account standing yesterday and it shows $0 dollars owed.  The invoice he sent on 12/22/14 has not been paid because he continue to fail to produce.

Still, after all this fuss. I STILL WANT MY WEBSITE.  I am willing to continue with original terms of the contract.  I just wish they would finish the work that was promised.

Please see my account standing as of 12/27/14.   I'm sure he'll go and falsify more documents now.

In Mr. Whyte's own respnse he copied and pasted m response which was willing to work with him in order to receive my completed website.  I as he correctly noted have agreed to pay any and all amounts for my completed site.  However he has been the one to change the terms.  Attached please see the email where in order for him to continue working on my site he wants to change the original terms of the agreement and is demanding copies of my credit cards and the agreements to not hold him liable to provide services.  SCAM!!!!

Variation Media and Elliot Whyte are a major scam!  After receiving my DEMAND LETTER, Elliot Whyte sent this to me today.
  
Hello Dawn,

I’ve spoken with my partners and we’ve decided we will continue to work on your project so long as the following terms are met;
- A Signed Letter of Authorization for all previous transactions ($1,120.00 & $560.00 including the Credit Card Used and Transaction ID on PayPal) 
- Copy of Government Issued ID
- Photocopy of Credit Card (Back & Front)
- Physical signed print out copy of Contract with Matching Credit Card Signature
- Credit Card Authorization for the next Milestone (#3) for the value of $560.00 ($651.33 CAD) 
- Letter recognizing that services have been rendered and continue to be rendered as agreed upon...
 
 

 Seriously???  this guy is asking for copies of credit cards... Is that even legal????

As the client mentioned, we begun working on their project on November 7th, 2014 after meeting through the website Freelancer.com. We had been discussing the project prior to where the client had been burned in the past by previous developers, I assured the client that we would have their best interests at heart and would ensure that the project was completed to the best of our abilities. Our normal policy for any new projects is a 50% deposit upon project signing and 50% upon project completion however because of the client's past we offered a Milestone payment system.

The client agreed to the milestone system in place which was outlined in the proposal prior to the plan created for the system which is as detailed below:

Milestone 3

Finalize Full Design & HTML/CSS

Milestone 4

Initial System Setup
 (Billing, User Login & Authentication, Listing Setup, Job Seeker & Employer Setup)

Milestone 5

50% System Completion
 (Full Listing Completion, Escrow & Finance System, Video Conferencing Setup, Administration Setup)

Milestone 6

Mobile Application Completion (Completion 20 days after Web Application Completion)

Milestone 7

18 Month Payment Period
 (Please use this time to test the system for any bugs or issues)

While working on the project we recognized that the designs would take longer then expected however we had to continue working on the platform itself so that we could meet the deadline which we later discussed which would be January 7th, 2015. We had already completed Milestone 4 and much of Milestone 3 being roughly 90% of the designs and the full initial system setup. While continuing we did realize that we had to restructure some of the milestone payments so that we could continue working on the project however we did recognize that the HTML/CSS had not be done with respects to the Milestone 3 payment. What we did was we took the requirements of Milestone 4 and the design portion of Milestone 3 and billed the client for $560.00 which is 10% of the project cost as per the cost of Milestone 3. After invoicing the client, the client became hostile threatening to file credit card chargebacks against the company as well as defame the company if we do not continue without payment. I explained to the client after showing them the results of all the work completed that with development and design somethings may take longer and that we do not want to hold back the project by following the Milestone system.

With the threats of a chargeback we requested that the client select another payment method to submit payments as it is quite a lengthy process dealing with credit card companies when a chargeback is filed for an intangible product. The client then began to defame the company calling us scammers and stating that we are looking to take her money after recognizing the work we've already done for her. I assured the client that we weren't looking to take any money that we didn't rightfully work for. The client then proceeded to file a dispute with PayPal which was awarded in our favour as their basis for a dispute was not supported by fact and we were able to provide proof of work. The client proceeded to slander the companies name via social media stating that we were looking to steal her website idea although we never mentioned such a thing.

We then attempted to come to an agreement with the client stating that although they are in breach of our serivce agreement we would continue to work with them if they would verify their transactions with us in writing (to protect ourselves from fraudulant chargebacks), provide us with government issued ID and a photo copy of their credit card with an authorization slip for the Milestone 3. The customer agreeed to provide us with a the following:

- Copy of Government Issued ID  **I have no problem sending you a copy of my government issued ID.**
- Photocopy of Credit Card (Back & Front) - **I have no problem sending you a copy of the credit card.  However, I will first check with the fraud department of the credit card.  If they consider that normal and acceptable, I will most certainly comply.**
- A Signed Letter of Authorization for all previous transactions ($1,120.00 & $560.00 including the Credit Card Used and Transaction ID on PayPal) - ** I have no problem signing such authorization as soon as the product is delivered as originally agreed**
- Physical signed print out copy of Contract with Matching Credit Card Signature -** I have no problem with this request**
- Credit Card Authorization for the next Milestone (#3) for the value of $560.00 ($651.33 CAD) ** I will make full payment for all services when they are actually delivered.  As you can see, good faith payments don't turn out so well for me**
- Letter recognizing that services have been rendered and continue to be rendered as agreed upon - I will gladly provide you with such letter when you render all services as agreed.  I can't provide a false statement in exchange for your promise to work.


After a long drawn out process I am now here responding to a claim which is false I will however admit to the following:

- The project has been delayed, after we created a full plan for the system we realized that the project would take longer then 30 days to complete and so we notified the client that we would finish it by the first week of January. The client accepted this and was happy with the date set forth.

- We did ask the client to choose a different payment method as a security measure

- We put forth all efforts to work with the client and come up with an amicable solution to get this matter resolved and the project completed

- We did threaten legal actions and will continue with such as we have proof of all work completed

- We will not be refunding the client as we have completed the work that has been paid for and more. The client's count is actually in a deficit currently and has been sent to collections.

Should anyone have any questions with regards to the project or want to validate it's working condition we would be MORE then happy to provide this proof as we have spent countless hours working on the project.
